3745-81-50                  Requirements for an exemption.

 

 

No exemption is permitted from the maximum contaminant level for total coliforms in rule 3745-81-14 of the Administrative Code or from the residual disinfectant concentration requirement in paragraph (B)(2) of rule 3745-81-72 of the Administrative Code. The director may exempt any public water system from any other requirement respecting a maximum contaminant level or any other treatment technique requirement, or from both, upon a finding that:

 

(A)   Due to compelling factors (which may include economic factors), the public water system is unable to comply with such maximum contaminant level or treatment technique requirement; and

 

(B)    The public water system was in operation on the effective date of such maximum contaminant level or treatment technique requirement; and
