    NOTICE OF PUBLIC HEARINGS

     

     

    In accordance with Chapter 119 of the Revised Code, the Public Health Council will conduct public hearings on Thursday, December 15, 2005 beginning at 10:00 a.m. The hearings will take place in the 8th Floor Conference Room of the Ohio Department of Health, 246 North High Street, Columbus, Ohio. The hearings concern the following actions:

     

       A proposal to amend rule 3701-3-16 of the Ohio Administrative Code (OAC), pertaining to reporting requirements for trauma centers. Authorized by R.C. 3701.072, the proposed changes clarify by a providing a specific list of areas to cover in a narrative report. Deleted in the proposed amendment is the required use of the Centers for Disease Control and Prevention algorithm.

       A proposal to amend OAC rule 3701-39-02.1, pertaining to standards for handling radioactive material.  Authorized by R.C. 3748.02,  the proposed amendments remove references to federal regulations.

       A proposal to amend OAC rules 3701-42-01 to 3701-42-09, pertaining to WIC vendor application, contracting, monitoring, compliance, and payment processes. Authorized by R.C. 3701.132, the proposed revisions reflect recent changes to the federal laws that govern WIC.

       A proposal to amend OAC rule 3701:1-38-07, which pertains to general radiation protection standards for sources of radiation. Authorized by R.C. 3748.02, the proposed changes update references to another OAC chapter.

       A proposal to amend OAC rule 3701:1-40-01, which clarifies a definition in the chapter on radiation protection requirements.

       A proposal to adopt new rules 3701:1-44-01 to 3701:1-44-25 of the OAC. Authorized by R.C. 3748.02, the proposed new chapter sets requirements and provisions for the use of source material for the issuance of licenses authorizing the use of this material. The adoption of this chapter is needed to keep Ohio rules compatible with federal regulations.

       A proposal to amend OAC rule 3701:1-54-01, and to adopt new rules 3701:1-54-

    06 to 3701:1-54-12. Authorized by R.C. 3748.02, these rules concern the disposal of radioactive material in Ohio. The proposed amendments remove references to federal regulations.

    A proposal to amend OAC rules 3701:1-66-03, 3701:1-66-05, and 3701:1-66- 13, pertaining to radiation generating equipment requirements and the certification of radiation experts. If adopted, amendments to these rules, which are authorized by R.C. 3748.04, will change notification requirements, make rule references more specific, change several technical factors relating to equipment standards, eliminate the annual radiation survey from the quality assurance requirement, and exempt photoelectron spectrometers from certain requirements.

     

    At the hearings, persons affected by the proposed actions may appear and be heard in person, by their attorney or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful.
