    NOTICE OF PUBLIC HEARING

    In accordance with Chapter 119 of the Revised Code (R.C.) and by authority of R.C. section

    3702.11 and 3702.13, the Director of the Ohio Department of Health (ODH), or his designee, will conduct a public hearing, at the time and place listed above, to consider the proposal to adopt new and rescind current Ohio Administrative Code (O.A.C.) rules 3701-83-47 and 3701- 84-71. These rules set the requirements for Health Care Facilities and Hospital Health Care Services to notify and report radiation incidents to the Department of Health . Specifically, this includes both misadministrations from x-ray therapy equipment, and medical events involving therapeutic doses of radioactive materials.

     

    ODH is proposing to rescind current versions of these rules and to adopt new ones, to eliminate material duplicated in other rules. Currently, the radioactive materials rule 3701:1-58-101 includes the standards for reporting medical events; and, similarly, new Chapter 3701:1-67 of the OAC, if adopted, will propose standards for the misadministration of radiation emanating from x-ray therapy. Therefore, proposed new rules 3701-83-47 and 3701-84-71 will simply require facilities to comply with rules 3701:1-67-12 and 3701:1-58-101 of the O.A.C.

     

    At the hearing, people affected by the proposed action may appear and be heard in person, by an attorney or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful.
