    NOTICE OF PUBLIC HEARING

     

    THE STATE OF OHIO ~ COUNSELOR, SOCIAL WORKER & MARRIAGE AND FAMILY

    THERAPIST BOARD, pursuant to CHAPTER 119., OHIO REVISED CODE, hereby gives notice that it will conduct a public hearing for the purpose of considering amended rules 4757-1- 05, 4757-3-01, 4757-5-01, 4757-6-02, 4757-11-01, 4757-13-03, 4757-15-02, 4757-15-03, and

    4757-21-04; and new rules 4757-27-01, 4757-27-02, 4757-27-03 and 4757-29-01 of the Ohio

    Administrative Code.

     

    Amended:

    4757-1-05        Change to allow credit card payment of fees for online renewals.

    4757-3-01        Change  definition  of  (D)  "Applicant"  to  allow  online  applications  without  a notarized form.

    4757-5-01 Adds "students" to those required to make mandatory reports of violations of the statute or rules and suspected incompetent, impaired or unethical practice. Expands definitions of prohibited contact in professional settings and clients of the agency. Makes many verb changes for clarity. Requires licensees working with children to read and understand ORC 3109.051(H)(1) & (2). Makes other changes for clarity.

    4757-6-02        Changes the number of days following an order of summary suspension before an adjudication hearing must be held if requested.

    4757-11-01      Adds to potential disciplinary actions - failure to adhere to a consent agreement and failure to cooperate in an investigation.

    4757-13-03 Modifies the examination requirements for Counselors. Requires a separate examination for PCC license. PCs who have passed the existing licensing examination will have until December 31, 2007 to complete their supervision/clinical requirements for PCC without having to take the clinical examination selected by the Board, after that date all PCC candidates will be required to have successfully completed the clinical examination. The following is not in the rule: The Board is working with the NBCC and is proposing to use the NBCC examination National Counselor Examination for Licensure and Certification (NCE) for PC examinations and the NBCC National Clinical Mental Health Counseling Examination (NCMHCE) for PCC examinations.

    4757-15-02      Modify reference in paragraph (A) to correct rule 4757-15-01 vice 4757-11-01. 4757-15-03      Adds requirement for license type and license number to counselor professional

    disclosure statements.

    4757-21-04      Adds  requirement  for  license  type  and  license  number  to  social  worker professional disclosure statements.

     

    New:

                                                    Scope of practice for marriage and family therapists.

    Scope of practice for independent marriage and family therapists.

                                                    Professional disclosure requirements for marriage and family therapists. 4757-29-01   Supervision requirements for marriage and family therapists.

     

    The public hearing on the proposed actions of the Counselor, Social Worker & Marriage and Family Therapist Board will be conducted on Friday, November 18, 2005.   The hearing will

     

     

     

    begin at 2:00 p.m. at Columbus One Building, 10 West Broad Street Suite 550, Columbus, Ohio 43215, and from time to time thereafter as may be required by the Board to hear all relevant testimony, oral or written, by any person affected by the proposed action, his/her attorney, or both.

    The full text of the proposed rules will be available on the Board's website,  http://cswmft.ohio.gov. All interested persons will be given an opportunity to be heard. Those persons who wish to provide oral testimony at the hearing are encouraged to inform the Board prior to the hearing date and may be given preference in the order of their testimony. Persons interested in providing written comments in lieu of oral testimony may direct them to the attention of James R. Rough, Executive Director, Counselor, Social Worker & Marriage and Family Therapist Board, 50 West Broad Street Suite 1425, Columbus, Ohio 43215-5919. These written comments must be received by the Board before the close of the hearing record.

    Copies of the proposed Rules will be on file with the Secretary of State, the Legislative Service Commission, and the Joint Committee on Agency Rule Review, at least thirty days prior to the public hearing, and are available at the Counselor, Social Worker & Marriage and Family Therapist Board Offices at the aforementioned address.
