    NOTICE OF PUBLIC HEARING

     

    Notice is hereby given that the Ohio Department of Mental Retardation and Developmental Disabilities will conduct a public hearing in accordance with Chapter

    119. of the Revised Code on November 17, 2003, beginning at 1:30 P.M. and continuing until all persons in attendance have had an opportunity to testify. The hearing will be

    held in the Administration Building Training Room of Columbus Developmental Center located at 1601 West Broad Street, Columbus, Ohio.

     

    At this hearing, the Department will accept oral and/or written testimony on the following community access model waiver, individual options waiver, and residential facility  waiver rules being proposed for permanent adoption, amendment and rescission on or about January 1, 2004:

     

    5123:1-2-04 Home and community-based services OBRA waiver and individual options (IO) waiver - Eligibility criteria for initial and continued enrollment. This rule is being proposed for rescission based on a review conducted pursuant to section

    119.032 of the Revised Code, and replaced with new rule 5123:2-13-02.

     

    5123:1-2-07  Allocation of home and community-based services (HCBS) waiver state matching fund for individual options (IO) and OBRA waivers. This rule is being proposed for rescission based on a review conducted pursuant to section 119.032 of the Revised Code, and replaced with new rule 5123:2-13-03.

     

    5123:1-2-12  Home and community-based services (HCBS) residential facility waiver - Eligibility criteria for initial and continued enrollment.  This rule is being proposed for rescission based on a review conducted pursuant to section 119.032 of the Revised Code, and replaced with proposed new rule 5123:2-11-02.

     

    5123:1-2-13  Allocation of residential services funds, including home and community-based services (HCBS) waiver state matching funds, for the residential facility waiver and funds for room and board for individuals enrolled on the individual options (IO) or OBRA waiver who reside in facilities licensed and operated in accordance with division (W) of section 5123.18 and section 5123.19 of the Revised Code.          This rule is being proposed for rescission based on a review conducted pursuant to section 119.032 of the Revised Code, and replaced with proposed new rule 5123:2-9-07.

     

    5123:2-9-01   HCBS waivers - Enrollment and disenrollment. This rule establishes the procedures for enrollment, denial of enrollment, and disenrollment of individuals in HCBS waivers and is being proposed for amendment to make revisions based on the new community access model waiver and the renewal of the residential facility waiver.

     

    5123:2-9-07   HCBS waivers - Allocation of residential services funds, including HCBS waiver state matching funds, for the residential facility waiver and funds for room and board for individuals enrolled in the individual options waiver who reside

     

     

     

     

     

     

    in facilities licensed in accordance with section 5123.19 of the Revised Code. This is a new rule being proposed for adoption to replace proposed rescinded rule 5123:1-2-07.

    5123:2-10-01 Community access model waiver - Definitions . This is a new rule being proposed for adoption to establish the definitions of terms used for the new community access model (CAM) waiver rules under Chapter 5123:2-10 of the Administrative Code.

    5123:2-10-02 Community access model waiver - Eligibility criteria for initial and continued enrollment. This is a new rule being proposed for adoption to establish the criteria for enrollment in the new community access model waiver and individual waiver service cost cap.

    5123:2-10-03 Community access model waiver - Benefit package. This is a new rule being proposed for adoption to describe the services available through the CAM waiver. The rule describes the conditions in which the following services are covered and any limitations for the coverage of any service: homemaker/personal care, transportation, environmental accessibility adaptations (home modifications), specialized medical equipment and supplies, institutional respite, intermittent nursing services, and

    community transition services (also known as "start up" costs).

    5123:2-10-04 Community access model waiver - Provider qualifications. This is a new rule being proposed for adoption to describe the qualifications that providers must meet in order to be certified as eligible providers for the community access model waiver. Denial or revocation standards are included in the rule.

    5123:2-10-05 Community access model waiver - Payment standards. This is a new rule being proposed for adoption to outline the standards that must be met by waiver providers in order to obtain reimbursement for community access model waiver services.

    5123:2-11-01 Residential facility waiver - Definitions. This is a new rule being proposed for adoption to establish the definitions of terms used for the residential facility waiver rules under Chapter 5123:2-11 of the Administrative Code.

    5123:2-11-02 Residential facility waiver - Eligibility criteria. This is a new rule being proposed for adoption to establish eligibility for the residential facility waiver. This rule  will replace proposed rescinded rule 5123:1-2-12.

    5123:2-13-01 Individual options waiver - Definitions. This is a new rule being proposed for adoption to establish the definitions of terms used for the individual options waiver rules under Chapter 5123:2-13 of the Administrative Code.

    5123:2-13-02 Individual options waiver - Eligibility criteria for initial and continued enrollment. This is a new rule being proposed for adoption to establish eligibility for the individual options waiver. This rule will replace proposed rescinded rule 5123:1-2-04.

    5123:2-13-03 Individual options waiver - Allocation of home and community-based services waiver state matching funds. This is a new rule being proposed for adoption to establish procedures for the allocation of home and community-based services waiver state matching funds for the individual options waiver. This rule will replace proposed rescinded rule 5123:1-2-07.

    Any written comments on the proposed rules submitted to the Department on or before the public hearing date will be treated as testimony.
