    NOTICE OF PUBLIC HEARING

     

     

    The Ohio Motor Vehicle Salvage Dealers Licensing Board will conduct a public hearing, pursuant to R.C. 119.03, on Thursday, November 4, 2010, at 10:00 a.m. The hearing will be held at the Ohio Department of Public Safety, 1970 West Broad Street, Room 109, Columbus, Ohio.

     

    The purpose of the hearing is to solicit public comment on the proposal to adopt, amend, and rescind rules found in Chapter 4501:1-4 of the Ohio Administrative Code, entitled "Motor Vehicle Salvage Dealers." These rules pertain to the licensing, place of business, and disciplinary hearing procedures for salvage vehicle dealers.

     

    Based on a scheduled R.C.119.032 rule review, and as authorized by R.C. 4738.11:

     

    The Board proposes to rescind and adopt Rules 4501:1-4-02, 4501:1-4-15, and 4501:1-4- 18 to remove language that is duplicative of Ohio Revised Code. Portions of each rule have been rewritten to ensure that language is easy to understand.

     

    The Board proposes to rescind Rules 4501:1-4-03, 4501:1-4-19, and 4501:1-4-20 as the Rules are duplicative of other Rules in the Ohio Administrative Code or Sections of the Ohio Revised Code.

     

    The Board proposes to amend Rules 4501:1-4-04, 4501:1-4-05, 4501:1-4-06, 4501:1-4-

    07, 4501:1-4-08, 4501:1-4-09, 4501:1-4-10, 4501:1-4-11, 4501:1-4-12, 4501:1-4-13,

    4501:1-4-14, 4501:1-4-16, and 4501:1-4-22 to reflect a change in statutory authority by removing references to R.C. 4738.09 and R.C. 4738.10.

     

    Any persons affected by the proposed rescission, adoption, or amendment of these rules may appear at the hearing and be heard in person, by an attorney, or both, or may present their position, argument, or contention in writing. Persons may offer and examine witnesses and present evidence to show that the proposed actions will be unreasonable or unlawful.
