    NOTICE OF PUBLIC HEARING

     

     

    The Ohio Facilities Construction Commission (OFCC), pursuant to Chapter 119 of the Ohio Revised Code, hereby gives notice that a public hearing will be conducted for the purpose of considering the adoption of the following rules contained in the Ohio Administrative Code.

     

    The public hearing will be conducted on Tuesday, December 1, 2015, beginning at 1:30 p.m. in L-2 Room 1, located at the William Green Building, 30 W. Spring Street, Floor 2, Columbus, OH 43215. All interested parties affected by the proposed rules may be heard by oral or written testimony.

     

    The following new rules are being proposed:

     

     

    Rule Number

    Rule Name and Summary

    3318-3-01

    Purpose.

    The rule establishes the purpose of the rules for energy consumption in state facilities and clarifies that the rules do not apply to facilities of a state institution of higher education or political subdivision.

    3318-3-02

    Definition as used in this chapter.

    This rule defines terms that are contained in the remaining rules in the chapter.

    3318-3-03

    Requirements.

    The rule encourages the use of cost-effective, energy-efficient, green building practices for state facilities and lays out the procedure to obtain a waiver from compliance.

    3318-3-04

    Procedures and guidelines for new and renovated facilities.

    The rule sets guidelines for how annual energy consumption and associated energy costs are factored into the design of new and renovated facilities through energy modeling and life-cycle cost analysis.

    3318-3-05

    Guidelines for leased facilities.

    The rule encourages the use of cost-effective, energy-efficient, green building practices for state-leased facilities.

    3318-3-06

    Requirements for building operator certification and tracking building energy consumption. The rule requires state funded entities that manage or operate facilities to have a certified building operator, designates a training program, and allows for a waiver of compliance.

    Requirements for local administration of installment payment energy conservation contracts.

    The rule spells out the procedure to follow for a state agency to request to locally administer an installment payment contract for energy conservation measures.

    Electronic Bidding.

    The rule allows for the use and acceptance of electronic bids and electronic surety bonds on public improvement projects.
