    NOTICE OF PUBLIC HEARING

     

    On December 20, 2004, the Ohio Department of Commerce, Division of Real Estate and the Ohio Real Estate Appraiser Board will hold a public hearing on proposed amendment of two rules and adoption of one rule. The hearing will be held at 9:00 a.m. in the 20th Floor Hearing Room at the Vern Riffe Center for the Arts and Government, located at 77 South High Street, Columbus, Ohio 43215.     PROPOSED RULES

     

    1301:11-3-04 Experience requirement

    Changes & Rationale

    The purpose of amendment is to require those apprentices that are acquiring experience to enter the profession with at least a minimum level of competency. The amendment requires that apprentice appraisers acquiring the experience for licensure must be state registered real estate appraiser assistants. Thus, apprentices must comply with the assistant education requirements when they register.

     

    In addition, the amendment will provide that such experience be obtained under the supervision of a state licensed or certified appraiser in good standing with the Board at all times. The rule also provides that an appraiser assistant may not have more than three supervisors at any one time and a supervising appraiser may not have more than three assistants at one time.

     

    The amendment requires the apprentice to maintain a log, which contains certain information for each appraisal. Finally, the rule permits that twenty-five percent (25%) of the required experience hours to be obtained by work on non-client appraisals through an approved course provider or a mentorship program.

     

    1301:11-1-03 Fees

    Changes & Rationale

    The purpose of the amendment is to clarify 4763.03 by providing that the Board shall determine annually the amount due from each certified or licensed real estate appraiser for the real estate appraiser recovery fund based on the cash balance in the fund and pending claims against the fund.

     

    1301:11-1-10 Settlement Agreements

    Adoption Rationale

    The purpose of the rule is to set forth the minimum guidelines for the Superintendent to enter into settlement agreements with appraiser facing disciplinary proceedings for violation of appraiser licensing law.
