4501-47-02                  Waiver of commercial driver's license skills test.

 

 

 

(A)   Each person who applies for a waiver of the commercial driver's license road skills test shall meet all of the following requirements as set forth in 49 C.F.R. 383.77.

 

(1)   Certifies that during the two-year period immediately preceding his application for a commercial driver's license all of the following apply:

 

(a)   He has not had any driver's license suspended, revoked or canceled;

 

(b)     He has not had any convictions in any type of motor vehicle for the offenses for which disqualification is prescribed in section 4506.16 of the Revised Code;

 

(c)    He has not had any violation of a state or local law relating to motor vehicle traffic control other than a parking violation arising in connection with any traffic accident and has no record of an accident in which he was at fault.

 

(2)    Certifies and also provides evidence that he is regularly employed in a job requiring him to operate a commercial motor vehicle and that one of the following applies:

 

(a)    He has previously taken and passed a skills test given by a state with a classified licensing and testing system in which the test was behind-the-wheel in a representative vehicle for his commercial driver's license classification; or

 

(b)    He has regularly operated, for at least two years immediately preceding his application for a commercial driver's license, a vehicle representative of the commercial motor vehicle he operates or expects to operate.

 

(3)   Evidence of regular employment in a job which requires the applicant to operate a commercial motor vehicle may be provided by any one of the following:

 

(a)     A letter from the employer signed with an original signature which contains the name of the employer, federal tax identification number or social security account number;

 

(b)   A list of the applicant's employers within the two-year period immediately preceding his application.

 

 

 

(B)   Any person who has completed and passed a commercial driver's license skills test in another state or jurisdiction which is in compliance with rules of the federal highway administration may apply for a waiver of the requirement to take a skills test in Ohio.
