3770:1-9-604               Game rule number six hundred four.

 

 

 

(A)     Title and term. Ohio lottery commission game rule number six hundred four, "Electric 8's," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number six hundred four.

 

(B)  General design.

 

(1)    Game rule number six hundred four is a key number match game with two additional instant win features and is generally known as an "instant lottery."

 

(2)    Holders of valid tickets will remove the covering off the entire play area to reveal two "Winning Numbers," ten "Your Numbers" and ten corresponding prize values. If any one or more of "Your Number(s)" matches one or more of the "Winning Number(s)," the player wins the corresponding prize value(s) shown next to the matching "Your Number(s)." If the player reveals a "Black Eight" symbol in any of the "Your Numbers" play spots, the player wins its corresponding prize value automatically. If the player reveals a "Red Eight" symbol in any of the "Your Numbers" play spots, the player wins eight times the corresponding prize value automatically. There are ten chances to win on each ticket, and a player may win up to ten times on one ticket.

 

(3)   As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: two dollars, four dollars, eight dollars, eighteen dollars, fifty dollars, eighty-eight dollars, one hundred dollars, eight hundred dollars, and eighteen thousand eight hundred eighty-eight dollars. Each ticket in game rule number six hundred four shall be imprinted in such a way that prize awards from the set listed above may be won.

 

(C)   Price of tickets. The price of a ticket issued by the commission in game rule number six hundred four shall be two dollars.

 

(D)  Structure, nature and value of prize awards.

 

(1)    There shall be one type of prize in game rule number six hundred four, a "regular prize award."

 

 

 

(2)   The only "prize values" which shall appear on a ticket in game rule number six hundred four are: one dollar, two dollars, four dollars, five dollars, eight dollars, ten dollars, eighteen dollars, fifty dollars, eighty-eight dollars, one hundred dollars, eight hundred dollars, and eighteen thousand eight hundred eighty-eight dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number six hundred four shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.

(a)    Holder of a valid winning ticket on which one or more of the "Winning Numbers" is matched by two of "Your Numbers," or a "Black Eight" symbol is revealed in two of "Your Numbers" play spots, or any combination of two matched numbers or "Black Eight" symbols are revealed for one dollar two times shall win a regular prize award of two dollars;

(b)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers," or a "Black Eight" symbol is revealed in one of "Your Numbers" play spots, for two dollars once shall win a regular prize award of two dollars;

(c)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers," or a "Black Eight" symbol is revealed in one of "Your Numbers" play spots, for four dollars once shall win a regular prize award of four dollars;

(d)   Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers," or a "Black Eight" symbol is revealed in two of "Your Numbers" play spots, or any combination of two matched numbers or "Black Eight" symbols are revealed for two dollars two times shall win a regular prize award of four dollars;

(e)    Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers," or a "Black Eight" symbol is revealed in four of "Your Numbers" play spots, or any combination of four matched numbers or "Black Eight" symbols are revealed for one dollar four times shall win a regular prize award of four dollars;

(f)   Holder of a valid winning ticket on which one or more of the "Winning Numbers" is matched by two of "Your Numbers," or a "Black Eight"

symbol is revealed in two of the "Your Numbers" play spots, or any combination of two matched numbers or "Black Eight" symbols are revealed for five dollars once and three dollars once shall win a regular prize award of eight dollars;

(g)   Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by eight of "Your Numbers," or a "Black Eight" symbol is revealed in eight of "Your Numbers" play spots, or any combination of eight matched numbers or "Black Eight" symbols are revealed for one dollar eight times shall win a regular prize award of eight dollars;

(h)     Holder of a valid winning ticket on which a "Red Eight" symbol is revealed in one of the "Your Numbers" play spots for one dollar times eight shall win a regular prize award of eight dollars;

(i)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Black Eight" symbol is revealed in one of the "Your Numbers" play spots for eight dollars once shall win a regular prize award of eight dollars;

(j)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Black Eight" symbol is revealed in one of the "Your Numbers" play spots for two dollars once, and on which a "Red Eight" symbol is revealed in one of "Your Numbers" play spots for two dollars times eight shall win a regular prize award of eighteen dollars;

(k)   Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by eight of "Your Numbers," or a "Black Eight" symbol is revealed in eight of the "Your Numbers" play spots, or any combination of eight matched numbers or "Black Eight" symbols are revealed for one dollar three times and three dollars five times shall win a regular prize award of eighteen dollars;

(l)    Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers," or a "Black Eight" symbol is revealed in two of the "Your Numbers" play spots, or any combination of two matched numbers or "Black Eight" symbols are revealed for eight dollars once and ten dollars once shall win a regular prize award of eighteen dollars;

(m)   Holder of a valid winning ticket on which one of the "Winning Numbers"

is matched by one of "Your Numbers" or a "Black Eight" symbol is revealed in one of the "Your Numbers" play spots for eighteen dollars once shall win a regular prize award of eighteen dollars;

(n)   Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers," or a "Black Eight" symbol is revealed in ten of the "Your Numbers" play spots, or any combination of ten matched numbers or "Black Eight" symbols are revealed for five dollars ten times shall win a regular prize award of fifty dollars;

(o)   Holder of a valid winning ticket on which one or more of the "Winning Numbers" is matched by five of "Your Numbers" or a "Black Eight" symbol is revealed in five of the "Your Numbers" play spots, or any combination of five matched numbers or "Black Eight" symbols are revealed for ten dollars five times shall win a regular prize award of fifty dollars;

(p)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers," or a "Black Eight" symbol is revealed in one of the "Your Numbers" play spots for ten dollars once, and on which a "Red Eight" symbol is revealed in one of "Your Numbers" play spots for five dollars times eight shall win a regular prize award of fifty dollars;

(q)   Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by eight of "Your Numbers," or a "Black Eight" symbol is revealed in eight of the "Your Numbers" play spots, or any combination of eight matched numbers or "Black Eight" symbols are revealed for four dollars two times, eight dollars five times and two dollars once shall win a regular prize award of fifty dollars;

(r)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Black Eight" symbol is revealed in one of the "Your Numbers" play spots for fifty dollars once shall win a regular prize award of fifty dollars;

(s)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Black Eight" symbol is revealed in one of the "Your Numbers" play spots for eight dollars once, and on which a "Red Eight" symbol is revealed in one of "Your Numbers" play spots for ten dollars times eight shall win a regular prize award of eighty-eight dollars;

(t)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Black Eight" symbol is revealed in one of the "Your Numbers" play spots for eighty-eight dollars once shall win a regular prize award of eighty-eight dollars;

(u)   Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers," or a "Black Eight" symbol is revealed in two of the "Your Numbers" play spots, or any combination of two matched numbers or "Black Eight" symbols are revealed for two dollars once and eighteen dollars once; and on which a "Red Eight" symbol is revealed in one of the "Your Numbers" play spots for ten dollars times eight shall win a regular prize award of one hundred dollars;

(v)   Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by three of "Your Numbers," or a "Black Eight" symbol is revealed in three of the "Your Numbers" play spots, or any combination of three matched numbers or "Black Eight" symbols are revealed for four dollars once, eight dollars once and eighty-eight dollars once shall win a regular prize award of one hundred dollars;

(w)   Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by eight of "Your Numbers," or a "Black Eight" symbol is revealed in eight of the "Your Numbers" play spots, or any combination of eight matched numbers or "Black Eight" symbols are revealed for two dollars once, four dollars two times and eighteen dollars five times shall win a regular prize award of one hundred dollars;

(x)   Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Black Eight" symbol is revealed in one of the "Your Numbers" play spots for one hundred dollars once shall win a regular prize award of one hundred dollars;

(y)     Holder of a valid winning ticket on which a "Red Eight" symbol is revealed in one of the "Your Numbers" play spots for one hundred dollars times eight shall win a regular prize award of eight hundred dollars;

(z)    Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by all ten of "Your Numbers," or a "Black Eight" symbol is revealed in all ten of "Your Numbers" play spots, or

any combination of ten matched numbers or "Black Eight" symbols are revealed for eight dollars once and eighty-eight dollars nine times shall win a regular prize award of eight hundred dollars;

(aa) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Black Eight" symbol is revealed in one of the "Your Numbers" play spots for eight hundred dollars once shall win a regular prize award of eight hundred dollars; and

(bb) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Black Eight" symbol is revealed in one of the "Your Numbers" play spots for eighteen thousand eight hundred eighty-eight dollars once shall win a regular prize award of eighteen thousand eight hundred eighty-eight dollars.

(E)   Number of prize awards. The number of prize awards in any sales cycle of game rule number six hundred four will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:

(1)   Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

(2)    Mathematical reasoning indicates that the number of winning tickets per six million tickets sold in the following prize categories should be as follows:

(a)   Thirty tickets matching numbers or revealing a "Black Eight" symbol for eighteen thousand eight hundred eighty-eight dollars once to win eighteen thousand eight hundred eighty-eight dollars;

(3)   Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:

(a)    Three tickets matching numbers or revealing "Black Eight" symbols, or any combination thereof, for eight hundred dollars once to win eight hundred dollars;

(b)    Three tickets matching numbers or revealing "Black Eight" symbols, or any combination thereof, for eight dollars once and eighty-eight dollars nine times to win eight hundred dollars;

(c)    Three tickets revealing the "Red Eight" symbol once for one hundred dollars times eight to win eight hundred dollars;

(d)   Five tickets matching numbers or revealing a "Black Eight" symbol for one hundred dollars once to win one hundred dollars;

(e)   Five tickets matching numbers or revealing "Black Eight" symbols, or any combination thereof, for two dollars once, four dollars two times and eighteen dollars five times to win one hundred dollars;

(f)   Six tickets matching numbers or revealing "Black Eight" symbols, or any combination thereof, for four dollars once, eight dollars once and eighty-eight dollars once to win one hundred dollars;

(g)   Fifteen tickets matching numbers or revealing "Black Eight" symbols, or any combination thereof, for two dollars once and eighteen  dollars once; and revealing a "Red Eight" symbol once for ten dollars times eight to win one hundred dollars;

(h)   Forty tickets matching numbers or revealing a "Black Eight" symbol for eighty-eight dollars once to win eighty-eight dollars;

(i)    Sixty tickets matching numbers or revealing a "Black Eight" symbol for eight dollars once and revealing a "Red Eight" symbol once for ten dollars times eight to win eighty-eight dollars;

(j)     One hundred tickets matching numbers or revealing a "Black Eight" symbol for fifty dollars once to win fifty dollars;

(k)     Two hundred tickets matching numbers or revealing "Black Eight" symbols, or any combination thereof, for two dollars once, four dollars two times and eight dollars five times to win fifty dollars;

(l)     Three hundred tickets matching numbers or revealing a "Black Eight" symbol for ten dollars once and revealing a "Red Eight" symbol once for five dollars times eight to win fifty dollars;

(m)     Two hundred tickets matching numbers or revealing "Black Eight" symbols, or any combination thereof, for ten dollars five times to win fifty dollars;

(n)     Two hundred tickets matching numbers or revealing "Black Eight" symbols, or any combination thereof, for five dollars ten times to win fifty dollars;

(o)     Five hundred tickets matching numbers or revealing a "Black Eight" symbol for eighteen dollars once to win eighteen dollars;

(p)      Five hundred tickets matching numbers or revealing "Black Eight" symbols, or any combination thereof, for eight dollars once and ten dollars once to win eighteen dollars;

(q)      Five hundred tickets matching numbers or revealing "Black Eight" symbols, or any combination thereof, for one dollar three times and three dollars five times to win eighteen dollars;

(r)     Five hundred tickets matching numbers or revealing a "Black Eight" symbol for two dollars once and revealing a "Red Eight" symbol once for two dollars times eight to win eighteen dollars;

(s)     Five hundred tickets matching numbers or revealing a "Black Eight" symbol for eight dollars once to win eight dollars;

(t)   Five hundred tickets revealing a "Red Eight" symbol once for one dollar times eight to win eight dollars;

(u)      Five hundred tickets matching numbers or revealing "Black Eight" symbols, or any combination thereof, for one dollar eight times to win eight dollars;

(v)      Five hundred tickets matching numbers or revealing "Black Eight" symbols, or any combination thereof, for three dollars once and five dollars once to win eight dollars;

(w)     Six thousand tickets matching numbers or revealing "Black Eight" symbols, or any combination thereof, for one dollar four times to win four dollars;

(x)      Six thousand tickets matching numbers or revealing "Black Eight" symbols, or any combination thereof, for two dollars two times to win four dollars;

(y)     Ten thousand tickets matching numbers or revealing a "Black Eight" symbol for four dollars once to win four dollars;

(z)    Eight thousand tickets matching numbers or revealing a "Black Eight" symbol for two dollars once to win two dollars; and

(aa) Eight thousand tickets matching numbers or revealing "Black Eight" symbols, or any combination thereof, for one dollar two times to win two dollars.

(F)   Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

(G)  Frequency of prize drawings.

(1)     Random imprinting of prize awards on all tickets issued in game rule six hundred four shall be accomplished in a manner which complies with the commission's rules and procedures.

(2)   When a ticket is issued in game rule number six hundred four is sold or deemed sold in accordance with this rule and covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game number six hundred four in which the ticket is sold.

(H)    Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

(I)  Validity of tickets.

(1)   A mechanical error in printing prize awards, symbols, words or other numbers on  a  ticket  shall  not  automatically  invalidate  that  ticket.  To  the  extent

feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

(2)   In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number six hundred three void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

(J)   Director's conduct in game rule six hundred four.

(1)    The director shall conduct game rule number six hundred four in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number six hundred three. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

(2)   Names and definitions of elements of game rule number six hundred four used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number six hundred four and these elements may be given names or titles chosen by the commission.
