    Public Notice

The Department of Agriculture, State of Ohio, will hold a public hearing for the purpose of accepting testimony on the proposed amendment of administrative rules 901-19-07 Quality assurance and, 901-19-38 False, deceptive or unacceptable practices.

These rules relate to prohibited practices and drug residues in show animals at the State and county fairs.

The proposed amendment of rule 901-19-07 will allow exhibitors to demonstrate their knowledge of the steps necessary to prevent drug residues in livestock by taking and passing an examination rather than attending a course on quality assurance. The proposed amendment of rule 901-19-38 removes the prohibition of accessory reproductive tissue in exhibition animals that have been neutered.

Presence of the residual tissue has not been found to cause any changes in confirmation or appearance inconsistent with neutering.

The hearing will be held Tuesday, December 30, 2003, at 10:30 a.m., in Hearing Room 133 (Seminar 'B') Bromfield Administration Building, Ohio Department of Agriculture, 8995 East Main Street, Reynoldsburg, Ohio 43068-3399.

The hearing will be conducted in accordance with Chapter 119 of the Revised Code. Any person affected by the proposed amendments to these rules may appear and be heard in person, by his attorney, or both, may present his position, arguments, or contentions, orally or in writing, offer and examine witnesses, and present evidence tending to show that the proposed amendments, if adopted or effectuated, will be unreasonable or unlawful.
