    NOTICE OF PUBLIC HEARING

    Notice is hereby given that the Board of Building Standards will convene for a public hearing in accordance with Chapter 119. of the Revised Code, at 10:00 A.M., Friday, November 5, 2010 in Hearing Room #1, at 6606 Tussing Road, Reynoldsburg, Ohio, 43068. The purpose of the hearing is to consider rules of the Administrative Code, identified as Amendments Group LXXXIV, proposed pursuant to Chapters 119., 3781., 3791., and 4104. of the Revised Code.

    Synopsis of the proposed rules:

    PART A

    Consider the proposed rescission of all existing building department certification rules contained in Chapters 4101:2-70, 4101:2-71, 4101:2-72, 4101:2-73, 4101:2-74, 4101:2-75, 4101:2-76, 4101:2-77,

    4101:2-80, and 4101:2-81 of the Administrative Code. Consistent with Governor Strickland's Executive Order 2008-04S, the board is proposing to rescind all building department certification rules. The board certification of a department will occur through a board motion, after a certification hearing is held to hear testimony from interested parties. A list of all certified departments will be maintained and posted on the board's website. There are no changes to the existing department certifications. This is simply a rescission of the rule that identifies the conditions of the certification.

    PART B

    Consider the proposed rescission of all existing local board of building appeals certification rules contained in Chapter 4101:2-78 of the Administrative  Code. Consistent with Governor Strickland's Executive Order 2008-04S, the board is proposing to rescind all local board of building appeals certification rules. The board certification of a local board of building appeals will occur through a board motion, after a certification hearing is held to hear testimony from interested parties. A list of all certified boards of building appeals will be maintained and posted on the board's website. There are no changes to the existing local board of building appeals certifications. This is simply a rescission of the rule that identifies the conditions of the certification.

    Information and copies of the public hearing draft may be obtained from the Board of Building Standards at P.O. Box 4009, 6606 Tussing Rd., Reynoldsburg, Ohio 43068. The full text of this public hearing draft can be viewed on the Board's website (http://www.com.ohio.gov/dico/bbs.aspx ).  Electronic copies of the draft on compact disc will be mailed upon written request to the Board.

    The full text of the proposed rules are filed electronically with the Secretary of State, the Legislative Service Commission, the Joint Committee on Agency Rule Review, the Department of Aging, and the Small and Developing Business Division as required in sections 119.03 and 121.24 of the Revised Code. The required rule filing can be viewed on the Register of Ohio (http://www.registerofohio.state.oh.us). Additionally, the Clerks of the 88 County Commissioners are notified of the filings as required by statute.
