    3770:1-9-610               Game rule number six hundred ten.

     

     

     

    (A)     Title and term. Ohio lottery commission game rule number six hundred ten, "Blackjack," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number six hundred ten.

     

    (B)  General design.

     

    (1)   Game rule number six hundred ten is a card style game and is generally known as an "instant lottery."

     

    (2)   In each "Game" ("Game 1," "Game 2," "Game 3," "Game 4," "Game 5," "Game 6," "Game 7," "Game 8," "Game 9," "Game 10," "Game 11," and "Game 12"), holders of valid tickets will remove the covering off the entire play area in each "Game" to reveal two card values in "Your Hand," the "Dealer's Total," and the corresponding prize values for each "Game." If the total sum of the two cards in any one of "Your Hands" in a "Game" is higher than the corresponding "Dealer's Total," the player wins the corresponding prize value revealed for that "Game." "Jack - J," "Queen - Q" or "King - K" cards have a value of ten and the "Ace - A" card has a value of eleven. There are twelve chances to win on each ticket, and a player may win up to twelve times on one ticket. If the total sum of the cards in any one of "Your Hands" in a "Game" is higher than the corresponding "Dealer's Total," and if the corresponding prize value revealed is a "TPD" symbol, the player wins one thousand dollars automatically, and, upon the filing of a valid claim at an Ohio lottery commission office, shall also automatically be entered in the Top Prize Drawing ("TPD") to win a two hundred thousand dollar prize. The Top Prize Drawing shall be conducted in accordance with Ohio lottery rules and procedures established and approved by the director.

     

    (3)   As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: five dollars, ten dollars, twenty dollars, twenty-five dollars, fifty dollars, seventy-five dollars, one hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars, twenty thousand and two hundred thousand dollars. Each ticket in game rule number six hundred ten shall be imprinted in such a way that prize awards from the set listed above may be won.

     

    (C)   Price of tickets. The price of a ticket issued by the commission in game rule number

     

     

    six hundred ten shall be five dollars.

    (D)  Structure, nature and value of prize awards.

    (1)   There shall be two types of prize in game rule number six hundred ten called a "regular prize award" and a "TPD prize award."

    (2)   The only "prize values" which shall appear on a ticket in game rule number six hundred ten are: one dollar, two dollars, three dollars, five dollars, ten dollars, twenty dollars, twenty-five dollars, fifty dollars, seventy-five dollars, one hundred dollars, five hundred dollars, TPD symbol corresponding to a prize value of one thousand dollars, five thousand dollars, twenty thousand dollars, and two hundred thousand dollars. Card values, prize values and play symbols appearing on any ticket in game rule number six hundred ten shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying card values, prize values and play symbols.

    (a)   Holder of a valid winning ticket on which the total sum of the two cards in one of "Your Hands" is higher than the corresponding "Dealer's Total" for five dollars in the corresponding "Game" across shall win a regular prize award of five dollars;

    (b)   Holder of a valid winning ticket on which the total sum of the two cards in each of five of "Your Hands" is higher than each of the corresponding five "Dealer's Total" for one dollar five times in the corresponding "Games" across shall win a regular prize of five dollars;

    (c)   Holder of a valid winning ticket on which the total sum of the two cards in each of two of "Your Hands" is higher than each of the corresponding two "Dealer's Total" for two dollars once and three dollars once in the corresponding "Games" across shall win a regular prize of five dollars;

    (d)  Holder of a valid winning ticket on which the total sum of the two cards in one of "Your Hands" is higher than the corresponding "Dealer's Total" for ten dollars once in the corresponding "Game" across shall win a regular prize of ten dollars;

    (e)   Holder of a valid winning ticket on which the total sum of the two cards in each of ten of "Your Hands" is higher than each of the corresponding ten "Dealer's Total" for one dollar ten times in the corresponding "Games" across shall win a regular prize of ten dollars;

    (f)  Holder of a valid winning ticket on which the total sum of the two cards in each of two of "Your Hands" is higher than each of the corresponding two "Dealer's Total" for five dollars two times in the corresponding "Games" across shall win a regular prize of ten dollars;

    (g)   Holder of a valid winning ticket on which the total sum of the two cards in each of five of "Your Hands" is higher than each of the corresponding five "Dealer's Total" for two dollars five times in the corresponding "Games" across shall win a regular prize of ten dollars;

    (h)   Holder of a valid winning ticket on which the total sum of the two cards in each of three of "Your Hands" is higher than each of the corresponding three "Dealer's Total" for two dollars once, three dollars once and five dollars once in the corresponding "Games" across shall win a regular prize of ten dollars;

    (i)   Holder of a valid winning ticket on which the total sum of the two cards in one of "Your Hands" is higher than the corresponding "Dealer's Total" for twenty dollars once in the corresponding "Game" across shall win a regular prize of twenty dollars;

    (j)   Holder of a valid winning ticket on which the total sum of the two cards in each of four of "Your Hands" is higher than each of the corresponding four "Dealer's Total" for five dollars four times in the corresponding "Games" across shall win a regular prize of twenty dollars;

    (k)   Holder of a valid winning ticket on which the total sum of the two cards in each of two of "Your Hands" is higher than the corresponding two "Dealer's Total" for ten dollars two times in the corresponding "Games" across shall win a regular prize of twenty dollars;

    (l)   Holder of a valid winning ticket on which the total sum of the two cards in each of ten of "Your Hands" is higher than each of corresponding ten "Dealer's Total" for two dollars ten times in the corresponding "Games" across shall win a regular prize of twenty dollars;

    (m)   Holder of a valid winning ticket on which the total sum of the two cards in each of three of "Your Hands" is higher than each of the corresponding three "Dealer's Total" for five dollars two times and ten dollars once in the corresponding "Games" across shall win a regular prize of twenty dollars;

    (n)   Holder of a valid winning ticket on which the total sum of the two cards in each of twelve of "Your Hands" is higher than each of the corresponding twelve "Dealer's Total" for one dollar ten times and five dollars two times in the corresponding "Games" across shall win a regular prize of twenty dollars;

    (o)   Holder of a valid winning ticket on which the total sum of the two cards in each of eight of "Your Hands" is higher than the corresponding eight "Dealer's Total" for two dollars four times and three dollars four times in the corresponding "Games" across shall win a regular prize of twenty dollars;

    (p)   Holder of a valid winning ticket on which the total sum of the two cards in one of "Your Hands" is higher than the corresponding "Dealer's Total" for twenty-five dollars once in the corresponding "Game" across shall win a regular prize of twenty-five dollars;

    (q)   Holder of a valid winning ticket on which the total sum of the two cards in each of five of "Your Hands" is higher than each of the corresponding five "Dealer's Total" for five dollars five times in the corresponding "Games" across shall win a regular prize of twenty-five dollars;

    (r)   Holder of a valid winning ticket on which the total sum of the two cards in each of twelve of "Your Hands" is higher than each of the corresponding twelve "Dealer's Total" for two dollars eleven times and three dollars once in the corresponding "Games" across shall win a regular prize of twenty-five dollars;

    (s)   Holder of a valid winning ticket on which the total sum of the two cards in one of "Your Hands" is higher than the corresponding "Dealer's Total" for fifty dollars once in the corresponding "Game" across shall win a regular prize of fifty dollars;

    (t)   Holder of a valid winning ticket on which the total sum of the two cards in each of five of "Your Hands" is higher than each of the corresponding five "Dealer's Total" for ten dollars five times in the corresponding "Games" across shall win a regular prize of fifty dollars;

    (u)   Holder of a valid winning ticket on which the total sum of the two cards in each of nine of "Your Hands" is higher than the corresponding nine "Dealer's Total" for five dollars eight times and ten dollars once in the corresponding "Games" across shall win a regular prize of fifty dollars;

    (v)   Holder of a valid winning ticket on which the total sum of the two cards in each of ten of "Your Hands" is higher than each of the corresponding ten "Dealer's Total" for five dollars ten times in the corresponding "Games" across shall win a regular prize of fifty dollars;

    (w)   Holder of a valid winning ticket on which the total sum of the two cards in each of eight of "Your Hands" is higher than each of the corresponding eight "Dealer's Total" for ten dollars two times and five dollars six times in the corresponding "Games" across shall win a regular prize of fifty dollars;

    (x)   Holder of a valid winning ticket on which the total sum of the two cards in each of two of "Your Hands" is higher than the corresponding two "Dealer's Total" for twenty-five dollars two times in the corresponding "Games" across shall win a regular prize of fifty dollars;

    (y)   Holder of a valid winning ticket on which the total sum of the two cards in each of six of "Your Hands" is higher than each of the corresponding six "Dealer's Total" for five dollars five times and twenty-five dollars once in the corresponding "Games" across shall win a regular prize of fifty dollars;

    (z)   Holder of a valid winning ticket on which the total sum of the two cards in one of "Your Hands" is higher than the corresponding "Dealer's Total" for seventy-five dollars once in the corresponding "Game" across shall win a regular prize of seventy-five dollars;

    (aa) Holder of a valid winning ticket on which the total sum of the two cards in each of twelve of "Your Hands" is higher than each of the corresponding twelve "Dealer's Total" for five dollars eleven times and twenty dollars once in the corresponding "Games" across shall win a regular prize of seventy-five dollars;

    (bb) Holder of a valid winning ticket on which the total sum of the two cards in one of "Your Hands" is higher than the corresponding "Dealer's Total" for one hundred dollars once in the corresponding "Game" across shall win a regular prize of one hundred dollars;

    (cc) Holder of a valid winning ticket on which the total sum of the two cards in each of ten of "Your Hands" is higher than each of the corresponding ten "Dealer's Total" for ten dollars ten times in the corresponding "Games" acorss shall win a regular prize of one hundred dollars;

    (dd) Holder of a valid winning ticket on which the total sum of the two cards in each of five of "Your Hands" is higher than each of the corresponding five "Dealer's Total" for twenty dollars five times in the corresponding "Games" across shall win a regular prize of one hundred dollars;

    (ee) Holder of a valid winning ticket on which the total sum of the two cards in each of two of "Your Hands" is higher than each of the corresponding two "Dealer's Total" for fifty dollars two times in the corresponding "Games" across shall win a regular prize of one hundred dollars;

    (ff) Holder of a valid winning ticket on which the total sum of the cards in each of twelve of "Your Hands" is higher than each of the corresponding twelve "Dealer's Total" for five dollars six times, ten dollars five times and twenty dollars once in the corresponding "Games" across shall win a regular prize of one hundred dollars;

    (gg) Holder of a valid winning ticket on which the total sum of the two cards in each of four of "Your Hands" is higher than each of the corresponding four "Dealer's Total" for twenty five dollars four times in the corresponding "Games" across shall win a regular prize of one hundred dollars;

    (hh) Holder of a valid winning ticket on which the total sum of the two cards in each of two of "Your Hands" is higher than each of the corresponding two "Dealer's Total" for twenty-five dollars once and seventy-five dollars once in the corresponding "Games" across shall win a regular prize of one hundred dollars;

    (ii) Holder of a valid winning ticket on which the total sum of the two cards in each of six of "Your Hands" is higher than each of the corresponding six "Dealer's Total" for ten dollars two times and twenty dollars four times in the corresponding "Games" across shall win a regular prize of one hundred dollars;

    (jj) Holder of a valid winning ticket on which the total sum of the two cards in one of "Your Hands" is higher than the corresponding "Dealer's Total" for five hundred dollars in the corresponding "Game" across shall win a regular prize of five hundred dollars;

    (kk) Holder of a valid winning ticket on which the total sum of the two cards

    in each of five of "Your Hands" is higher than each of the corresponding five "Dealer's Total" for one hundred dollars five times in the corresponding "Games" across shall win a regular prize of five hundred dollars;

    (ll) Holder of a valid winning ticket on which the total sum of the two cards in each of ten of "Your Hands" is higher than each of the corresponding ten "Dealer's Total" for fifty dollars ten times in the corresponding "Games" across shall win a regular prize of five hundred dollars;

    (mm) Holder of a valid winning ticket on which the total sum of the two cards in each of six of "Your Hands" is higher than each of the corresponding six "Dealer's Total" for twenty-five dollars once, seventy-five dollars once and one hundred dollars four times in the corresponding "Games" across shall win a regular prize of five hundred dollars;

    (nn) Holder of a valid winning ticket on which the total sum of the two cards in each of seven of "Your Hands" is higher than the total sum of the two cards in each of the corresponding seven "Dealer's Total" for fifty dollars four times and one hundred dollars three times in the corresponding "Games" shall win a regular prize of five hundred dollars;

    (oo) Holder of a valid winning ticket on which the total sum of the two cards in each of eleven of "Your Hands" is higher than each of the corresponding eleven "Dealer's Total" for twenty-five dollars eight times and one hundred dollars three times in the corresponding "Games" across shall win a regular prize of five hundred dollars;

    (pp) Holder of a valid winning ticket on which the total sum of the two cards in each of twelve of "Your Hands" is higher than each of the corresponding twelve "Dealer's Total" for twenty-five dollars eight times and seventy-five dollars four times in the corresponding "Games" across shall win a regular prize of five hundred dollars;

    (qq) Holder of a valid winning ticket on which the total sum of the two cards in one of "Your Hands" is higher than the corresponding "Dealer's Total" and a "TPD" symbol is revealed for one thousand dollars in the corresponding "Game" across shall win a regular prize award of one thousand dollars, and, upon the filing of a valid claim at an Ohio lottery commission office, shall automatically be entered into the Top Prize Drawing ("TPD") to win two hundred thousand dollars;

    (rr) Holder of a valid winning ticket on which the total sum of the two cards in one of "Your Hands" is higher than the corresponding "Dealer's Total" for five thousand dollars once in the corresponding "Game" across shall win a regular prize of five thousand dollars;

    (ss) Holder of a valid winning ticket on which the total sum of the two cards in each of ten of "Your Hands" is higher than each of the corresponding ten "Dealer's Total" for five hundred dollars ten times in the corresponding "Games" across shall win a regular prize of five thousand dollars;

    (tt) Holder of a valid winning ticket on which the total sum of the two cards in one of "Your Hands" is higher than the corresponding "Dealer's Total" for twenty thousand dollars once in the corresponding "Games" across shall win a regular prize of twenty thousand dollars;

    (uu) Holder of a valid winning ticket on which the total sum of the two cards in each of ten of "Your Hands" is higher than each of the corresponding ten "Dealer's Total" for twenty thousand dollars ten times in the corresponding "Games" across shall win a regular prize of two hundred thousand dollars; and

    (vv) Holder of a valid winning ticket on which the total sum of the two cards in one of "Your Hands" is higher than the corresponding "Dealer's Total" for two hundred thousand dollars once in the corresponding "Game" across shall win a regular prize of two hundred thousand dollars.

    (E)   Number of prize awards. The number of prize awards in any sales cycle of game rule number six hundred ten will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:

    (1)   Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2)    Mathematical reasoning indicates that the number of winning tickets sold per six million tickets sold should be as follows:

    (a)       Two  tickets  winning  two  hundred  thousand  dollars  once  in  the

    corresponding "Game" to win two hundred thousand dollars;

    (b)   One ticket winning twenty thousand dollars ten times in the corresponding "Games" to win two hundred thousand dollars;

    (c)    Two tickets winning twenty thousand dollars once in the corresponding "Game" to win twenty thousand dollars;

    (d)  Seven tickets winning five hundred dollars ten times in the corresponding "Games" to win five thousand dollars; and

    (e)    Three tickets winning five thousand dollars once in the corresponding "Game" to win five thousand dollars.

    (3)   Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:

    (a)    One ticket winning one thousand dollars by revealing the "TPD" prize symbol in the corresponding "Game," and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing to win two hundred thousand dollars;

    (b)    Three tickets winning twenty-five dollars eight times and seventy-five dollars four times in the corresponding "Games" to win five hundred dollars;

    (c)    Three tickets winning twenty five dollars eight times and one hundred dollars three times in the corresponding "Games" to win five hundred dollars;

    (d)    Three tickets winning fifty dollars four times and one hundred dollars three times in the corresponding "Games" to win five hundred dollars;

    (e)   Three tickets winning twenty-five dollars once, seventy five dollars once and one hundred dollars four times in the corresponding "Games" to win five hundred dollars;

    (f)   Three tickets winning fifty dollars ten times in the corresponding "Games" to win five hundred dollars;

    (g)   Three tickets winning one hundred dollars five times in the corresponding "Games" to win five hundred dollars;

    (h)     Three tickets winning five hundred dollars once in the corresponding "Game" to win five hundred dollars;

    (i)   Twenty tickets winning ten dollars two times and twenty dollars four times in the corresponding "Games" win one hundred dollars;

    (j)    Twenty tickets winning twenty-five dollars once and seventy-five dollars once in the corresponding "Games" to win one hundred dollars;

    (k)   Fifty tickets winning twenty-five dollars four times in the corresponding "Games" to win one hundred dollars;

    (l)    Twenty tickets winning five dollars six times, ten dollars five times and twenty dollars once in the corresponding "Games" to win one hundred dollars;

    (m)     Twenty tickets winning fifty dollars two times in the corresponding "Games" to win one hundred dollars;

    (n)    Twenty tickets winning twenty dollars five times in the corresponding "Games" to win one hundred dollars;

    (o)      Twenty tickets winning ten dollars ten times in the corresponding "Games" to win one hundred dollars;

    (p)    Twenty tickets winning one hundred dollars once in the corresponding "Game" to win one hundred dollars;

    (q)   Two hundred tickets winning five dollars eleven times and twenty dollars once in the corresponding "Games" to win seventy-five dollars;

    (r)        Two hundred tickets winning seventy-five dollars once in the corresponding "Game" to win seventy-five dollars;

    (s)     Two hundred tickets winning five dollars five times and twenty-five dollars once in the corresponding "Games" to win fifty dollars;

    (t)      Two  hundred  tickets  winning  twenty-five  dollars  two  times  in  the corresponding "Games" to win fifty dollars;

    (u)    Two hundred tickets winning five dollars six times and ten dollars two times in the corresponding "Games" to win fifty dollars;

    (v)   Five hundred tickets winning five dollars ten times in the corresponding "Games" to win fifty dollars;

    (w)    Three hundred tickets winning five dollars eight times and ten dollars once in the corresponding "Games" to win fifty dollars;

    (x)   Three hundred tickets winning ten dollars five times in the corresponding "Games" to win fifty dollars;

    (y)    Three hundred tickets winning fifty dollars once in the corresponding "Game" to win fifty dollars;

    (z)    One thousand tickets winning two dollars eleven times and three dollars once in the corresponding "Games" to win twenty-five dollars;

    (aa)    Two   thousand   tickets     winning    five   dollars    five    times     in    the corresponding "Games" to win twenty-five dollars;

    (bb)   One   thousand   tickets   winning   twenty-five   dollars   once   in   the corresponding "Game" to win twenty-five dollars;

    (cc) One thousand tickets winning two dollars four times and three dollars four times in the corresponding "Games" to win twenty dollars;

    (dd) Four thousand tickets winning one dollar ten times and five dollars two times in the corresponding "Games" to win twenty dollars;

    (ee) One thousand tickets winning five dollars two times and ten dollars once in the corresponding "Games" to win twenty dollars;

    (ff) One thousand tickets winning two dollars ten times in the corresponding "Games" to win twenty dollars;

    (gg) One thousand tickets winning ten dollars two times in the corresponding

    "Games" to win twenty dollars;

    (hh)   One   thousand   tickets   winning   five   dollars   four   times   in   the corresponding "Games" to win twenty dollars;

    (ii) One thousand tickets winning twenty dollars once in the corresponding "Game" to win twenty dollars;

    (jj) Two thousand tickets winning two dollars once, three dollars once and five dollars once in the corresponding "Games" to win ten dollars;

    (kk) One thousand tickets winning two dollars five times in the corresponding "Games" to win ten dollars;

    (ll) One thousand tickets winning five dollars two times in the corresponding "Games" to win ten dollars;

    (mm) Two thousand tickets winning one dollar ten times in the corresponding "Games" to win ten dollars;

    (nn) Two thousand tickets winning ten dollars once in the corresponding "Game" to win ten dollars;

    (oo) Eight thousand tickets winning two dollars once and three dollars once in the corresponding "Games" to win five dollars;

    (pp)    Eight     thousand   tickets     winning    one    dollar    five    times     in    the corresponding "Games" to win five dollars; and

    (qq) Eight thousand tickets winning five dollars once in the corresponding "Game" to win five dollars.

    (F)   Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G)  Frequency of prize drawings.

    (1)    Random imprinting of prize awards on all tickets issued in game rule number six hundred ten shall be accomplished in a manner which complies with the commission's rules and procedures.

    (2)    When a ticket issued in game rule number six hundred ten is sold or deemed sold in accordance with this rule and the covering material over any of the card values, prize values and play symbols has been removed, the holder shall be deemed to have drawn the card values, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number six hundred ten in which the ticket was sold.

    (3)    The Top Prize Drawing to award one grand prize of two hundred thousand dollars shall take place in accordance with rules and procedures established and approved by the director, and specifically, rule 3770:1-6-05 of the Administrative Code governing "Prize drawings" and rule 3770:1-6-06 of the Administrative Code governing "Special lottery drawings." Such drawings shall be held on dates determined and announced by the director, however, the earliest Top Prize Drawing date shall be one hundred eighty days from the game close date or when all tickets winning a prize value corresponding with a "TPD" symbol have been claimed, whichever is earlier.

    (H)    Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules, as well as procedures for entry into the Top Prize Drawings described in Section (G)(3) of this Rule. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I)  Validity of tickets.

    (1)   A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2)   In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number six hundred ten void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut,

    defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J)   Director's conduct of game rule number six hundred ten.

    (1)     The director shall conduct game rule number six hundred ten in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number six hundred ten. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
