Public Hearing Notice Amended OAC Chapter 3745-73

 

 

Notice is hereby given that in accordance with Ohio Revised Code (ORC) 119.032 (5-year rule review), the Ohio Environmental Protection Agency (OEPA), Division of Air Pollution Control (DAPC) has reviewed the rules contained in Ohio Administrative Code (OAC) Chapter 3745-73. These rules are related to control of emissions of total reduced sulfur from Kraft Pulp Mills in Ohio. Our preliminary review indicates that the rules in this chapter continue to be necessary and require modifications to the following rules:

3745-73-04      Emission test methods and reporting requirements.

 

DAPC is proposing the following changes:

 

OAC rules 3745-73-01 (Definitions) and 3745-73-04 (Emission test methods and reporting requirements) are being amended to incorporate corrections of typographical errors and updates to references of incorporated materials to satisfy the requirement of ORC 121.72. Also, the title of 3745-73-01 is being changed to "Definitions and reference to materials" to properly reflect the rule content.

 

OAC rule 3745-73-02 (Certification and compliance time schedules) is being amended to replace "the actual date of this rule" with the actual historic date from which the compliance times and other deadlines set forth in 3745-73-02(C) are measured.

 

OAC rule 3745-73-03 (General emission limits) is being amended to conform to guidance in the Legislative Services Commission style manual concerning representation of numbers.

 

Pursuant to Section 121.39 of the Ohio Revised Code, DAPC was required to consult with interested parties affected by the rules before the Division formally adopts them. On June 25, 2010 these rules went out for a 30-day review by interested parties.

 

Pursuant to Section 119.03 of the Ohio Revised Code, a public hearing on these rule changes will be conducted on Monday, December 20, 2010 at 10:30 AM, in room 6C at Ohio EPA, Lazarus Government Center, 50 W. Town Street, Suite 700, Columbus, Ohio. All visitors to Ohio EPA must register at the Security desk in the lobby upon arrival. Please bring photo identification (such as a valid driver's license). For security reasons, visitor's are required to wear their badge at all times while in the building. Please arrive early to complete these procedures.

 

All interested persons are entitled to attend or be represented at the hearing and give

 

 

 

 

 

written or oral comments on these rule changes. All oral comments presented at the hearing, and all written statements submitted at the hearing or by the close of business on December 20, 2010, will be considered by Ohio EPA prior to final action on this rule. Written statements submitted after December 20, 2010, may be considered as time and circumstances permit, but will not be part of the official record of the hearing.
