    LEGAL NOTICE

     

    STATE OF OHIO DEPARTMENT OF NATURAL RESOURCES

     

    NOTICE OF INTENTION TO AMEND AND HOLD A PUBLIC HEARING ON STATE OF OHIO WATERCRAFT RULES

     

     

    The Chief of the Division of Watercraft, pursuant to Section 1547.52 of the Ohio Revised Code, hereby gives notice of his intention to amend the following rule:

     

    1501:47-3-19  Lakes permitting ten horsepower and to adopt the following rule:

    1501:47-3-99  Unlimited horsepower at no wake speed - Cowan lake pilot program

     

    Administrative Rule 1501:47-3-19 is being amended to remove the ten horsepower restriction for recreational vessels operating on the waters of Cowan Lake located in Clinton County.  Administrative Rule 1501:47-3-99 is being adopted to temporarily allow powercraft propelled by motors with more than ten horsepower to operate at no-wake speed on the waters of Cowan Lake.  Beginning November 1, 2017 only powercraft propelled by a motor or combination of motors with less than ten horsepower will be permitted to operate on Cowan Lake unless a permanent rule change is promulgated prior to that date.

     

    A public hearing on the proposed amendment and adoption of these rules will be held at 10:30 am on Tuesday, December 29, 2015 in the Building E Assembly Center, at the Ohio Department of Natural Resources Headquarters which is located at 2045 Morse Road in Columbus, Ohio.  At the public hearing, any person affected by the rule amendment or adoption may appear and be heard in person, or by an attorney, or both, and may present testimony, orally or in writing, and present evidence tending to show that these rules, if amended or adopted, will be unreasonable or unlawful.
