    3770:1-9-436               Game rule number four hundred thirty-six.

     

     

     

    (A)   Title and term. Ohio lottery commission game rule number four hundred thirty-six, "Ohio Millionaire," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number four hundred thirty-six.

     

    (B)  General design.

     

    (1)    Game rule number four hundred thirty-six is an instant lottery game within which are contained five separate games. To win a prize award(s), the player is required to scratch off the covering and do one or more of the following:

     

    (a)    "Game 1" - The player reveals two play symbols which may include: "Gold Bar;" "Diamond;" "Star;" "Pot of Gold;" "Coin;" and "Stack of Cash." The player must match two like play symbols to win fifty dollars automatically.

     

    (b)    "Game 2" - The player reveals two play symbols which may include: "Cherries;" "Bell;" "Crown;" "Clover;" "Bar;" and "Pineapple." The player must match two like play symbols to win the corresponding prize value revealed.

     

    (c)    "Game 3" - The player reveals seven play symbols which may include: "Horseshoe;" "Moneybag;" "Piggy Bank;" "Wish Bone;" "Lemon;" "Banana;" "Orange;" "Melon;" "Stack of Cash;" and "Coin." If the player reveals a "Moneybag" symbol, the player wins the corresponding prize value shown below that symbol.

     

    (d)    "Game 4" - This is a match three of six lottery game. The player will remove the covering over the play area to reveal six prize values. If three of the six prize values revealed match, the player wins the matched prize value. If two of the six prize values revealed match a "Double Dollar Sign" symbol is revealed, the player wins double the matched prize value automatically.

     

    (e)    "Game 5" - This will be a "Key Amount Match" style game. The player will remove the covering over the play area to reveal three "Winning Amounts" and ten "Your Amounts." The player must match any one or

     

     

    more of "Your Amounts" to one or more of the "Winning Amounts" to win the matched prize values. If any one or more of "Your Amounts" match one or more of the "Winning Amounts" and a "Star" symbol is revealed in any of the "Your Amounts" play area, the player wins double the total of the matching prize values automatically. If the player matches the "$7.5 Mil" symbol in one of the "Your Amounts" play area to the "$7.5 Mil" symbol in one of the "Winning Amounts" play area, the player wins the "Annuity Prize Award" of two hundred fifty thousand dollars per year for thirty years (before taxes) or the "Elected Cash-Option Prize Award" of approximately four million dollars before taxes in lieu of the "Annuity Prize Award." If the player matches the "TPD" symbol revealed in the "Your Amounts" play area to the "TPD" symbol revealed in the "Winning Amounts" play area, the player wins two thousand five hundred dollars automatically, and, upon the filing of a valid claim at an Ohio lottery commission office, shall also automatically be entered in the Top Prize Drawing ("TPD") to win the "Annuity Prize Award" of two hundred fifty thousand dollars per year for thirty years (before taxes) or the "Elected Cash-Option Prize Award" of approximately four million dollars before taxes in lieu of the "Annuity Prize Award." The Top Prize Drawing shall be conducted in accordance with Ohio lottery rules and procedures established and approved by the director.

    (2)    As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: twenty dollars, twenty-five dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, two thousand five hundred dollars, five thousand dollars, ten thousand dollars, fifty thousand dollars and the "Annuity Prize Award" consisting of seven million five hundred thousand dollars to be paid out in installments of two hundred fifty thousand dollars per year for thirty years before taxes) or the "Elected Cash-Option Prize Award" of approximately four million dollars before taxes in lieu of the "Annuity Prize Award." Each ticket in game rule number four hundred thirty-six shall be imprinted in such a way that prize awards from the set listed above may be won.

    (C)   Price of tickets. The price of a ticket issued by the commission in game rule number four hundred thirty-six shall be twenty dollars.

    (D)  Structure, nature and value of prize awards.

    (1)   There shall be two types of prizes in game rule number four hundred thirty-six, a "regular prize award" and a "TPD" prize award.

    (2)   The only "prize values" which shall appear on a ticket in game rule number four hundred thirty-six are those listed as follows:

    (a)   "Game 1" - Fifty dollars.

    (b)     "Game 2" - Five dollars, ten dollars, fifteen dollars, twenty dollars, twenty-five dollars, one hundred dollars, two hundred fifty dollars, five hundred dollars, one thousand dollars, five thousand dollars and ten thousand dollars.

    (c)    "Game 3" - Five dollars, ten dollars, fifteen dollars, twenty-five dollars, thirty dollars, fifty dollars, one hundred dollars, two hundred fifty dollars, five hundred dollars and one thousand dollars.

    (d)   "Game 4" - Five dollars, ten dollars, fifteen dollars, twenty-five dollars, fifty dollars, one hundred dollars, two hundred fifty dollars, five hundred dollars, five thousand dollars and fifty thousand dollars.

    (e)    "Game 5" - Five dollars, ten dollars, twenty dollars, twenty-five dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, the "TPD" symbol corresponding to a prize value of two thousand five hundred dollars, five thousand dollars, ten thousand dollars, fifty thousand dollars and the "Annuity Prize Award" consisting of seven million five hundred thousand dollars to be paid out in installments of two hundred fifty thousand dollars per year for thirty years before taxes) or the "Elected Cash-Option Prize Award" of approximately four million dollars before taxes in lieu of the "Annuity Prize Award."

    (3)    Numbers, prize values and play symbols appearing on any ticket in game rule number four hundred thirty-six shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.

    (a)   Holder of a valid winning ticket matching two like play symbols for five dollars in "Game 2;" on which a "Moneybag" symbol is revealed for five dollars once in "Game 3;" matching three like prize values for five dollars in "Game 4;" and on which one of the "Wining Amounts" is matched by one of "Your Amounts" for five dollars once in "Game 5" shall win a regular prize award of twenty dollars;

    (b)    Holder of a valid winning ticket matching two like play symbols for

    twenty dollars in "Game 2" shall win a regular prize award of twenty dollars;

    (c)    Holder of a valid winning ticket matching two like prize values and a "Double Dollar Sign" symbol is revealed for five dollars doubled in "Game 4;" and on which one of the "Winning Amounts" is matched by one of "Your Amounts" for ten dollars once in "Game 5" shall win a regular prize award of twenty dollars;

    (d)  Holder of a valid winning ticket on which one of the "Winning Amounts" is matched by one of "Your Amounts" for ten dollars and a "Star" symbol is revealed in one of the "Your Amounts" play area in "Game 5" shall win a regular prize award of twenty dollars;

    (e)   Holder of a valid winning ticket matching two like play symbols for five dollars in "Game 2;" on which a "Moneybag" symbol is revealed for ten dollars once in "Game 3;" and matching three like prize values for ten dollars in "Game 4" shall win a regular prize award of twenty-five dollars;

    (f)    Holder of a valid winning ticket matching two like play symbols for fifteen dollars in "Game 2;" and on which one or more of the "Winning Amounts" are matched by two of "Your Amounts" for five dollars two times in "Game 5" shall win a regular prize award of twenty-five dollars;

    (g)     Holder of a valid winning ticket on which a "Moneybag" symbol is revealed for twenty-five dollars once in "Game 3" shall win a regular prize award of twenty-five dollars;

    (h)   Holder of a valid winning ticket on which five "Moneybag" symbols are revealed for five dollars five times in "Game 3" shall win a regular prize award of twenty-five dollars;

    (i)   Holder of a valid winning ticket on which one of the "Winning Amounts" is matched by one of "Your Amounts" for twenty-five dollars once in "Game 5" shall win a regular prize award of twenty-five dollars;

    (j)   Holder of a valid winning ticket matching two like play symbols for fifty dollars in "Game 1" shall win a regular prize award of fifty dollars;

    (k)   Holder of a valid winning ticket on which one or more of the "Winning

    Amounts" are matched by five of "Your Amounts" for five dollars five times and a "Star" symbol is revealed in one of the "Your Amounts" play area in "Game 5" shall win a regular prize award of fifty dollars;

    (l)   Holder of a valid winning ticket on which seven "Moneybag" symbols are revealed for five dollars seven times in "Game 3;" matching three like prize values for five dollars in "Game 4;" and on which one or more of the "Winning Amounts" are matched by two of "Your Amounts" for five dollars two times in "Game 5" shall win a regular prize award of fifty dollars;

    (m)     Holder of a valid winning ticket matching two like play symbols for twenty-five dollars in "Game 2;" matching two like prize values and a "Double Dollar Sign" symbol is revealed for ten dollars doubled in "Game 4;" and on which one of the "Winning Amounts" is matched by one of "Your Amounts" for five dollars once in "Game 5" shall win a regular prize award of fifty dollars;

    (n)   Holder of a valid winning ticket on which three "Moneybag" symbols are revealed for five dollars once, fifteen dollars once and thirty dollars once in "Game 3" shall win a regular prize award of fifty dollars;

    (o)    Holder of a valid winning ticket matching two like play symbols for twenty  dollars  in  "Game  2;"  matching  two  like  prize  values  and  a "Double Dollar Sign" symbol is revealed for five dollars doubled  in "Game 4;" and on which one or more of the "Winning Amounts" are matched  by  four  of  "Your  Amounts"  for  five  dollars  four  times in "Game 5" shall win a regular prize award of fifty dollars;

    (p)   Holder of a valid winning ticket on which one of the "Winning Amounts" is matched by one of "Your Amounts" for fifty dollars once in "Game 5" shall win a regular prize award of fifty dollars;

    (q)   Holder of a valid winning ticket matching two like play symbols for fifty dollars in "Game 1;" matching two like play symbols for ten dollars in "Game 2;" on which a "Moneybag" symbol is revealed for ten dollars once in "Game 3;" matching three like prize values for ten dollars in "Game 4;" and on which one of the "Winning Amounts" is matched by one of "Your Amounts" for ten dollars once and a "Star" symbol is revealed in one of the "Your Amounts" play area in "Game 5" shall win a regular prize award of one hundred dollars;

    (r)   Holder of a valid winning ticket matching two like play symbols for fifty

    dollars in "Game 1;" on which seven "Moneybag" symbols are revealed for five dollars seven times in "Game 3;" and on which one or more of the "Winning Amounts" are matched by three of "Your Amounts" for five dollars three times in "Game 5" shall win a regular prize award of one hundred dollars;

    (s)   Holder of a valid winning ticket matching two like play symbols for fifty dollars in "Game 1;" and on which one of the "Winning Amounts" is matched by one of "Your Amounts" for twenty-five dollars once and a "Star" symbol is revealed in one of the "Your Amounts" play area in "Game 5" shall win a regular prize award of one hundred dollars;

    (t)   Holder of a valid winning ticket matching two like play symbols for one hundred dollars in "Game 2" shall win a regular prize award of one hundred dollars;

    (u)   Holder of a valid winning ticket on which four "Moneybag" symbols are revealed for five dollars two times and thirty dollars two times in "Game 3;" and matching two like prize values and a "Double Dollar Sign" symbol is revealed for fifteen dollars doubled in "Game 4" shall win a regular prize award of one hundred dollars;

    (v)   Holder of a valid winning ticket on which one or more of the "Winning Amounts" are matched by all ten of "Your Amounts" for ten dollars ten times in "Game 5" shall win a regular prize award of one hundred dollars;

    (w)    Holder of a valid winning ticket on which a "Moneybag" symbol is revealed for one hundred dollars once in "Game 3" shall win a regular prize award of one hundred dollars;

    (x)   Holder of a valid winning ticket on which one of the "Winning Amounts" is matched by one of "Your Amounts" for one hundred dollars once in "Game 5" shall win a regular prize award of one hundred dollars;

    (y)   Holder of a valid winning ticket matching two like play symbols for five hundred dollars in "Game 2" shall win a regular prize award of five hundred dollars;

    (z)    Holder of a valid winning ticket matching two like prize values and a "Double Dollar Sign" symbol is revealed for two hundred fifty dollars doubled in "Game 4" shall win a regular prize award of five hundred

    dollars;

    (aa) Holder of a valid winning ticket matching two like play symbols for fifty dollars in "Game 1;" matching two like play symbols for twenty-five dollars in "Game 2;" on which seven "Moneybag" symbols are revealed for fifty dollars seven times in "Game 3;" matching three like prize values for twenty-five dollars in "Game 4;" and on which one or more of the "Winning Amounts" are matched by all ten of "Your Amounts" for five dollars ten times in "Game 5" shall win a regular prize award of five hundred dollars;

    (bb) Holder of a valid winning ticket matching two like play symbols for fifty dollars in "Game 1;" matching two like play symbols for one hundred dollars in "Game 2;" on which five "Moneybag" symbols are revealed for ten dollars five times in "Game 3;" matching two like prize values and a "Double Dollar Sign" symbol is revealed for fifty dollars doubled in "Game 4;" and on which one or more of the "Winning Amounts" are matched by five of "Your Amounts" for twenty dollars five times and a "Star" symbol is revealed in one of the "Your Amounts" play area in "Game 5" shall win a regular prize award of five hundred dollars;

    (cc) Holder of a valid winning ticket matching two like play symbols for two hundred fifty dollars in "Game 2;" on which a "Moneybag" symbol is revealed for fifty dollars once in "Game 3;" matching three like prize values for one hundred dollars in "Game 4;" and on which one or more of the "Winning Amounts" are matched by five of "Your Amounts" for ten dollars five times and a "Star" symbol is revealed in one of the "Your Amounts" play area in "Game 5" shall win a regular prize award of five hundred dollars;

    (dd) Holder of a valid winning ticket on which one of the "Winning Amounts" is matched by one of "Your Amounts" for five hundred dollars once in "Game 5" shall win a regular prize award of five hundred dollars;

    (ee) Holder of a valid winning ticket matching two like play symbols for fifty dollars in "Game 1;" matching two like play symbols for five hundred dollars in "Game 2;" on which seven "Moneybag" symbols are revealed for twenty-five dollars seven times in "Game 3;" matching three like prize values for twenty-five dollars in "Game 4;" and on which one or more of the "Winning Amounts" are matched by all ten of "Your Amounts" for twenty-five dollars ten times in "Game 5" shall win a regular prize award of one thousand dollars;

    (ff) Holder of a valid winning ticket matching two like play symbols for two hundred fifty dollars in "Game 2;" on which a "Moneybag" symbol is revealed for two hundred fifty dollars once in "Game 3;" matching three like prize values for two hundred fifty dollars in "Game 4;" and on which one or more of the "Winning Amounts" are matched by five of "Your Amounts" for twenty-five dollars five times and a "Star" symbol is revealed in one of the "Your Amounts" play area in "Game 5" shall win a regular prize award of one thousand dollars;

    (gg) Holder of a valid winning ticket on which one of the "Winning Amounts" is matched by one of "Your Amounts" for one thousand dollars once in "Game 5" shall win a regular prize award of one thousand dollars;

    (hh) Holder of a valid winning ticket on which the "TPD" prize symbol revealed in one of the "Winning Amounts" play area is matched by the "TPD" prize symbol revealed in one of the "Your Amounts" play area for two thousand five hundred dollars, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing to win the "Annuity Prize Award" of two hundred fifty thousand dollars per year for thirty years (before taxes) or the "Elected Cash-Option Prize Award" of approximately four million dollars before taxes in lieu of the "Annuity Prize Award;"

    (ii) Holder of a valid winning ticket matching two like play symbols for one thousand dollars in "Game 2;" on which a "Moneybag" symbol is revealed for one thousand dollars once in "Game 3;" matching two like prize values and a "Double Dollar Sign" symbol is revealed for five hundred dollars doubled in "Game 4;" and on which one or more of the "Winning Amounts" are matched by two of "Your Amounts" for one thousand dollars two times in "Game 5" shall win a regular prize award of five thousand dollars;

    (jj) Holder of a valid winning ticket matching two like play symbols for five thousand dollars in "Game 2" shall win a regular prize award of five thousand dollars;

    (kk) Holder of a valid winning ticket matching three like prize values for five thousand dollars in "Game 4" shall win a regular prize award of five thousand dollars;

    (ll) Holder of a valid winning ticket on which one of the "Winning Amounts"

    is matched by one of "Your Amounts" for five thousand dollars once in "Game 5" shall win a regular prize award of five thousand dollars;

    (mm) Holder of a valid winning ticket matching two like play symbols for one thousand dollars in "Game 2;" on which seven "Moneybag" symbols are revealed for five hundred dollars seven times in "Game 3;" matching three like prize values for five hundred dollars in "Game 4;" and on which one or more of the "Winning Amounts" are matched by five of "Your Amounts" for five hundred dollars five times and a "Star" symbol is revealed in one of the "Your Amounts" play area in "Game 5" shall win a regular prize award of ten thousand dollars;

    (nn) Holder of a valid winning ticket on which one of the "Winning Amounts" is matched by one of "Your Amounts" for ten thousand dollars once in "Game 5" shall win a regular prize award of ten thousand dollars;

    (oo) Holder of a valid winning ticket matching two like play symbols for ten thousand dollars in "Game 2;" on which seven "Moneybag" symbols are revealed for one thousand dollars seven times in "Game 3;" matching two like prize values and a "Double Dollar Sign" symbol is revealed for five thousand dollars doubled in "Game 4;" and on which one or more of the "Winning Amounts" are matched by seven of "Your Amounts" for one thousand dollars three times and five thousand dollars four times in "Game 5" shall win a regular prize award of fifty thousand dollars;

    (pp) Holder of a valid winning ticket matching three like prize values for fifty thousand dollars in "Game 4" shall win a regular prize award of fifty thousand dollars;

    (qq) Holder of a valid winning ticket on which one of the "Winning Amounts" is matched by one of "Your Amounts" for fifty thousand dollars once in "Game 5" shall win a regular prize award of fifty thousand dollars; and

    (rr) Holder of a valid winning ticket on which the "$7.5 Mil" prize symbol revealed in one of the "Winning Amounts" play area is matched by the "$7.5 Mil" prize symbol in one of the "Your Amounts" play area in "Game 5" to win the "Annuity Prize Award" of two hundred fifty thousand dollars per year for thirty years (before taxes) or the "Elected Cash-Option Prize Award" of approximately four million dollars before taxes in lieu of the "Annuity Prize Award."

    (E)   Number of prize awards. The number of prize awards in any sales cycle of game rule number four hundred thirty-six will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that:

    (1)   Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2)    Mathematical reasoning indicates that the number of winning tickets per four million tickets sold should be as follows:

    (a)    Two tickets winning the "Annuity Prize Award" of two hundred fifty thousand dollars per year for thirty years (before taxes) or the "Elected Cash-Option Prize Award" of approximately four million dollars before taxes in lieu of the "Annuity Prize Award;"

    (b)    One ticket winning fifty thousand dollars once in "Game 5" to win fifty thousand dollars;

    (c)     One ticket winning fifty thousand dollars in "Game 4" to win fifty thousand dollars;

    (d)    Two tickets winning ten thousand dollars in "Game 2;" one thousand dollars seven times in "Game 3;" five thousand dollars doubled in "Game 4;" and one thousand dollars three times and five thousand dollars four times in "Game 5" to win fifty thousand dollars;

    (e)    Five tickets winning ten thousand dollars once in "Game 5" to win ten thousand dollars;

    (f)    Five tickets winning one thousand dollars in "Game 2;" five hundred dollars seven times in "Game 3;" five hundred dollars in "Game 4;" and five hundred dollars five times with a "Star" symbol in "Game 5" to win ten thousand dollars;

    (g)   Eight tickets winning five thousand dollars once in "Game 5" to win five thousand dollars;

    (h)     Four  tickets  winning  five  thousand  dollars  in  "Game  4"  to  win  five

    thousand dollars;

    (i)     Four tickets winning five thousand dollars in "Game 2" to win five thousand dollars; and

    (j)    Eight tickets winning one thousand dollars in "Game 2;" one thousand dollars once in "Game 3;" five hundred dollars doubled in "Game 4;" and one thousand dollars two times in "Game 5" to win five thousand dollars.

    (3)   Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:

    (a)    One ticket winning the "TPD" prize symbols in "Game 5" to win two thousand five hundred dollars, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top prize Drawing to win the "Annuity Prize Award" of two hundred fifty thousand dollars per year for thirty years (before taxes) or the "Elected Cash-Option Prize Award" of approximately four million dollars before taxes in lieu of the "Annuity Prize Award;"

    (b)    Two tickets winning one thousand dollars once in "Game 5" to win one thousand dollars;

    (c)   Three tickets winning two hundred fifty dollars in "Game 2;" two hundred fifty dollars once in "Game 3;" two hundred fifty dollars in "Game 4;" and twenty-five dollars five times with a "Star" symbol in "Game 5" to win one thousand dollars;

    (d)   Three tickets winning fifty dollars in "Game 1;" five hundred dollars in "Game 2;" twenty-five dollars seven times in "Game 3;" twenty-five dollars in "Game 4;" and twenty-five dollars ten times in "Game 5" to win one thousand dollars;

    (e)    Fifty tickets winning five hundred dollars once in "Game 5" to win five hundred dollars;

    (f)   Fifty tickets winning two hundred fifty dollars in "Game 2;" fifty dollars once in "Game 3;" one hundred dollars in "Game 3;" and ten dollars five times with a "Star" symbol in "Game 5" to win five  hundred dollars;

    (g)    Fifty tickets winning fifty dollars in "Game 1;" one hundred dollars in "Game 2;" ten dollars five times in "Game 3;" fifty dollars doubled in "Game 4;" and twenty dollars five times with a "Star" symbol in "Game 5" to win five hundred dollars;

    (h)    Fifty tickets winning fifty dollars in "Game 1;" twenty-five dollars in "Game 2;" fifty dollars seven times in "Game 3;" twenty-five dollars in "Game 4;" and five dollars ten times in "Game 5" to win five hundred dollars;

    (i)   Fifty tickets winning two hundred fifty dollars doubled in "Game 4" to win five hundred dollars;

    (j)   Fifty tickets winning five hundred dollars in "Game 2" to win five hundred dollars;

    (k)    Five hundred tickets winning one hundred dollars once in "Game 5" to win one hundred dollars;

    (l)   Five hundred tickets winning one hundred dollars once in "Game 3" to win one hundred dollars;

    (m)    One thousand tickets winning ten dollars ten times in "Game 5" to win one hundred dollars;

    (n)   One thousand tickets winning five dollars two times and thirty dollars two times in "Game 3;" and fifteen dollars doubled in "Game 4" to win one hundred dollars;

    (o)   One thousand tickets winning one hundred dollars in "Game 2" to win one hundred dollars;

    (p)   One thousand tickets winning fifty dollars in "Game 1;" and twenty-five dollars once with a "Star" symbol in "Game 5" to win one hundred dollars;

    (q)   One thousand tickets winning fifty dollars in "Game 1;" five dollars seven times in "Game 3;" and five dollars three times in "Game 5" to win one hundred dollars;

    (r)    Two thousand tickets winning fifty dollars in "Game 1;" ten dollars in "Game 2;" ten dollars once in "Game 3;" ten dollars in "Game 4;" and ten dollars once with a "Star" symbol in "Game 5" to win one hundred dollars;

    (s)   One thousand tickets winning fifty dollars once in "Game 5" to win fifty dollars;

    (t)    One thousand tickets winning twenty dollars in "Game 2;" five dollars doubled in "Game 4;" and five dollars four times in "Game 5" to win fifty dollars;

    (u)    One thousand tickets winning five dollars once, fifteen dollars once and thirty dollars once in "Game 3" to win fifty dollars;

    (v)   One thousand tickets winning twenty-five dollars in "Game 2;" ten dollars doubled in "Game 4;" and five dollars once in "Game 5" to win fifty dollars;

    (w)   One thousand tickets winning five dollars seven times in "Game 3;" five dollars in "Game 4;" and five dollars two times in "Game 5" to win fifty dollars;

    (x)   One thousand tickets winning five dollars five times with a "Star" symbol in "Game 5" to win fifty dollars;

    (y)     Two thousand tickets winning fifty dollars in "Game 1" to win fifty dollars;

    (z)    Two thousand tickets winning twenty-five dollars once in "Game 5" to win twenty-five dollars;

    (aa) Two thousand tickets winning five dollars five times in "Game 3" to win twenty-five dollars;

    (bb) One thousand five hundred tickets winning twenty-five dollars once in "Game 3" to win twenty-five dollars;

    (cc) One thousand tickets winning fifteen dollars in "Game 2;" and five dollars two times in "Game 5" to win twenty-five dollars;

    (dd) One thousand five hundred tickets winning five dollars in "Game 2;" ten dollars once in "Game 3;" and ten dollars in "Game 4" to win twenty-five dollars;

    (ee) Eight thousand tickets winning ten dollars once with a "Star" symbol in "Game 5" to win twenty dollars;

    (ff) Eight thousand tickets winning five dollars doubled in "Game 4;" and ten dollars once in "Game 5" to win twenty dollars;

    (gg) Eight thousand tickets winning twenty dollars in "Game 2" to win twenty dollars; and

    (hh) Eight thousand tickets winning five dollars in "Game 2;" five dollars once in "Game 3;" five dollars in "Game 4;" and five dollars once in "Game 5" to win twenty dollars.

    (F)   Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G)  Frequency of prize drawings.

    (1)    Random imprinting of prize awards on all tickets issued in game rule number four hundred thirty-six shall be accomplished in a manner which complies with the commission's rules and procedures.

    (2)    When a ticket issued in game rule number four hundred thirty-six is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number four hundred thirty-six in which the ticket was sold.

    (3)   The Top Prize Drawing to award one grand prize of the "Annuity Prize Award" of two hundred fifty thousand dollars per year for thirty years (before taxes) or the "Elected Cash-Option Prize Award" of approximately four million dollars before taxes in lieu of the "Annuity Prize Award" shall take place in accordance with rules and procedures established and approved by the director,  and  specifically,  rule  3770:1-6-05  of  the  Administrative  Code

    governing "Prize drawings" and rule 3770:1-6-01 of the Administrative Code governing "Special lottery drawings." Such drawings shall be held on dates determined and announced by the director, however, the earliest Top Prize Drawing date shall be one hundred eighty days from the game close date or when all tickets winning a prize value corresponding with a "TPD" symbol have been claimed, whichever is earlier.

    (H)    Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules, as well as procedures for entry into the Top Prize Drawings described in Section (G)(3) of this Rule. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I)  Validity of tickets.

    (1)   A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2)   In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number four hundred thirty-six void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J)   Director's conduct of game rule number four hundred thirty-six.

    (1)     The director shall conduct game rule number four hundred thirty-six in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed  necessary  or  advisable,  the  director  shall  adopt  management

    regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number four hundred thirty-six. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2)   Names and definitions of elements of game rule number four hundred thirty-six used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number four hundred thirty-six and these elements may be given names or titles chosen by the commission.
