    NOTICE OF PUBLIC HEARING

     

     

    The Ohio Department of Mental Retardation and Developmental Disabilities hereby gives notice of its intent to adopt rule 5123:2-3-24 of the Ohio Administrative Code on a permanent basis and to conduct a public hearing thereon.

     

    Rule 5123:2-3-24 entitled "Participation of individuals in day activities" is a new rule being proposed for adoption to ensure that individuals who live in an ICF/MR are able to maximize community participation by being afforded the opportunity to participate in day activities. The new rule is being proposed to implement Department policy promoting participation of individuals in day activities off-site an ICF/MR and to provide consistent application with ODJFS rule 5101:3-3-94 of the Administrative Code.

     

    A public hearing on the proposed new rule will be conducted on Monday, December 19, 2005, beginning at 9:30 A.M. and continuing until all persons in attendance have had an opportunity to testify, at 1810 Sullivant Avenue (large conference room), Columbus, Ohio. At this hearing, the Department will accept verbal and/or written testimony on the proposed rule.

     

    Any written comments on the proposed rule submitted on or before the public hearing date will be treated as testimony.
