    3770:1-9-453               Game rule number four hundred fifty-three.

     

     

     

    (A)   Title and term. Ohio lottery commission game rule number four hundred fifty-three, "Find the 9's," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number four hundred fifty-three.

     

    (B)  General design.

     

    (1)    Game rule number four hundred fifty-three is a "Tic-Tac-Toe" style lottery game offering three separate chances to play, and is generally known as an "instant lottery."

     

    (2)   The player is required to scratch off the covering to reveal nine number symbols in "Game 1" through "Game 3" which may include: "1's;" "2's;" "3's;" "4's;" "5's;" "6's;" "7's," "8's" or "9's." In each "Game," the player must reveal three number "9" symbols in the same vertical, horizontal or diagonal straight line to win the corresponding prize value shown in the "Prize" area for that "Game." There are three chances to win on each ticket, and a player may win up to three times on one ticket.

     

    (3)    As used in this rule, "prize award" shall mean one of the following prize amounts which is the total of all winning prize values appearing on the ticket: two dollars, four dollars, nine dollars, nineteen dollars, forty-nine dollars, ninety-nine dollars, nine hundred ninety-nine dollars and nineteen thousand nine hundred ninety-nine dollars. Each ticket in game rule number four hundred fifty-three shall be imprinted with prize awards from the set listed above.

     

    (C)   Price of tickets. The price of a ticket issued by the commission in game rule number four hundred fifty-three shall be two dollars.

     

    (D)  Structure, nature and value of prize awards.

     

    (1)   There shall be one type of prize in game rule number four hundred fifty-three called a "regular prize award."

     

    (2)   The only "prize values" which shall appear on a ticket in game rule number four hundred fifty-three are those listed as follows:

     

     

    (a)   "Game 1" - One dollar, two dollars, three dollars, four dollars, five dollars, nine dollars, ten dollars, nineteen dollars, twenty dollars, forty-nine dollars, fifty dollars, nine-nine dollars, nine hundred ninety-nine dollars and nineteen thousand nine hundred ninety-nine dollars;

    (b)   "Game 2" - One dollar, two dollars, three dollars, five dollars, ten dollars, fifteen dollars, nineteen dollars, twenty dollars, twenty-five dollars, ninety-nine dollars, nine hundred ninety-nine dollars and nineteen thousand nine hundred ninety-nine dollars; and

    (c)     "Game 3" - Two dollars, three dollars, nine dollars, fifteen dollars, nineteen dollars, twenty dollars, forty-nine dollars, nine hundred ninety-nine dollars and nineteen thousand nine hundred ninety-nine dollars.

    (3)    Number symbols and prize values shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying number symbols and prize values.

    (a)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for one dollar in "Game 1" and one dollar in "Game 2 shall win a regular prize award of two dollars;

    (b)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for two dollars in "Game 3" shall win a regular prize award of two dollars;

    (c)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for two dollars in "Game 2" and two dollars in "Game 3" shall win a regular prize award of four dollars;

    (d)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for four dollars in "Game 1" shall win a regular prize award of four dollars;

    (e)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for one dollar in "Game 1;" one dollar in "Game 2" and two dollars in "Game 3" shall win a regular prize award of four dollars;

    (f)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for four dollars in "Game 1" shall win a regular prize award of four dollars;

    (g)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for three dollars in "Game 1;" three dollars in "Game 2" and three dollars in "Game 3" shall win a regular prize award of nine dollars;

    (h)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for nine dollars in "Game 3" shall win a regular prize award of nine dollars;

    (i)    Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for nine dollars in "Game 1" and ten dollars in "Game 2" shall win a regular prize award of nineteen dollars;

    (j)    Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for five dollars in "Game 1;" five dollars in "Game 2" and nine dollars in "Game 3" shall win a regular prize award of nineteen dollars;

    (k)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for two dollars in "Game 1;" two dollars in "Game 2" and fifteen dollars in "Game 3" shall win a regular prize award of nineteen dollars;

    (l)    Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for nineteen dollars in "Game 3" shall win a regular prize award of nineteen dollars;

    (m)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for nineteen dollars in "Game 1;" fifteen dollars in "Game 2" and fifteen dollars in "Game 3" shall win a regular prize award of forty-nine dollars;

    (n)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for ten dollars in "Game 1;" nineteen dollars in "Game 2" and twenty dollars in "Game 3" shall win a regular prize award of forty-nine dollars;

    (o)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for five dollars in "Game 1;" twenty-five dollars in "Game 2" and nineteen dollars in "Game 3" shall win a regular prize award of forty-nine dollars;

    (p)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for forty-nine dollars in "Game 1" shall win a regular prize award of forty-nine dollars;

    (q)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for twenty dollars in "Game 1;" twenty dollars in "Game 2;" and nine dollars in "Game 3" shall win a regular prize award of forty-nine dollars;

    (r)    Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for ninety-nine dollars in "Game 2" shall win a regular prize award of ninety-nine dollars;

    (s)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for ninety-nine dollars in "Game 1" shall win a regular prize award of ninety-nine dollars;

    (t)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for fifty dollars in "Game 1" and forty-nine dollars in "Game 3" shall win a regular prize award of ninety-nine dollars;

    (u)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for nine hundred ninety-nine dollars in "Game 1" shall win a regular prize award of nine hundred ninety-nine dollars;

    (v)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for nine hundred ninety-nine dollars in "Game 2" shall win a regular prize award of nine hundred ninety-nine dollars;

    (w)   Holder of a valid winning ticket on which three number "9" symbols are revealed  in  a  horizontal,  vertical  or  diagonal  straight  line  for  nine

    hundred ninety-nine dollars in "Game 3" shall win a regular prize award of nine hundred ninety-nine dollars;

    (x)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for nineteen thousand nine hundred ninety-nine dollars in "Game 1" shall win a regular prize award of nineteen thousand nine hundred ninety-nine dollars;

    (y)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for nineteen thousand nine hundred ninety-nine dollars in "Game 2" shall win a regular prize award of nineteen thousand nine hundred ninety-nine dollars; and

    (z)   Holder of a valid winning ticket on which three number "9" symbols are revealed in a horizontal, vertical or diagonal straight line for nineteen thousand nine hundred ninety-nine dollars in "Game 3" shall win a regular prize award of nineteen thousand nine hundred ninety-nine dollars.

    (E)   Number of prize awards. The number of prize awards in any sales cycle of game rule number four hundred fifty-three will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that:

    (1)   Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2)    Mathematical reasoning indicates that the number of winning tickets per six million tickets sold in the following categories should be as follows:

    (a)   Ten tickets winning nineteen thousand nine hundred ninety-nine dollars in "Game 3" to win nineteen thousand nine hundred ninety-nine dollars;

    (b)   Ten tickets winning nineteen thousand nine hundred ninety-nine dollars in "Game 2" to win nineteen thousand nine hundred ninety-nine dollars;

    (c)   Ten tickets winning nineteen thousand nine hundred ninety-nine dollars in "Game 1" to win nineteen thousand nine hundred ninety-nine dollars;

    (d)   Thirty tickets winning nine hundred ninety-nine dollars in "Game 3" to win nine hundred ninety-nine dollars;

    (e)    Thirty tickets winning nine hundred ninety-nine dollars in "Game 2" to win nine hundred ninety-nine dollars; and

    (f)   Forty tickets winning nine hundred ninety-nine dollars in "Game 1" to win nine hundred ninety-nine dollars.

    (3)   Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:

    (a)   Twenty tickets winning fifty dollars in "Game 1" and forty-nine dollars in "Game 3" to win ninety-nine dollars;

    (b)     Twenty-five  tickets  winning  ninety-nine  dollars  in  "Game  1"  to  win ninety-nine dollars;

    (c)     Twenty-five  tickets  winning  ninety-nine  dollars  in  "Game  2"  to  win ninety-nine dollars;

    (d)   One hundred tickets winning twenty dollars in "Game 1;" twenty dollars in "Game 2" and nine dollars in "Game 3" to win forty-nine dollars;

    (e)     One  hundred  tickets  winning  forty-nine  dollars  in  "Game  1"  to  win forty-nine dollars;

    (f)   One hundred tickets winning five dollars in "Game 1;" twenty-five dollars in "Game 2" and nineteen dollars in "Game 3" to win forty-nine dollars;

    (g)   Four hundred tickets winning ten dollars in "Game 1;" nineteen dollars in "Game 2;" and twenty dollars in "Game 3" to win forty-nine dollars;

    (h)   One hundred tickets winning nineteen dollars in "Game 1;" fifteen dollars in "Game 2" and fifteen dollars in "Game 3" to win forty-nine dollars;

    (i)   Five hundred tickets winning nineteen dollars in "Game 3" to win nineteen dollars;

    (j)     Five hundred tickets winning two dollars in "Game 1;" two dollars in "Game 2" and fifteen dollars in "Game 3" to win nineteen dollars;

    (k)    Five hundred tickets winning five dollars in "Game 1;" five dollars in "Game 2" and nine dollars in "Game 3" to win nineteen dollars;

    (l)    Five hundred tickets winning nine dollars in "Game 1" and ten dollars in "Game 2" to win nineteen dollars;

    (m)     Two thousand tickets winning nine dollars in "Game 3" to win nine dollars;

    (n)   Four thousand tickets winning three dollars in "Game 1;" three dollars in "Game 2" and three dollars in "Game 3" to win nine dollars;

    (o)     Two thousand tickets winning four dollars in "Game 1" to win four dollars;

    (p)    Three thousand tickets winning one dollar in "Game 1;" one dollar in "Game 2" and two dollars in "Game 3" to win four dollars;

    (q)     Four thousand tickets winning four dollars in "Game 1" to win four dollars;

    (r)   Three thousand tickets winning two dollars in "Game 2" and two dollars in "Game 3" to win four dollars;

    (s)     Eight  thousand  tickets  winning  two  dollars  in  "Game  3"  to  win  two dollars; and

    (t)   Fourteen thousand tickets winning one dollar in "Game 1" and one dollar in "Game 2" to win two dollars.

    (F)   Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G)  Frequency of prize drawings.

    (1)    Random imprinting of prize awards on all tickets issued in game rule number four hundred fifty-three shall be accomplished in a manner which complies

    with the commission's rules and procedures.

    (2)    When a ticket issued in game rule number four hundred fifty-three is sold or deemed sold in accordance with this rule and the covering material over any of the number symbols and prize values has been removed, the holder shall be deemed to have drawn the number symbols and prize values on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number four hundred fifty-three in which the ticket was sold.

    (H)    Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prizes which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I)  Validity of tickets.

    (1)   A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2)   In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number four hundred fifty-three void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J)   Director's conduct of game rule number four hundred fifty-three.

    (1)     The director shall conduct game rule number four hundred fifty-three in a

    manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number four hundred fifty-three. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2)      Names and definitions of elements of game rule number four hundred fifty-three used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number four hundred fifty-three and these elements may be given names or titles chosen by the commission.
