    NOTICE OF PUBLIC HEARING ON ADMINISTRATIVE RULES

     

     

    DATE: Monday, December 9, 2013

    TIME: 10:00 a.m.

    LOCATION: 17th Floor Human Resources Training Room 180 East Broad Street, Columbus, OH 43215

     

     

    Pursuant to Chapter 119 of the Ohio Revised Code, the Ohio Secretary of State gives notice of a public hearing regarding the proposed amendment or rescission of the following administrative rules:

     

     

    111-1-06          Computation of Time-The rule provides direction for calculating time for requirements under ORC Chapter 3517.  The proposed amendment corrects statutory citations.

    111-4-03          FSL Corporate/Labor PAC Must File Statement of Organization; Ohio Corporate/Labor PAC Must Disclose Sponsoring Corporation-The rule explains filing requirements for a statement of organization of political action committees.  The proposed amendment corrects statutory citations.

    111-10-1                   Scope of Rules-The rule introduces designated agencies' voter registration

    responsibilities.  The proposed amendment corrects statutory citations.

     

    111-10-2                   Submission of Plan-The rule requires designated agencies to submit a voter registration plan.  The proposed amendment corrects statutory citations.

    111-10-3                   Registration Opportunities-The rule gives guidelines for designated agencies' voter registration plans.  The proposed amendment corrects statutory citations.

    111-10-4                   Employees-The rule outlines responsibilities of employees providing registration assistance.  The proposed amendment corrects statutory citations.

    111-10-5                   Transmittal of Forms-The rule presents instruction for the transmittal of each designated agency's registration forms to the boards of elections. The proposed amendment corrects statutory citations.

     

     

     

     

     

     

     

     

    111-10-6                   Registration and Transmittal Forms to be Prescribed-The rule explains that the Secretary of State prescribes registration and transmittal forms for the designated agencies.  The proposed amendment corrects statutory citations.

    111-10-7                   Voter Registration-BMV-The rule details the responsibilities of the Bureau of Motor Vehicles as a designated agency for voter registration purposes.  The proposed amendment corrects statutory citations.

    111-12-1                   Scope of Rules-These rules requiring any person who receives compensation for registering voters to complete a training program are proposed for rescission pursuant to the federal court decision in Project Vote v. Blackwell, 455 F. Supp.2d 694 (N. D. Ohio 2006).

Blackwell, 455 F. Supp.2d 694 (N. D. Ohio 2006).

    111-12-4                   Online Training Program for Non-Exempt Persons Receiving Compensation to Register Others to Vote-These rules requiring any person who receives compensation for registering voters to complete a training program are proposed for rescission pursuant to the federal court decision in Project Vote v. Blackwell, 455 F. Supp.2d 694 (N. D. Ohio 2006).

    111-12-5                   Amendments and Changes to an Individual's Registration Information- These rules requiring any person who receives compensation for registering voters to complete a training program are proposed for rescission pursuant to the federal court decision in Project Vote v. Blackwell, 455 F. Supp.2d 694 (N. D. Ohio 2006).

    111-12-6                   Registration Renewal-These rules requiring any person who receives compensation for registering voters to complete a training program are proposed for rescission pursuant to the federal court decision in Project Vote v. Blackwell, 455 F. Supp.2d 694 (N. D. Ohio 2006).

    111:3-2-02      Application Fee-The rule sets an application fee for the Board of Voting Machine Examiners.  The proposed amendment corrects the fee amount to match that established in statute.

    111:3-2-03      Escrow Procedures-The rule requires that computer software developers for voting machines place documentation in escrow.  The proposed amendments will update the name of the federal elections commission to the U.S. Election Assistance Commission.

    111:3-3-01      Certification; Mandatory Requirements-The rule presents requirements for certification of voting machines. The proposed amendment corrects statutory citations.

    111:3-3-03      Bond-The rule requires a surety bond for voting equipment. The proposed amendment aligns rule language with statutory language and corrects statutory citations.
