    NOTIFICATION OF PUBLIC HEARING

    Notice of hearing

    to amend Rules 4501:1-3-02, -04, -08, -11, -32, and -33 of the Ohio Administrative Code in accordance with Chapter 119. of the Ohio Revised Code

     

    Notice is hereby given that a hearing will be held by the Motor Vehicle Dealers Board for the purpose of considering the proposed adoption of the above-listed administrative rules.

     

    Based on a review under Section 119.032 of the Ohio Revised Code of Chapter 4501:1-3 of the Administrative Code, and as authorized in Sections 4501.02 and 4517.12, 4517.27, 4517.32, 4517.33 of the Ohio Revised Code, the Motor Vehicle Dealers Board proposes to adopt amended Rules 4501:1-3-02, -04, -08,

    -11, -32, and -33 of the Ohio Administrative Code. The purpose of these rule filings is to provide and enhance clarity, access, and consistency, and to update provisions of Chapter 4501:1-3 of the Administrative Code which governs motor vehicle dealers and salespersons. To make requirements more consistent for the different types of motor vehicle dealers, proposed changes include clarification of requirements for minimum, appropriate office space, and a telephone. The proposed changes consistently provide that the office shall have a landline telephone number (not a cellular phone) in service at all times, that is listed in the local telephone directory as, and answered in the name of, the business, that required interior office space exclude restroom, storage, or utility space, and that office space be kept neat and orderly at all times and not be used as a storage or other utility area.  Proposed changes include update of a minimum net worth requirement from "$10,000" to "at least $75,000" verifiable net worth, clarification that minimum office space refers to usable, interior space, and addition of "security agreement" to a listing of items required to be maintained for record keeping purposes.  Finally, proposed changes establish minimum hours of operation to increase accessibility.

     

    A public hearing on the proposed rules will be held Thursday, December 18, 2008 at 9:00 am in room 109 (first floor) of the Charles D. Shipley Building, Ohio Department of Public Safety, 1970 West Broad Street, Columbus, Ohio.

     

    Either written or oral testimony will be received at the hearing.  Additionally, written comments received at the address below before the hearing will be treated as testimony.
