    5101:4-6-15                 Food stamps: Determining determining eligibility of households with other non-AGnon-assistance (non-AG) members.

     

     

     

    (A)  Treatment of income and resources of other non-AG members

     

    For all non-AG members who are not specifically mentioned in rule 5101:4-6-13 of the Administrative Code (such as an individual who failed to complete the appraisal process, a roomer, live-in attendant, boarder, SSI supplemental security income (SSI) recipient receiving benefits through a cashout system, or an ineligible student), the income and resources of such individuals shall not be considered available to the AG with whom the individual resides. Cash payments from the non-AG member to the AG will be considered income under the normal income standards specified in rule 5101:4-4-19 of the Administrative Code, unless the non-AG member is making vendor payments. Vendor payments shall be excluded as income. If the AG shares deductible expenses with the non-AG member, only the amount actually paid or contributed by the AG shall be deducted as an AG expense. If the payments or contributions cannot be differentiated, the expenses shall be prorated evenly among persons actually paying or contributing to the expense and only the AG's pro rata share is deducted.

     

    (B)  Earned income of AG member and non-AG member are combined

     

    When the earned income of one or more AG members and the earned income of a non-AG member are combined into one wage, the income of the AG members shall be determined as follows:

     

    (1)   If the AG member's share can be identified, the county agency shall count that portion as earned income, ; or,

     

    (2)   If the AG member's share cannot be identified, the county agency shall prorate the earned income among all those whom it was intended to cover and count that prorated portion to the AG.
