    Pursuant to sections 5162.03, 5164.02, 5166.02, and Chapter 119. of the Ohio Revised Code, the director of the Department of Medicaid gives notice of the department's intent to consider the rescission of the rules as identified below and of a public hearing thereon.

     

    OAC Rule 5160-50-02, Transitions Carve-Out Waiver Program: Eligibility and Enrollment, is being proposed for rescission. This rule sets forth the eligibility and enrollment criteria for the Transitions Carve-Out Waiver that was previously administered by the Ohio Department of Medicaid. It is being rescinded as the Transitions Carve-Out Waiver was terminated on June 30, 2015.

     

    OAC Rule 5160-50-04, Transitions Carve-Out Waiver: Definitions of the Covered Services and Provider Requirements and Specifications, is being proposed for rescission. This rule sets forth the service specifications and provider requirements for the services available through the Transitions Carve-Out Waiver that was previously administered by the Ohio Department of Medicaid. It is being rescinded as the Transitions Carve-Out Waiver was terminated on June 30, 2015.

     

    OAC Rule 5160-50-04.1, Transitions Carve-Out Waiver Program: Home Care Attendant Services, is being proposed for rescission. This rule sets forth the requirements a home care attendant must meet in order to provide home care attendant services, as well as the requirements the attendant must follow when providing services to an individual enrolled on the Transitions Carve-Out Waiver that was previously administered by the Ohio Department of Medicaid. It is being rescinded as the Transitions Carve-Out Waiver was terminated on June 30, 2015.

     

    OAC Rule 5160-50-06, Transitions Carve-Out Waiver Program: Reimbursement Rates and Billing Procedures, is being proposed for rescission. This rule sets forth the reimbursement rates and billing procedures for services that were available on the Transitions Carve-Out Waiver that was previously administered by the Ohio Department of Medicaid. It is being rescinded as the Transitions Carve-Out Waiver was terminated on June 30, 2015.

     

     

     

     

     

     

     

     

    OAC Rule 5160-50-06.1, Transitions Carve-Out Waiver Program: Home Care Attendant Services Reimbursement Rates and Billing Procedures, is being proposed for rescission. This rule sets forth the rate setting methodology and reimbursement rates for the home care attendant service that was available on the Transitions Carve-Out Waiver previously administered by the Ohio Department of Medicaid. It is being rescinded as the Transitions Carve-Out Waiver was terminated on June 30, 2015.

    A copy of each of the proposed rules is available at the address listed below and without charge, to any person affected by the rules and at the county department of job and family services. The proposed rules are also available on the internet at http://www.registerofohio.state.oh.us/. A public hearing on the proposed rules will be held at the date, time and location listed at the top of this notice. Either written or oral testimony will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
