    3770:1-9-415               Game rule number four hundred fifteen.

     

     

     

    (A)    Title and term. Ohio lottery commission game rule number four hundred fifteen, "New Year's Cash," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number four hundred fifteen.

     

    (B)  General design.

     

    (1)   Game rule number four hundred fifteen is a key number match game with an additional instant win feature and a "Bonus" feature, and is generally known as an "instant lottery."

     

    (2)    Holders of valid tickets will remove the covering off the entire play area to reveal two "Winning Numbers," ten "Your Numbers" and ten corresponding prize values. If the player matches any one or more of "Your Number(s)" to either of the "Winning Number(s)," the player wins the corresponding prize value shown below the matching "Your Number(s)." If the player reveals a "Clock" symbol in any of the "Your Numbers" play spots, the player wins ten times the corresponding prize value automatically. The player will then remove the covering off the "Bonus" box play area to reveal either the "Try Again" symbol or the "2005" symbol. If the player reveals the "2005" symbol in the "Bonus" box play area, the player wins twenty dollars automatically. There are ten chances to win on each ticket, and a player may win up to ten times on one ticket.

     

    (3)   As used in this rule, "prize award" shall mean one of the following monetary amounts which is the total of all winning prize values appearing on the ticket: two dollars, four dollars, ten dollars, twenty dollars, forty dollars, one hundred dollars, two thousand five dollars and twenty-two thousand five dollars. Each ticket in game rule number four hundred fifteen shall be imprinted in such a way that prize awards from the set listed above may be won.

     

    (C)   Price of tickets. The price of a ticket issued by the commission in game rule number four hundred fifteen shall be two dollars.

     

    (D)  Structure, nature and value of prize awards.

     

     

     

     

    (1)   There shall be one type of prize in game rule number four hundred fifteen called a "regular prize award."

    (2)   The only "prize values" which shall appear on a ticket in game rule number four hundred fifteen are: one dollar, two dollars, three dollars, four dollars, five dollars, six dollars, ten dollars, fifteen dollars, twenty dollars, forty dollars, fifty dollars, one hundred dollars, two thousand five dollars and twenty-two thousand five dollars. Numbers, prize values and play symbols shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.

    (a)    Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" for one dollar two times; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of two dollars;

    (b)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for two dollars once; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of two dollars;

    (c)    Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by four of "Your Numbers" for one dollar four times; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of four dollars;

    (d)  Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for four dollars once; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of four dollars;

    (e)    Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" for two dollars two times; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of four dollars;

    (f)   Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" for one dollar once and three dollars once; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of four dollars;

    (g)    Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by all ten of "Your Numbers" for one dollar ten times; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of ten dollars;

    (h)   Holder of a valid winning ticket on which a "Clock" symbol is revealed in one of the "Your Numbers" play spots for one dollar ten times; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of ten dollars;

    (i)    Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by five of "Your Numbers" for two dollars five times; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of ten dollars;

    (j)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for ten dollars once; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of ten dollars;

    (k)   Holder of a valid winning ticket on which a "Clock" symbol is revealed in one of the "Your Numbers" play spots for two dollars ten times; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of twenty dollars;

    (l)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for twenty dollars once; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of twenty dollars;

    (m)   Holder of a valid winning ticket on which a "2005" symbol is revealed in the "Bonus" box play area for twenty dollars shall win a regular prize award of twenty dollars;

    (n)   Holder of a valid winning ticket on which a "Clock" symbol is revealed in one of the "Your Numbers" play spots for four dollars ten times; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of forty dollars;

    (o)    Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" for five dollars once and fifteen dollars once; and on which a "2005" symbol is revealed in

    the "Bonus" box play area for twenty dollars shall win a regular prize award of forty dollars;

    (p)    Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by eight of "Your Numbers" for five dollars eight times; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of forty dollars;

    (q)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for forty dollars once; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of forty dollars;

    (r)   Holder of a valid winning ticket on which a "Clock" symbol is revealed in one of the "Your Numbers" play spots for ten dollars ten times; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of one hundred dollars;

    (s)    Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" for fifty dollars two times; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of one hundred dollars;

    (t)   Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by nine of "Your Numbers" for six dollars five times, ten dollars three times and twenty dollars once; and on which a "2005" symbol is revealed in the "Bonus" box play area for twenty dollars shall win a regular prize award of one hundred dollars;

    (u)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for one hundred dollars once; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of one hundred dollars;

    (v)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for two thousand five dollars once; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of two thousand five dollars; and

    (w)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for twenty-two thousand five

    dollars once; and on which a "Try Again" symbol is revealed in the "Bonus" box play area shall win a regular prize award of twenty-two thousand five dollars.

    (E)   Number of prize awards. The number of prize awards in any sales cycle of game rule number four hundred fifteen will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that:

    (1)   Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance;

    (2)    Mathematical reasoning indicates that the number of winning tickets per five million two hundred thousand tickets sold in the following categories should be as follows:

    (a)    Twenty tickets matching numbers for twenty-two thousand five dollars once; and revealing the "Try Again" symbol in the "Bonus" box play area to win twenty-two thousand five dollars; and

    (b)   Sixteen tickets matching numbers for two thousand five dollars once; and revealing the "Try Again" symbol in the "Bonus" box play area to win two thousand five dollars.

    (3)   Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:

    (a)   Ten tickets matching numbers for one hundred dollars once; and revealing the "Try Again" symbol in the "Bonus" box play area to win one hundred dollars;

    (b)   Ten tickets matching numbers for six dollars five times, ten dollars three times and twenty dollars once; and revealing the "2005" symbol for twenty dollars in the "Bonus" box play area to win one hundred dollars;

    (c)    Ten tickets matching numbers for fifty dollars two times; and revealing the "Try Again" symbol in the "Bonus" box play area to win one hundred dollars;

    (d)     Ten tickets winning ten dollars ten times by revealing the "Clock" symbol; and revealing the "Try Again" symbol in the "Bonus" box play area to win one hundred dollars;

    (e)    One hundred fifty tickets matching numbers for forty dollars once; and revealing the "Try Again" symbol in the "Bonus" box play area to win forty dollars;

    (f)   Two hundred tickets matching numbers for five dollars eight times; and revealing the "Try Again" symbol in the "Bonus" box play area to win forty dollars;

    (g)    Six hundred tickets matching numbers for five dollars once and fifteen dollars once; and revealing the "2005" symbol for twenty dollars in the "Bonus" box play area to win forty dollars;

    (h)     Six hundred tickets winning four dollars ten times by revealing the "Clock" symbol; and revealing the "Try Again" symbol in the "Bonus" box play area to win forty dollars;

    (i)   One thousand tickets revealing the "2005" symbol for twenty dollars in the "Bonus" box play area to win twenty dollars;

    (j)     Five hundred tickets matching numbers for twenty dollars once; and revealing the "Try Again" symbol in the "Bonus" box play area to win twenty dollars;

    (k)     Five hundred tickets winning two dollars ten times by revealing the "Clock" symbol; and revealing the "Try Again" symbol in the "Bonus" box play area to win twenty dollars;

    (l)   Five hundred tickets matching numbers for ten dollars once; and revealing the "Try Again" symbol in the "Bonus" box play area to win ten dollars;

    (m)    Five hundred tickets matching numbers for two dollars five times; and revealing the "Try Again" symbol in the "Bonus" box play area to win ten dollars;

    (n)     One thousand five hundred tickets winning one dollar ten times by revealing the "Clock" symbol; and revealing the "Try Again" symbol in the "Bonus" box play area to win ten dollars;

    (o)     Five hundred tickets matching numbers for one dollar ten times; and revealing the "Try Again" symbol in the "Bonus" box play area to win ten dollars;

    (p)    Two thousand tickets matching numbers for one dollar once and three dollars once; and revealing the "Try Again" symbol in the "Bonus" box play area to win four dollars;

    (q)    Two thousand tickets matching numbers for two dollars two times; and revealing the "Try Again" symbol in the "Bonus" box play area to win four dollars;

    (r)      Four thousand tickets matching numbers for four dollars once; and revealing the "Try Again" symbol in the "Bonus" box play area to win four dollars;

    (s)    Four thousand tickets matching numbers for one dollar four times; and revealing the "Try Again" symbol in the "Bonus" box play area to win four dollars;

    (t)      Ten thousand tickets matching numbers for two dollars once; and revealing the "Try Again" symbol in the "Bonus" box play area to win two dollars; and

    (u)   Fifteen thousand tickets matching numbers for one dollar two times; and revealing the "Try Again" symbol in the "Bonus" box play area to win two dollars.

    (F)   Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G)  Frequency of prize drawings.

    (1)    Random imprinting of prize awards on all tickets issued in game rule number four hundred fifteen shall be accomplished in a manner which complies with the commission's rules.

    (2)     When a ticket issued in game rule number four hundred fifteen is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols

    on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day on the sales cycle of game rule number four hundred fifteen in which the ticket was sold.

    (H)    Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prizes which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I)  Validity of tickets.

    (1)   A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2)   In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number four hundred fifteen void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed, or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J)   Director's conduct of game rule number four hundred fifteen.

    (1)   The director shall conduct game rule number four hundred fifteen in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number four

    hundred fifteen. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2)    Names and definitions of elements of game rule number four hundred fifteen used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number four hundred fifteen and these elements may be given names or titles chosen by the commission.
