    OHIO DEPARTMENT OF JOB AND FAMILY SERVICES

    Pursuant to section 4141.13 and Chapter 119. of the Ohio Revised Code, the director of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the amendment of the rules as identified below and of a public hearing thereon. The rules below are proposed to be amended as a result of the five year review process.

     

    OAC Rule 4141-9-09 entitled "Valuation of meals and lodging." This rule explains when there is a written agreement between an employer and employee that sets a cash value for remuneration for meals and/or lodging then the amount they have agreed to will be deemed by the Agency to be the cash value of such meals and or lodging. When there isn't a written agreement the Agency will set the value for remuneration for breakfast at seven dollars, for lunch at eight dollars, for dinner at fifteen dollars, and for lodging per day at sixty dollars. This rule doesn't apply to individuals performing services as a domestic or agricultural worker. The value of meals and lodging that are not considered remuneration is covered by rule 4141-9-04 of the Administrative Code. The rule has technical/grammatical changes for clarification purposes. The rule is being amended to change the promulgated statute to 119.03 pursuant to recent legislative changes.

     

    OAC Rule 4141-15-04 entitled "Assignment of average contribution rate for employers engaged in the construction industry." This rule explains when the Agency assigns an average contribution rate for construction industry employers, pursuant to Revised Code section 4141.25(A)(1), the rate assigned will be as reflected in the Agency's most current labor market information report. The rate will be rounded to the nearest tenth of one per cent the process of assigning average contribution rates are assigned to employers in the construction industry. The rule has technical/grammatical changes for clarification purposes. The rule is being amended to change the promulgated statute to 119.03 pursuant to recent legislative changes.

     

    OAC Rule 4141-27-09 entitled "Requests for redetermination and appeal." This rule explains that pursuant to Revised Code section 4141.281, any interested party notified of a determination of an application for unemployment benefit rights or a claim for unemployment benefits may file an appeal within 21 calendar days of when the determination was sent. The Agency will either: (1) reply to the appeal with an appealable redetermination which voids the original determination or (2) transfer the

     

     

     

     

     

    appeal request to the Unemployment Compensation Review Commission (UCRC) along with all the pertinent information. An appeal of the Agency's appealable redetermination would be directly handled by the UCRC. The rule has technical/grammatical changes for clarification purposes. The rule is being amended to change the promulgated statute to

    119.03 pursuant to recent legislative changes.

    OAC Rule 4141-27-10 entitled "Timeliness of appeals." This rule explains that pursuant to Revised Code section 4141.281, an appeal is considered timely filed if it is filed within 21 calendar days of the date the Agency's determination or redetermination is sent to an interested party. The rule has technical/grammatical changes for clarification purposes.

    The rule is being amended to change the promulgated statute to 119.03 pursuant to recent legislative changes.

A public hearing on the proposed rule(s) will be held at the date, time, and location listed at the top of this notice. Either written or oral testimony will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
