    NOTICE OF PUBLIC HEARING

     

     

    Notice is hereby given that the Ohio Department of Mental Retardation and Developmental Disabilities will conduct a public hearing in accordance with Chapter 119. of the Revised Code on November 24, 2003, beginning at 9:30 A.M. and continuing until all persons in attendance have had an opportunity to testify. The hearing will be held at the Department's Administrative Offices Building (large conference room) located at 1810 Sullivant Avenue, Columbus, Ohio.

     

    At this public hearing, the Department will accept oral and/or written testimony on the proposed adoption of the following rules pertaining to the administration of prescribed medications, the performance of health-related activities, and the performance of tube feedings as required with the passage of Senate Bill 191 of the 124th General Assembly:

     

    5123:2-1-07 "Medication administration: Delegation, self-administration, and assistance with self-administration" - This rule, which establishes the requirements for county boards permitting unlicensed workers to perform delegated nursing tasks and/or to give oral or apply topical medications and requirements for self-administration and assistance with self-  administration of prescribed medication, is being proposed for rescission to comply with

    Senate Bill 191 of the 124th Assembly.

     

    5123:2-6-01 "Definitions" - This rule establishes the definitions of terms used throughout the chapter.

     

    5123:2-6-02 "Self-administration or assistance with the self-administration of prescribed medication" - This rule implements the right of individuals to self-administer medication or receive assistance with self-administration of medication and specifies the actions that MR/DD personnel may take when providing assistance to individuals in the self-administration of prescribed medications.

     

    5123:2-6-03 "Authorization of MR/DD personnel to administer prescribed medications, perform health-related activities, or perform tube feedings" - This rule establishes the authority granted MR/DD personnel under section 5123.42 of the Revised Code to administer prescribed medications, perform health-related activities, and perform tube feedings when no other provisions of the Revised Code specifically authorize the personnel to perform those services. The rule specifies whether nursing delegation is required according to the type of service being performed and where it is performed.

     

    5123:2-6-04 "Qualifications, training, and certification of registered nurses to train MR/DD personnel in the administration of prescribed medications, performance of health-related activities, and performance of tube feedings" - This rule establishes the requirements a registered nurse must meet to be eligible to teach training program courses, develops and specifies the content and length of the training courses for registered nurses to train MR/DD personnel, and establishes the standards and procedures for the issuance and renewal of certification for registered nurses to train MR/DD personnel.

     

     

     

     

     

     

     

    5123:2-6-05 "Qualifications and training for registered nurses to train MR/DD personnel and for MR/DD personnel in the administration of prescribed medications and the performance of tube feedings for individuals of a residential facility with seventeen or more beds who are on a field trip from the facility" - This rule establishes the requirements

    a registered nurse must meet to be eligible to teach training program courses, develops and specifies the length and content of training courses for registered nurses to train MR/DD personnel, establishes the qualifications for MR/DD personnel to receive training and specifies the content of training courses for MR/DD personnel. The provisions in this rule are  applicable to the administration of prescribed medications and performance of tube feedings for individuals of larger facilities who are on a field trip from the facility.

    5123:2-6-06 "Qualifications, training, and certification of MR/DD personnel in the administration of prescribed medications, performance of health-related activities, and performance of tube feedings" - This rule establishes the qualifications MR/DD personnel must meet to be eligible to receive training, develops and specifies the content and length of training courses for MR/DD personnel, and establishes the standards and procedures for issuance and renewal of certificates to MR/DD personnel.

    5123:2-6-07 "General provisions and compliance in the administration of prescribed medications, performance of health-related activities, and performance of tube feedings"

    - This rule establishes the requirement of a database for maintaining a list of certified MR/DD personnel and certified registered nurses; establishes the requirements for documentation of the administration of prescribed medications, performance of health-related activities, and the performance of tube feedings by MR/DD personnel; establishes the requirements for reporting errors in the administration of prescribed medications, performance of health-related activities, and the performance of tube feedings; establishes the compliance and quality assessment requirements for individuals of specified settings; establishes standards and procedures for employers of MR/DD personnel under certain conditions to prohibit MR/DD personnel from continuing or commencing the administration of prescribed medications, performance of

    health-related activities, or performance of tube feedings; establishes the procedures for suspending the certification of MR/DD personnel without a hearing pending the outcome of an investigation; establishes the procedures for revoking a certificate issued to MR/DD personnel; establishes the procedures for accepting complaints and conducting investigations; establishes procedures for taking corrective action for failure to comply with rules adopted under this chapter; and establishes the conditions for MR/DD personnel from immunity from liability.
