    3770:1-9-564               Game rule number five hundred sixty-four.

     

     

     

    (A)   Title and term. Ohio lottery commission game rule number five hundred sixty-four, "Blackjack Doubler," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number five hundred sixty-four.

     

    (B)  General design.

     

    (1)   Game rule number five hundred sixty-four is a "Beat the Dealer" game with a "Doubler" feature, and is generally known as an "instant lottery."

     

    (2)    The player will remove the covering off the entire play area to reveal one "Dealer's Total," four "Player's Hands" ("Hand 1" through "Hand 4") consisting of two card values each and four corresponding prize values. If the sum of any "Hand" is higher than the "Dealer's Total," the player wins the corresponding prize value revealed for that "Hand." If the total of any "Hand" is "21" or "Blackjack," the player wins double the corresponding prize value revealed for that "Hand." To reach the total of "21," the player must reveal either the "10," "Jack," "Queen" or "King" cards which have a value of ten and the "Ace" card which has a value of eleven. ("Aces" are high in this game). There are four chances to win on each ticket, and a player may win up to four times on one ticket.

     

    (3)   As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: one dollar, two dollars, four dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars and two thousand one hundred dollars. Each ticket in game rule number five hundred sixty-four shall be imprinted in such a way that prize awards from the set listed above may be won.

     

    (C)   Price of tickets. The price of a ticket issued by the commission in game rule number five hundred sixty-four shall be one dollar.

     

    (D)  Structure, nature and value of prize awards.

     

    (1)   There shall be one type of prize in game rule number five hundred sixty-four called a "regular prize award."

     

     

     

    (2)   The only "prize values" which shall appear on a ticket in game rule number five hundred sixty-four are: one dollar, two dollars, four dollars, five dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars and two thousand one hundred dollars. Card values and prize values appearing on any ticket in game rule number five hundred sixty-four shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying card values and prize values.

    (a)   Holder of a valid winning ticket on which the sum of one "Hand" is higher than the "Dealer's Total" for one dollar once shall win a regular prize award of one dollar;

    (b)    Holder of a valid winning ticket on which the sum of two "Hands" is higher than the "Dealer's Total" for one dollar two times shall win a regular prize award of two dollars;

    (c)    Holder of a valid winning ticket on which one "Hand" totals "21" or "Blackjack" for one dollar doubled shall win a regular prize award of two dollars;

    (d)    Holder of a valid winning ticket on which the sum of one "Hand" is higher than the "Dealer's Total" for two dollars once shall win a regular prize award of two dollars;

    (e)    Holder of a valid winning ticket on which the sum of four "Hands" is higher than the "Dealer's Total" for one dollar four times shall win a regular prize award of four dollars;

    (f)    Holder of a valid winning ticket on which the sum of two "Hands" is higher than the "Dealer's Total" for two dollars two times shall win a regular prize award of four dollars;

    (g)    Holder of a valid winning ticket on which one "Hand" totals "21" or "Blackjack" for two dollars doubled shall win a regular prize award of four dollars;

    (h)    Holder of a valid winning ticket on which the sum of one "Hand" is higher than the "Dealer's Total" for four dollars once shall win a regular prize award of four dollars;

    (i)    Holder of a valid winning ticket on which the sum of two "Hands" is

    higher than the "Dealer's Total" for five dollars two times shall win a regular prize award of ten dollars;

    (j)    Holder of a valid winning ticket on which the sum of four "Hands" is higher than the "Dealer's Total" for one dollar two times and  four dollars two times shall win a regular prize award of ten dollars;

    (k)    Holder of a valid winning ticket on which one "Hand" totals "21" or "Blackjack" for five dollars doubled shall win a regular prize award of ten dollars;

    (l)   Holder of a valid winning ticket on which the sum of one "Hand" is higher than the "Dealer's Total" for ten dollars once shall win a regular prize award of ten dollars;

    (m)    Holder of a valid winning ticket on which the sum of four "Hands" is higher than the "Dealer's Total" for five dollars four times shall win a regular prize award of twenty dollars;

    (n)    Holder of a valid winning ticket on which the sum of one "Hand" is higher than the "Dealer's Total" for ten dollars once; and one "Hand" totals "21" or "Blackjack" for five dollars doubled shall win a regular prize award of twenty dollars;

    (o)    Holder of a valid winning ticket on which one "Hand" totals "21" or "Blackjack" for ten dollars doubled shall win a regular prize award of twenty dollars;

    (p)    Holder of a valid winning ticket on which the sum of one "Hand" is higher than the "Dealer's Total" for twenty dollars once shall win a regular prize award of twenty dollars;

    (q)    Holder of a valid winning ticket on which the sum of two "Hands" is higher than the "Dealer's Total" for five dollars two times; and one "Hand" totals "21" or "Blackjack" for twenty dollars doubled shall win a regular prize award of fifty dollars;

    (r)    Holder of a valid winning ticket on which the sum of three "Hands" is higher than the "Dealer's Total" for ten dollars once and twenty dollars two times shall win a regular prize award of fifty dollars;

    (s)   Holder of a valid winning ticket on which the sum of one "Hand" is higher

    than the "Dealer's Total" for fifty dollars once shall win a regular prize award of fifty dollars;

    (t)    Holder of a valid winning ticket on which one "Hand" totals "21" or "Blackjack" for fifty dollars doubled shall win a regular prize award of one hundred dollars;

    (u)    Holder of a valid winning ticket on which the sum of one "Hand" is higher than the "Dealer's Total" for one hundred dollars once shall win a regular prize award of one hundred dollars; and

    (v)    Holder of a valid winning ticket on which the sum of one "Hand" is higher than the "Dealer's Total" for two thousand one hundred dollars once shall win a regular prize award of two thousand one hundred dollars.

    (E)   Number of prize awards. The number of prize awards in any sales cycle of game rule number five hundred sixty-four will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:

    (1)   Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2)   Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:

    (a)    Two tickets winning two thousand one hundred dollars once to win two thousand one hundred dollars;

    (b)   Four tickets winning one hundred dollars once to win one hundred dollars;

    (c)   Eight tickets winning fifty dollars doubled to win one hundred dollars;

    (d)  Forty-two tickets winning fifty dollars once to win fifty dollars;

    (e)   Fifty tickets winning ten dollars once and twenty dollars two times to win

    fifty dollars;

    (f)    One hundred tickets winning five dollars two times and twenty dollars doubled to win fifty dollars;

    (g)    Two hundred fifty tickets winning twenty dollars once to win twenty dollars;

    (h)     Two hundred fifty tickets winning ten dollars doubled to win twenty dollars;

    (i)     Two  hundred  fifty  tickets  winning  ten  dollars  once  and  five  dollars doubled to win twenty dollars;

    (j)    Two hundred fifty tickets winning five dollars four times to win twenty dollars;

    (k)   Two hundred fifty tickets winning ten dollars once to win ten dollars;

    (l)   One thousand tickets winning five dollars doubled to win ten dollars;

    (m)    Two hundred fifty tickets winning one dollar two times and four dollars two times to win ten dollars;

    (n)   Five hundred tickets winning five dollars two times to win ten dollars;

    (o)   Two hundred fifty tickets winning four dollars once to win four dollars;

    (p)   One thousand tickets winning two dollars doubled to win four dollars;

    (q)    Two hundred fifty tickets winning two dollars two times to win four dollars;

    (r)    One thousand five hundred tickets winning one dollar four times to win four dollars;

    (s)   Four thousand tickets winning two dollars once to win two dollars;

    (t)  Nine thousand tickets winning one dollar doubled to win two dollars;

    (u)   Seven thousand tickets winning one dollar two times to win two dollars; and

    (v)   Fifteen thousand tickets winning one dollar once to win one dollar.

    (F)   Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G)  Frequency of prize drawings.

    (1)    Random imprinting of prize awards on all tickets issued in game rule number five hundred sixty-four shall be accomplished in a manner, which complies with the commission's rules and procedures.

    (2)    When a ticket issued in game rule number five hundred sixty-four is sold or deemed sold in accordance with this rule and the covering material over any of the card values and prize values has been removed, the holder shall be deemed to have drawn the card values and prize values on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number five hundred sixty-four in which the ticket was sold.

    (H)    Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I)  Validity of tickets.

    (1)   A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2)   In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number five hundred sixty-four void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J)   Director's conduct of game rule number five hundred sixty-four.

    (1)     The director shall conduct game rule number five hundred sixty-four in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number five hundred sixty-four. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2)   Names and definitions of elements of game rule number five hundred sixty-four used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number five hundred sixty-four and these elements may be given names or titles chosen by the commission.
