    3770:1-9-449               Game rule number four hundred forty-nine.

     

     

     

    (A)   Title and term. Ohio lottery commission game rule number four hundred forty-nine, "Double It!" shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sale agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number four hundred forty-nine.

     

    (B)  General design.

     

    (1)    Game rule number four hundred forty-nine contains four separate chances to match three like prize values with a "doubler" feature, and is generally known as an "instant lottery."

     

    (2)   The player will remove the covering over the play area to reveal six prize values or five prize values and a "Double Dollar Sign" symbol in "Game 1" through "Game 4." If three of the six prize values revealed match in any one "Game," the player wins the matched prize value for that "Game." If two of the six prize values revealed match and a "Double Dollar Sign" symbol is revealed in any one "Game," the player wins double the matched prize value for that "Game." There are four chances to win on each ticket, and a player may win up to four times on one ticket.

     

    (3)     As used in this rule, "prize award" shall mean any one of the following monetary amounts: two dollars, three dollars, four dollars, eight dollars, ten dollars, twenty dollars, thirty dollars, sixty dollars, one hundred dollars, five hundred dollars and sixteen thousand dollars. Each ticket in game rule number four hundred forty-nine shall be imprinted in such a way that prize awards from the set listed above may be won.

     

    (C)   Price of tickets. The price of a ticket issued by the commission in game rule number four hundred forty-nine shall be two dollars.

     

    (D)  Structure, nature and value of prize awards.

     

    (1)   There shall be one type of prize in game rule number four hundred forty-nine called a "regular prize award."

     

    (2)   The only "prize values" which shall appear on a ticket in game rule number four hundred forty-nine are: one dollar, two dollars, three dollars, four dollars, five

     

     

    dollars, eight dollars, ten dollars, fifteen dollars, twenty dollars, twenty-five dollars, thirty dollars, fifty dollars, sixty dollars, one hundred dollars, five hundred dollars and sixteen thousand dollars. Prize values and play symbols shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying prize values and play symbols.

    (a)     Holder of a valid winning ticket on which three of the prize values revealed are two dollars in one "Game" shall win a regular prize award of two dollars;

    (b)   Holder of a valid winning ticket on which two of the prize values revealed are one dollar and a "Double Dollar Sign" symbol is revealed for one dollar doubled in one "Game" shall win a regular prize award of two dollars;

    (c)     Holder of a valid winning ticket on which three of the prize values revealed are one dollar in one "Game," and two of the prize values revealed are one dollar and a "Double Dollar Sign" symbol is revealed for one dollar doubled in one "Game" shall win a regular prize award of three dollars;

    (d)    Holder of a valid winning ticket on which three of the prize values revealed are three dollars in one "Game" shall win a regular prize award of three dollars;

    (e)     Holder of a valid winning ticket on which three of the prize values revealed are one dollar in all four "Games" shall win a regular prize award of four dollars;

    (f)    Holder of a valid winning ticket on which three of the prize values revealed are four dollars in one "Game" shall win a regular prize award of four dollars;

    (g)   Holder of a valid winning ticket on which two of the prize values revealed are one dollar and a "Double Dollar Sign" symbol is revealed for one dollar doubled in two "Games" shall win a regular prize award of four dollars;

    (h)   Holder of a valid winning ticket on which two of the prize values revealed are two dollars and a "Double Dollar Sign" symbol is revealed for two dollars doubled in one "Game" shall win a regular prize award of four dollars;

    (i)     Holder of a valid winning ticket on which three of the prize values revealed are two dollars in all four "Games" shall win a regular prize award of eight dollars;

    (j)   Holder of a valid winning ticket on which two of the prize values revealed are two dollars and a "Double Dollar Sign" symbol is revealed for two dollars doubled in two "Games" shall win a regular prize award of eight dollars;

    (k)   Holder of a valid winning ticket on which two of the prize values revealed are one dollar and a "Double Dollar Sign" symbol is revealed for one dollar doubled in all four "Games" shall win a regular prize award of eight dollars;

    (l)     Holder of a valid winning ticket on which three of the prize values revealed are eight dollars in one "Game" shall win a regular prize award of eight dollars;

    (m)     Holder of a valid winning ticket on which two of the prize values revealed are five dollars and a "Double Dollar Sign" symbol is revealed for five dollars doubled in one "Game" shall win a regular prize award of ten dollars;

    (n)     Holder of a valid winning ticket on which three of the prize values revealed are five dollars in two "Games" shall win a regular prize award of ten dollars;

    (o)     Holder of a valid winning ticket on which three of the prize values revealed are one dollar in one "Game" and three of the prize values revealed are three dollars in three "Games" shall win a regular prize award of ten dollars;

    (p)     Holder of a valid winning ticket on which three of the prize values revealed are four dollar in one "Game" and two of the prize values revealed are one dollar and a "Double Dollar Sign" symbol is revealed for one dollar doubled in three "Games" shall win a regular prize award of ten dollars;

    (q)     Holder of a valid winning ticket on which three of the prize values revealed are ten dollars in one "Game" shall win a regular prize award of ten dollars;

    (r)   Holder of a valid winning ticket on which two of the prize values revealed are five dollars and a "Double Dollar Sign" symbol is revealed for five dollars doubled in two "Games" shall win a regular prize award of twenty dollars;

    (s)   Holder of a valid winning ticket on which two of the prize values revealed are ten dollars and a "Double Dollar Sign" symbol is revealed for ten dollars doubled in one "Game" shall win a regular prize award  of twenty dollars;

    (t)     Holder of a valid winning ticket on which three of the prize values revealed are five dollars in all four "Game" shall win a regular prize award of twenty dollars;

    (u)     Holder of a valid winning ticket on which three of the prize values revealed are twenty dollars in one "Game" shall win a regular prize award of twenty dollars;

    (v)     Holder of a valid winning ticket on which three of the prize values revealed are five dollars in two "Games" and three of the prize values revealed are ten dollars in two "Games" shall win a regular prize award of thirty dollars;

    (w)    Holder of a valid winning ticket on which three of the prize values revealed are fifteen dollars in two "Games" shall win a regular prize award of thirty dollars;

    (x)     Holder of a valid winning ticket on which three of the prize values revealed are ten dollars in one "Game" and two of the prize values revealed are ten dollars and a "Double Dollar Sign" symbol is revealed for ten dollars doubled in one "Game" shall win a regular prize award of thirty dollars;

    (y)     Holder of a valid winning ticket on which three of the prize values revealed are thirty dollars in one "Game" shall win a regular prize award of thirty dollars;

    (z)   Holder of a valid winning ticket on which two of the prize values revealed are thirty dollars and a "Double Dollar Sign" symbol is revealed for thirty dollars doubled in one "Game" shall win a regular prize award of sixty dollars;

    (aa) Holder of a valid winning ticket on which three of the prize values revealed are sixty dollars in one "Game" shall win a regular prize award of sixty dollars;

    (bb) Holder of a valid winning ticket on which three of the prize values revealed are twenty-five dollars in all four "Games" shall win a regular prize award of one hundred dollars;

    (cc) Holder of a valid winning ticket on which two of the prize values revealed are fifty dollars and a "Double Dollar Sign" symbol is revealed for fifty dollars doubled in one "Game" shall win a regular prize award of one hundred dollars;

    (dd) Holder of a valid winning ticket on which three of the prize values revealed are fifty dollars in one "Game" and two of the prize values revealed are twenty-five dollars and a "Double Dollar Sign" symbols is revealed for twenty-five dollars doubled in one "Game" shall win a regular prize award of one hundred dollars;

    (ee) Holder of a valid winning ticket on which three of the prize values revealed are one hundred dollars in one "Game" shall win a regular prize award of one hundred dollars;

    (ff) Holder of a valid winning ticket on which three of the prize values revealed are one hundred dollars in three "Games" and two of the prize values revealed are one hundred dollars and a "Double Dollar Sign" symbol is revealed for one hundred dollars doubled in one "Game" shall win a regular prize award of five hundred dollars;

    (gg) Holder of a valid winning ticket on which three of the prize values revealed are five hundred dollars in one "Game" shall win a regular prize award of five hundred dollars; and

    (hh) Holder of a valid winning ticket on which three of the prize values revealed are sixteen thousand dollars in one "Game" shall win a regular prize award of sixteen thousand dollars.

    (E)   Number of prize awards. The number of prize awards in any sales cycle of game rule number four hundred forty-nine will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in

    accordance with this rule using random techniques in order that:

    (1)   Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2)    Mathematical reasoning indicates that the number of winning tickets per six million tickets sold in the following categories should be as follows:

    (a)    Twenty-four tickets winning sixteen thousand dollars in one "Game" to win sixteen thousand dollars.

    (3)   Mathematical reasoning indicates that over a sufficiently large number of tickets sold, and average number of winning tickets per two hundred thousand tickets sold should be as follows:

    (a)     One  ticket  winning  five  hundred  dollars  in  one  "Game"  to  win  five hundred dollars;

    (b)     One  ticket  winning  one  hundred  dollars  in  three  "Games"  and  one hundred dollars doubled in one "Game" to win five hundred dollars;

    (c)     Six  tickets  winning  one  hundred  dollars  in  one  "Game"  to  win  one hundred dollars;

    (d)   Six tickets winning fifty dollars in one "Game" and twenty-five dollars doubled in one "Game" to win one hundred dollars;

    (e)     Six  tickets  winning  fifty  dollars  doubled  in  one  "Game"  to  win  one hundred dollars;

    (f)     Six  tickets  winning  twenty-five  dollars  in  four  "Games"  to  win  one hundred dollars;

    (g)   Fifty tickets winning sixty dollars in one "Game" to win sixty dollars;

    (h)    Fifty tickets winning thirty dollars doubled in one "Game" to win sixty dollars;

    (i)    Two hundred tickets winning thirty dollars in one "Game" to win thirty dollars;

    (j)    Two hundred tickets winning ten dollars in one "Game" and ten dollars doubled in one "Game" to win thirty dollars;

    (k)   Two hundred tickets winning fifteen dollars in two "Games" to win thirty dollars;

    (l)   Two hundred tickets winning five dollars in two "Games" and ten dollars in two "Games" to win thirty dollars;

    (m)   Five hundred tickets winning twenty dollars in one "Game" to win twenty dollars;

    (n)   Five hundred tickets winning five dollars in four "Games" to win twenty dollars;

    (o)    Five hundred tickets winning ten dollars doubled in one "Game" to win twenty dollars;

    (p)   Five hundred tickets winning five dollars doubled in two "Games" to win twenty dollars;

    (q)   Five hundred tickets winning ten dollars in one "Game" to win ten dollars;

    (r)    Five hundred tickets winning four dollars in one "Game" and one dollar doubled in three "Games" to win ten dollars;

    (s)   One thousand five hundred tickets winning one dollar in one "Game" and three dollars in three "Games" to win ten dollars;

    (t)    One thousand tickets winning five dollars in two "Games" to win ten dollars;

    (u)   Five hundred tickets winning five dollars doubled in one "Game" to win ten dollars;

    (v)    One thousand tickets winning eight dollars in one "Game" to win eight dollars;

    (w)   One thousand tickets winning one dollar doubled in four "Games" to win eight dollars;

    (x)   One thousand tickets winning two dollars doubled in two "Games" to win eight dollars;

    (y)    One thousand tickets winning two dollars in four "Games" to win eight dollars;

    (z)   Three thousand tickets winning two dollars doubled in one "Game" to win four dollars;

    (aa) Three thousand tickets winning one dollar doubled in two "Games" to win four dollars;

    (bb) Two thousand tickets winning four dollars in one "Game" to win four dollars;

    (cc) Four thousand tickets winning one dollar in four "Games" to win four dollars;

    (dd) Two thousand tickets winning three dollars in one "Game" to win three dollars;

    (ee) Four thousand tickets winning one dollar in one "Game" and one dollar doubled in one "Game" to win three dollars;

    (ff) Eight thousand tickets winning one dollar doubled in one "Game" to win two dollars; and

    (gg) Six thousand tickets winning two dollars in one "Game" to win two dollars.

    (F)   Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G)  Frequency of prize drawings.

    (1)    Random imprinting of prize awards on all tickets issued in game rule number four hundred forty-nine shall be accomplished in a manner which complies with the commission's rules and procedures.

    (2)    When a ticket issued in game rule number four hundred forty-nine is sold or

    deemed sold in accordance with this rule and the covering material over the prize values and play symbols has been removed, the holder shall be deemed to have drawn the prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number four hundred forty-nine in which the ticket was sold.

    (H)    Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prizes which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I)  Validity of tickets.

    (1)   A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2)   In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number four hundred forty-nine void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J)   Director's conduct of game rule number four hundred forty-nine.

    (1)     The director shall conduct game rule number four hundred forty-nine in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed  necessary  or  advisable,  the  director  shall  adopt  management

    regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number four hundred forty-nine. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2)   Names and definitions of elements of game rule number four hundred forty-nine used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number four hundred forty-nine and these elements may be given names or titles chosen by the commission.
