    NOTIFICATION OF PUBLIC HEARING

    Notice of hearing

    to amend Rules 4501-47-03 and 4501-47-05

    of the Ohio Administrative Code in accordance with Chapter 119. of the Ohio Revised Code

     

    Notice is hereby given that a hearing will be held by the Ohio Department of Public Safety for the purpose of considering the proposed amendment of the above-listed administrative rules.

     

    As authorized in Section 4506.09 of the Ohio Revised Code, the Department of Public Safety proposes to amend Rules 4501-47-03 and 4501-47-05 of the Ohio Administrative Code. These rules provide requirements for the operation of commercial driver's license (CDL) third-party testing facilities and examiners.

    Proposed changes include provision to clarify that current third-party examiners for are to maintain the same standards as required of new applicants and are to correctly administer and score each of the CDL skills tests, and to clarify that unlicensed driver training schools are prevented from providing any CDL testing and that this prohibition applies to third-party tester owners, employees, facility managers, examiners, or any entity affiliated with such person or the third-party tester.

     

    A public hearing on the proposed rules will be held Monday, January 7, 2008 at 10:00 a.m. in room 109 (first floor) of the Charles D. Shipley Building, Ohio Department of Public Safety, 1970 West Broad Street, Columbus, Ohio.

     

    Either written or oral testimony will be received at the hearing.  Additionally, written comments received at the address below before the hearing will be treated as testimony.
