    NOTICE OF PUBLIC HEARING TO ADOPT RULE

    The Office of the Secretary of State will hold a public hearing on Tuesday, November 23, 2010, at 10:00 a.m. on the 11th floor in the PUCO 11B Hearing Room of the Continental Plaza Building, located at 180 East Broad Street, Columbus, Ohio 43215. Visitors must register at the front desk in the first floor lobby before proceeding to the 11th floor. The purpose of the hearing is to solicit public comment on the following rules:

     

    ·         111-6-01: Delineates the use of an electronic signature through an assigned user name and password by a campaign entity before filing electronic statements through the Secretary of State's office.

    ·         111-6-02: Requires the secretary of state's office to issue electronic acknowledgement of a properly processed campaign finance statement.

    ·         111-6-03: Requires that any entity filing a campaign finance electronic transmission must also make copies on paper and submit them to their respective county board of elections.

    ·         111-11-01: Defines the terms used in Chapter 111-11: UCC Filings, Fees, and Records.

     

    ·         111-11-02: Delineates the procedure of delivery for the filing of tendered UCC filings.

     

    ·         111-11-03: Delineates the procedure of delivery for UCC search requests.

     

    ·         111-11-04: Allows for the acceptance of forms prescribed in Ohio Revised Code (ORC) section 1309.521 for the filing office.

    ·         111-11-05: Delineates the methods of payments that are accepted for public record services fees and filing fees.

    ·         111-11-06: Delineates the procedure for correcting overpayment and underpayment for public record services fees and filing fees.

    ·         111-11-07: Delineates the methods that may be utilized for the obtaining of copies of UCC data from the UCC information management system.

    ·         111-11-20: Determines the responsibilities and role of a filing officer.

     

    ·         111-11-21: Delineates the deadline for the filing of a continuation statement.

     

    ·         111-11-22: Delineates the grounds by which a filing officer may refuse to provide a UCC record, under the provisions of section 1309.516 of the ORC.

     

     

     

     

     

     

    ·         111-11-23: Delineates the procedure of a refusal to provide a UCC record by a filing officer.

    ·         111-11-24: Regards the responsibilities of a filing officer to inform a filer or remitter that there are discrepancies or defects on a UCC record.

    ·         111-11-25: Delineates the procedure by which a filer or remitter may follow when it can be proven that a UCC filing record that has been rejected should not have been rejected.

    ·         111-11-30: Regards the information management system that a filing officer uses for statements.

    ·         111-11-31: Delineates the primary data elements that will be used in the UCC information management system.

    ·         111-11-32: Regards the input of data for names of individuals on a UCC record in the UCC information management system.

    ·         111-11-33: Regards the input of data for names of organizations on a UCC record in the UCC information management system.

    ·         111-11-34: Regards the treatment of estates in the UCC information management system under rule 111-11-32 of the Ohio Administrative Code

    ·         111-11-35: Delineates the use of a trust in the UCC information management system.

    ·         111-11-36: Regards the status of parties and of a financing statement upon an initial filing in the UCC information management system.

    ·         111-11-37: Regards the status of parties and of a financing statement upon the filing of an amendment in the UCC information management system.

    ·         111-11-39: Determines the length of postponement of a lapse date when a secured party/parties has timely filed a financing continuation statement.

    ·         111-11-40: Delineates the procedure of termination in regards to the status of a party and of a financing statement.

    ·         111-11-41: Delineates the procedure of a correction statement in regards to the status of a party and of a financing statement.

    ·         111-11-42: Regards the procedure for the status of a financing statement that has lapsed within the UCC information management system.

    ·         111-11-43: Regards customer accessibility of financing statement records.

    ·         111-11-50: Regards the correction of errors made within the UCC information management system.

    ·         111-11-51: Delineates the procedure by which a filing can designate the name of an individual or the name of an organization in designated data-entry fields in the UCC information management system.

    ·         111-11-60: Delineates that a filing officer must maintain a searchable index of all UCC records.

    ·         111-11-61: Regards the information search requests must contain within the UCC information management system.

    ·         111-11-62: Delineates the rules that will be applied to search requests within the UCC information management system.

    ·         111-11-63: Regards information that is optional for including within the UCC information management system.

    All interested persons are invited to attend the hearing and present testimony.  All written statements must be received by the Office at the close of the hearing record.  If you wish to provide comments, please register at the hearing prior to the start of the hearing.
