5139-2-15                    Prohibited activity relating to weapons, intoxicating liquors, tobacco products, drugs, unauthorized correspondence, communication devices, and hunting.

 

 

 

(A)   The purpose of this rule is to describe prohibited activities by department of youth services (ODYS) personnel, visitors, or trespassers to ODYS property and institutions. Prohibited activities are those deemed threatening to the safety and welfare of the youth.

 

(1)   All ODYS personnel and visitors will be responsible for the implementation of this rule.

 

(2)    The specific responsibility for the implementation of this rule rests with the managing officers of the ODYS institutions or their designees.

 

(B)   All ODYS personnel and all visitors are prohibited from conveying into any ODYS institution, or onto the grounds of any ODYS institution, the following items:

 

(1)    Weapons of any kind, or facsimiles thereof, including but not limited to any type of firearms, longbow, crossbow, sling shot, tomahawk, switchblade knife, or any knife with a blade over three inches. No person or persons will hunt, trap, or target practice on any ODYS property with any of the above weapons or facsimiles thereof.

 

(2)    Intoxicating liquors.Any intoxicating liquor, as defined in section 4301.01 of the Revised Code. An exception to prohibited conveying of certain items onto property of state facilities is provided in section 2921.36(B) of the Revised Code.

 

(3)   Any form of tobacco product.

 

(4)   Any medication, sedatives, stimulants, or narcotic drug for any youth except as officially requested by the managing officer of the institution. Personnel will not convey into any ODYS institution any stimulant, narcotic medicine, or drug for their own use without the authorization of the managing officer or staff member designated by the managing officer.

 

(5)    Letters or other forms of correspondence to or from ODYS youth who are confined in any ODYS institution, without authorization of the managing officer or staff members designated by the managing officer. This includes conveying correspondence out of the institution.

 

(6)    Any communication or recording device, including but not limited to pager,

 

 

cellular phone, walkie-talkie, or camera, not issued by the state of Ohio unless authorized by the managing officer or designee.

(C)    The managing officer of all ODYS institutions will immediately bring all possible violations of this rule to the attention of the deputy director of the division of institutions and the chief inspector's office. The managing officer of all ODYS institutions will immediately bring all possible violations of this rule to the attention of the deputy director of the division responsible for institutions and the chief inspector's office.

(D)    Violations of this rule may result in the arrest and/or possible criminal prosecution against the employee, visitor, or trespasser pursuant to section 2921.37 of the Revised Code for violations under section 2921.36 of the Revised Code.

(E)    Law enforcement officers are to be asked to deposit their weapons in the trunk of their vehicle or in a locked box outside of the institution's secure perimeter. Law enforcement officers will only be permitted to carry weapons into a secure perimeter of an institution with the approval of the director of the agency.
