    PUBLIC NOTICE

     

    The Ohio Department of Agriculture, State of Ohio, will hold a public hearing to accept testimony on the proposed changes to administrative rules 901:10-1-01 through 901:10-6-06.

     

    These rules relate to the regulating of Ohio's large livestock and poultry farms. Changes were needed to the rules in order to comply with new rules published by the U.S. Environmental Protection Agency, changes to Ohio law through H.B. 152, and corrections to the rules discovered during the program's first year of regulating the state's large-scale livestock and poultry farms. These rules regulate construction standards for all new and existing large livestock and poultry farms; all aspects of manure storage, handling, transportation, and land- application by these farms; the farms' insect and rodent control plans; and compliance and enforcement procedures. These rules also regulate requirements for facilities subject to the Federal Water Pollution Control Act with rules governing National Pollutant Discharge and Elimination System permits for livestock and poultry farms.

     

    The hearing will be held on Monday, Jan. 5 at 10:00 a.m. in the Auditorium of the Bromfield Administration Building, Ohio Department of Agriculture, 8995 East Main Street, Reynoldsburg, Ohio 43068-3399.

     

    The hearing will be conducted in accordance with Chapter 119 of the Revised Code. Any person affected by the proposed new rules may appear and be heard in person, by his or her attorney, or both, may present his or her position, arguments, or contentions, orally or in writing, and present evidence tending to show that the proposed rule, if adopted or effectuated, will be unreasonable or unlawful.
