    NOTICE OF PUBLIC HEARINGS

     

    In accordance with Chapter 119 of the Revised Code, the Public Health Council (Council) will conduct four public hearings beginning at 10:00 a.m. on January 18, 2007 in the 8th Floor Conference Room of the Ohio Department of Health, 246 N. High Street, Columbus Ohio:

     

    HEARING #1. By authority of recent statutory revisions to Revised Code 3712.03, Council is proposing to amend Ohio Administrative Code (O.A.C.) rule 3701-19-05 pertaining to hospice inspections. The new statutory language authorizes Council to adopt and amend rules establishing inspection fees not to exceed $1,750.00 per inspection for hospice care programs. Further, Council proposes to set a $3,600.00 cap on the amount of fees that can be charged to a hospice care program per year.

     

    HEARING #2. By authority of R.C. 3729.02, Council proposes to rescind O.A.C. rules 3701-25-51, 3701-25-52, 3701-25-52.1, 3701-25-54, 3701-25-55 to 3701-25-72, and

    3701-25-74; and to replace them with new rules 3701-26-01 to 3701-26-04, and 3701- 26-07 to 3701-26-24. Both the Chapter 3701-25 rules proposed for rescission and the new Chapter 3701-26 rules pertain to recreational vehicle parks, recreation camps, combined park-camps, and temporary park camps. During the review of Chapter 3701- 25 rules, the Department of Health (ODH) elected to narrow the chapter's focus by moving the rules dealing with the subjects mentioned above, with some changes, to a new Chapter 3701-26. The proposed changes include some new definitions, expanded requirements applicable to park-camp owners, and clarifying language to ensure the health and safety of the camping public.

     

    HEARING #3. By authority of R.C. 3748.04, Council proposes to amend rule 3701:1-40- 16 of the Administrative Code, pertaining to terms and conditions of licenses to receive and possess byproduct or accelerator-produced material. The proposed change requires portable gauge users to use a minimum of two independent physical controls to secure portable gauges from unauthorized removal. The intent of the proposed change is to enhance the security of these gauges, and to make the rule consistent with federal regulations.

     

    HEARING #4. By authority of R.C. 3748.04, Council is proposing to amend O.A.C. rules 3701:1-48-01 to 3701:1-48-06, 3701:1-48-08, 3748:1-09, 3701:1-48-13, 3701:1-48-

    14, 3701:1-48-16, 3701:1-48-17, 3701:1-48-19, 3701:1-48-22 to 3701:1-48-24. These

    rules have been reviewed pursuant to R.C. 119.032 (five-year review), and the proposed changes are chiefly editorial in nature. Two changes of note are: 1) the proposed rescission of Appendix A in rule 3701:1-48-05, with new language inserted in text to direct affected parties to the appropriate industry standards; and 2) in rule 3701:1-48- 08, the specification of acceptable calibration standards for linear scale, logarithmic scale, and digital instruments used in radiation surveys.

     

    At the hearings, persons affected by the proposed actions may appear and be heard in person, by an attorney, or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful.
