    PUBLIC HEARING NOTICE

    OHIO DEPARTMENT OF JOB AND FAMILY SERVICES

     

    DATE:                       December 15, 2009

    Pursuant to section 4141.13 and Chapter 119. of the Ohio Revised Code, the Director of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the amendment and rescission of the rules as identified below and of a public hearing thereon.

     

    Rule 4141-11-01, entitled Quarterly reports and due date, is being amended because of the five year review. This rule sets forth the due dates and methods for filing quarterly reports required by Chapter 4141. The rule has been changed to remove a paragraph level designation to comply with LSC drafting requirements.

     

    Rule 4141-11-14, entitled Method of payment, clearance of checks, and dishonored checks, is being proposed for amendment because of the five year review. This rule provides methods for payment of unemployment contributions, establishes when the employer's account will be credited with the payment, and indicates that employers may be denied the privilege of making future payments by check if the check is returned for insufficient funds or any other reason. The change to the rule is deletion of an old address.

     

    Rule 4141-23-01, entitled Records of employers, is being proposed for amendment because of the five year review. This rule indicates the records to be maintained by employers for every individual in employment, and indicates when and where the records shall be made available to the department. The change to the rule is specifying that when the records are made available to the Department at the office of its duly authorized representative, such office shall be a location within the state of Ohio.

     

    Rule 4141-27-05, entitled Time limitation for filing claim for benefits within the benefit

    year, is being proposed for amendment because of the five year review. This rule specifies the time limitations for filing a claim for benefits and explains that the director may extend such time under certain circumstances. The amendment clarifies that the claim must ordinarily be filed on or before the end of the third week following the week in which the benefit year was established.

     

    Rule 4141-29-01, entitled Registration while claiming benefits, is being proposed for amendment because of the five year review. The rule specifies the procedure for, and duration of, registration. The rule is being amended to reconfigure paragraph level designations to comply with LSC rule drafting requirements.

     

    4141-30-12, entitled Pension payments, is being proposed for rescission because it is obsolete due to federal regulatory changes under amendments to 26 USC 3304(a), enacted on December 23, 2008 in P.L. 110-458, Title I, Subtitle A, Sec. 111(b), 122 Stat. 5113 relating to the unemployment insurance program. The rule previously explains when and how certain pension payments would be offset against unemployment benefits.

     

     

     

     

    4141-48-01, entitled Definitions for "Alternative Trade Adjustment Assistance for older workers", is being proposed for amendment because of the five year review. The rule defines the term "employed full time" for purposes of administration of the Alternative Trade Adjustment Assistance for Older Workers program. The change removes a paragraph level designation to comply with LSC drafting requirements.

    Copies of the proposed rules are available, without charge, to any person affected by the rules at the address listed below. The rules are also available on the internet at  http://www.registerofohio.state.oh.us/. A public hearing on the proposed rules will be held at the date, time, and location listed at the top of this notice. Either written or oral testimony will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
