    Public Notice                           Request for Comment on Draft Rules

     

    Notice is hereby given that the Ohio Environmental Protection Agency, Division of Emergency and Remedial Response (DERR), under the authority of Section 3746.04 of the Ohio Revised Code and in accordance with Chapter 119, proposes to modify the following rules of the Ohio Administrative Code:

     

    OAC 3745-300-01 - Definitions.

    OAC 3745-300-02 - Eligibility for participation in the voluntary action program.

    OAC 3745-300-03 - Voluntary action program fees.

    OAC 3745-300-04 - Certified Laboratories.

    OAC 3745-300-05 - Certified professionals.

    OAC 3745-300-06 - Phase I property assessments for the voluntary action program.

    OAC 3745-300-07 - Phase II property assessments.

    OAC 3745-300-08 - Generic numerical standards.

    OAC 3745-300-09 - Property-specific risk assessment procedures.

    OAC 3745-300-10 - Ground water classification and response requirements.

    OAC 3745-300-11 - Remediation. (old OAC 3745-300-15)

    OAC 3745-300-12 - Variances from generic numerical standards or property-specific risk assessment procedures.

    OAC 3745-300-13 - Content and scope of no further action letters.

    OAC 3745-300-14 - Audits of no further action letters.

    OAC 3745-300-15 - Remediation. (rescinded and renumbered as 3745-300-11)

     

    These rules address the Voluntary Action Program (VAP) regulations.   The rules are being updated as a part of the latest five-year rule review.

     

    The public comment period will run until December 30, 2008. A public hearing on this proposed rule making will be held to consider public comments in accordance with Section 119.03 of the Ohio Revised Code. This hearing will be held in Conference Room A at the Lazarus Government Center, 50 West Town Street, Columbus, Ohio, on December 30 at 10:30 am. All visitors to Ohio EPA must register at the Security desk in the lobby upon arrival. Please bring photo identification (such as a valid driver's license). For security reasons, visitors are required to wear their badge at all times while in the building. Please arrive early to complete these procedures.

     

    Written testimony should be sent to the attention of Ildi Pallós at DERR/VAP, P.O. Box 1049, Columbus Ohio 43216-1049. Written comments may also be submitted to the Hearing Officer at the public hearing. Written testimony will receive the same consideration as oral testimony. All testimony received at the hearing or by close of business on December 30 will be considered by Ohio EPA prior to final action on this

     

     

     

     

     

     

     

    rulemaking proposal. Written comments submitted after this date may be considered as time and circumstances permit.
