3770:1-9-441               Game rule number four hundred forty-one.

 

 

 

(A)   Title and term. Ohio lottery commission game rule number four hundred forty-one, "5 Times Lucky," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number four hundred forty-one.

 

(B)  General design.

 

(1)   Game rule number four hundred forty-one is a "Number" symbol match game within which is contained five separate "Games" ("Game 1" through "Game 5") with an additional instant win feature, and is generally known as an "instant lottery."

 

(2)    Holders of valid tickets will remove the covering off the entire play area to reveal one "Your Lucky Number" symbol, one or more number and/or play symbols in each "Game" and a corresponding prize value for each "Game." The number symbols shall consist of numbers from "1" through "25." The player must match the "Your Lucky Number" symbol to one or more of the number symbols in each "Game" to win the corresponding prize value shown below that "Game." If the player reveals a "Star" symbol in any one of the "Games," the player wins five times the corresponding prize value automatically for that "Game." There are fifteen chances to win on each ticket, and a player may win up to fifteen times on one ticket. "Game 1" through "Game 5" may contain the following combination of number and/or play symbols:

 

(a)   "Game 1" - One number symbol or a "Star" symbol;

 

(b)    "Game 2" - Two number symbols or one number symbol and a "Star" symbol;

 

(c)    "Game 3" - Three number symbols or two number symbols and a "Star" symbol;

 

(d)   "Game 4" - Four number symbols or three number symbols and a "Star" symbol; and

 

(e)    "Game 5" - Five number symbols or four number symbols and a "Star"

 

 

symbol.

(3)    As used in this rule, "prize award" shall mean one of the following monetary amounts which is the total of all winning prize values appearing on the ticket: two dollars, three dollars, five dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars, five thousand dollars and fifteen thousand dollars. Each ticket in game rule number four hundred forty-one shall be imprinted in such a way that prize awards from the set listed above may be won.

(C)   Price of tickets. The price of a ticket issued by the commission in game rule number four hundred forty-one shall be two dollars.

(D)  Structure, nature and value of prize awards.

(1)    There shall be one type of prize in game rule number four hundred forty-one called a "regular prize award."

(2)   The only "prize values" which shall appear on a ticket in game rule number four hundred forty-one are: one dollar, two dollars, three dollars, four dollars, five dollars, six dollars, ten dollars, twenty dollars, twenty-five dollars, fifty dollars, one hundred dollars, five hundred dollars, five thousand dollars and fifteen thousand dollars. Numbers, prize values and play symbols shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.

(a)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by two number symbols in one or more "Games" for one dollar two times shall win a regular prize award of two dollars;

(b)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by one number symbol in one "Game" for two dollars once shall win a regular prize award of two dollars;

(c)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by three number symbols in one or more "Games" for one dollar three times shall win a regular prize award of three dollars;

(d)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by one number symbol in one "Game" for three dollars once shall win a regular prize award of three dollars;

(e)   Holder of a valid winning ticket on which a "Star" symbol is revealed in one "Game" for one dollar five times shall win a regular prize award of five dollars;

(f)    Holder of a valid winning ticket the "Your Lucky Number" symbol is matched by one number symbol in one "Game" for five dollars once shall win a regular prize award of five dollars;

(g)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by six number symbols in two or more "Games" for one dollar five times and five dollars once shall win a regular prize award of ten dollars;

(h)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by four number symbols in two or more "Games" for two dollars three times and four dollars once shall win a regular prize award of ten dollars;

(i)    Holder of a valid winning ticket on which a "Star" symbol is revealed in one "Game" for two dollars five times shall win a regular prize award of ten dollars;

(j)     Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by one number symbol in one "Game" for  ten dollars once shall win a regular prize award of ten dollars;

(k)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by fourteen number symbols in four or more "Games" for one dollar ten times, two dollars two times and three dollars two times shall win a regular prize award of twenty dollars;

(l)   Holder of a valid winning ticket on which a "Star" symbol is revealed one "Game" for four dollars five times shall win a regular prize award of twenty dollars;

(m)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by one number symbol in one "Game" for twenty dollars once shall win a regular prize award of twenty dollars;

(n)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by fifteen numbers in five "Games" for one dollar

ten times and two dollars five times shall win a regular prize award of twenty dollars;

(o)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by twelve number symbols in three or more "Games" for three dollars ten times and ten dollars two times shall win a regular prize award of fifty dollars;

(p)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by two number numbers in one or more "Games" for twenty-five dollars two times shall win a regular prize award of fifty dollars;

(q)   Holder of a valid winning ticket on which a "Star" symbol is revealed in one "Game" for ten dollars five times shall win a regular prize award of fifty dollars;

(r)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by fifteen number symbols in five "Games" for two dollars ten times and six dollars five times shall win a regular prize award of fifty dollars;

(s)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by one number symbol in one "Game" for fifty dollars once shall win a regular prize award of fifty dollars;

(t)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by fifteen number symbols in five "Games" for five dollars ten times and ten dollars five times shall win a regular prize award of one hundred dollars;

(u)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by ten number symbols in three or more "Games" for ten dollars ten times shall win a regular prize award of one hundred dollars;

(v)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by two number symbols in one or more "Games" for fifty dollars two times shall win a regular prize award of one hundred dollars;

(w)   Holder of a valid winning ticket on which a "Star" symbol is revealed in

one "Game" for twenty dollars five times shall win a regular prize award of one hundred dollars;

(x)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by one number symbol in one "Game" for one hundred dollars once shall win a regular prize award of one hundred dollars;

(y)   Holder of a valid winning ticket on which a "Star" symbol is revealed in one "Game" for one hundred dollars five times shall win a regular prize award of five hundred dollars;

(z)    Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by ten number symbols in three or more "Games" for fifty dollars ten times shall win a regular prize award of five hundred dollars;

(aa) Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by fifteen number symbols in five "Games" for ten dollars ten times, fifty dollars two times and one hundred dollars three times shall win a regular prize award of five hundred dollars;

(bb) Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by one number symbol in one "Game" for five hundred dollars once shall win a regular prize award of five hundred dollars;

(cc) Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by one number symbol in one "Game" for five thousand dollars once shall win a regular prize award of five thousand dollars; and

(dd) Holder of a valid winning ticket on which the "Your Lucky Number" symbol is matched by one number symbol in one "Game" for fifteen thousand dollars once shall win a regular prize award of fifteen thousand dollars.

(E)   Number of prize awards. The number of prize awards in any sales cycle of game rule number four hundred forty-one will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in

accordance with this rule using random techniques in order that:

(1)   Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance;

(2)    Mathematical reasoning indicates that the number of winning tickets per six million tickets sold in the following categories should be as follows:

(a)     Twenty  tickets  winning  fifteen  thousand  dollars  once  to  win  fifteen thousand dollars; and

(b)    Fifteen tickets winning five thousand dollars once to win five thousand dollars.

(3)   Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:

(a)     Five  tickets  winning  five  hundred  dollars  once  to  win  five  hundred dollars;

(b)   Five tickets winning ten dollars ten times, fifty dollars two times and one hundred dollars three times to win five hundred dollars;

(c)   Five tickets winning fifty dollars ten times to win five hundred dollars;

(d)  Ten tickets winning one hundred dollars five times by revealing the "Star" symbol to win five hundred dollars;

(e)   Twenty-five tickets winning one hundred dollars once to win one hundred dollars;

(f)    Fifty tickets winning twenty dollars five times by revealing the "Star" symbol to win one hundred dollars;

(g)    Twenty-five tickets winning fifty dollars two times to win one hundred dollars;

(h)    Twenty-five tickets winning ten dollars ten times to win one hundred dollars;

(i)     Twenty-five tickets winning five dollars ten times and ten dollars five times to win one hundred dollars;

(j)   Three hundred tickets winning fifty dollars once to win fifty dollars;

(k)    One hundred tickets winning two dollars ten times and six dollars five times to win fifty dollars;

(l)     Three hundred tickets winning ten dollars five times by revealing the "Star" symbol to win fifty dollars;

(m)    One hundred fifty tickets winning twenty-five dollars two times to win fifty dollars;

(n)   One hundred fifty tickets winning three dollars ten times and ten dollars two times to win fifty dollars;

(o)    Five hundred tickets winning one dollar ten times and two dollars five times to win twenty dollars;

(p)   Five hundred tickets winning twenty dollars once to win twenty dollars;

(q)    Five hundred tickets winning four dollars five times by revealing the "Star" symbol to win twenty dollars;

(r)    Five hundred tickets winning one dollar ten times, two dollars two times and three dollars two times to win twenty dollars;

(s)   Five hundred tickets winning ten dollars once to win ten dollars;

(t)  Five hundred tickets winning two dollars five times by revealing the "Star" symbol to win ten dollars;

(u)   Five hundred tickets winning two dollars three times and four dollars once to win ten dollars;

(v)   Five hundred tickets winning one dollar five times and five dollars once to win ten dollars;

(w)  Two thousand tickets winning five dollars once to win five dollars;

(x)     Four thousand tickets winning one dollar five times by revealing the "Star" symbol to win five dollars;

(y)   Four thousand tickets winning three dollars once to win three dollars;

(z)   Four thousand tickets winning one dollar three times to win three dollars; (aa) Ten thousand tickets winning two dollars once to win two dollars; and (bb) Fourteen thousand tickets winning one dollar two times to win two

dollars.

(F)   Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

(G)  Frequency of prize drawings.

(1)    Random imprinting of prize awards on all tickets issued in game rule number four hundred forty-one shall be accomplished in a manner which complies with the commission's rules.

(2)    When a ticket issued in game rule number four hundred forty-one is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day on the sales cycle of game rule number four hundred forty-one in which the ticket was sold.

(H)    Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prizes which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

(I)  Validity of tickets.

(1)   A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

(2)   In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number four hundred forty-one void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed, or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

(J)   Director's conduct of game rule number four hundred forty-one.

(1)     The director shall conduct game rule number four hundred forty-one in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number four hundred forty-one. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

(2)   Names and definitions of elements of game rule number four hundred forty-one used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number four hundred forty-one and these elements may be given names or titles chosen by the commission.
