NOTICE OF PUBLIC HEARING

 

The Ohio Bureau of Workers' Compensation will hold a public hearing on Tuesday, December 30, 2008, at 10:00 a.m., in Room D, 3rd Floor, 30 West Spring Street, Columbus, Ohio 43215, to consider the following:

 

Amendment of the following rules:

 

4123-3-08  Preparation and filing of applications for compensation and/or benefits. 4123-3-09  Procedures in the processing of applications for benefits.

4123-3-15  Claim procedures subsequent to allowance. 4123-3-16  Motions.

                                      Briefs.

                                      Appellate procedure. 4123-3-22  Inspection of claim files. 4123-3-24  Fee controversies.

                                      Informing the claimant of the right to representation.

                                      Procedures to inform claimant on request as to the status of his [or her] claim and of any action necessary to maintain the claim.

                                      Disabled workers' relief fund: claimant's payments. 4123-3-32  Temporary total examinations.

                                      Employer handicap reimbursement.

                                      Immediate allowance and payment of medical bills in claims

 

Rescission of the following rules:

 

4123-3-05  Applications for the payment of medical expenses only. 4123-3-12  Suspension of the processing of claims.

4123-3-21  Change of address.

4123-3-25  Application for change of occupation allowance.

 

Adoption of the following rule:

BWC reviewed these rules under the five-year rule review requirement of R.C. 119.032. The rules describe claim procedures in the Ohio workers' compensation system. BWC updated the rules to reflect current BWC procedures, changes in terminology, and statutory and rule changes.
