    3745-7-01                    Definitions.

     

     

    As used in this chapter:

     

    (A)  "Board" means the advisory board of examiners for certification as established in rule 3745-7-10 of the Administrative Code.

     

    (B)      "Certified operator" means an individual with currently valid certification in accordance with this chapter.

     

    (C)  "Contact hours" means time spent in approved formal or informal training.

     

    (D)   "Director" means the director of the environmental protection agency or his or her duly authorized representative.

     

    (E)     "Full-time contract operations" means the owner or operator has entered into a contract placing the responsibility for overall operation of a public water system, a wastewater works, a water distribution system, or a wastewater collection system, including but not limited to all maintenance and testing, with the contractor.

     

    (F)   "Full-time employee" means an employee of the owner or operator of a public water system, a wastewater works, a water distribution system, or a wastewater collection system who receives a regular salary, including whatever benefits the owner or operator provides, in exchange for work performed for the employer, where at least part of this work involves duties associated with the operation and maintenance of the public water system, wastewater works, water distribution system, or wastewater collection system. Full-time contract operations meet this definition.

     

    (G)    "Operating experience" means actual time in performing the day to day activities necessary to ensure the proper performance of the equipment, processes, or laboratory analyses incorporated as an integral part of a public water system, a wastewater works, a water distribution system, or a wastewater collection system, except that time performing laboratory analyses may only qualify if the analyses are conducted in the owner's laboratory.

     

    (H)   "Operator in responsible charge" means the individual identified as being the on-site manager of technical operations and maintenance of:

     

    (1)  A public water system, or

     

    (2)    One treatment facility, if a public water system has more than one treatment

     

     

     

    facility, or

    (3)   A wastewater works, or

    (4)     One treatment facility, if a wastewater works has more than one treatment facility.

    (I) "Person" means any individual; corporation; company; association; partnership; the state; or any political subdivision, agency, institution, or instrumentality thereof; any interstate body created by compact; or the federal government or any department, agency, or instrumentality thereof.

    (J)       "Population equivalent" means the calculated population being served by a wastewater works based on the amount and strength of the wastewater being received at the wastewater works. Population equivalents are computed to be 0.167 pounds of five-day biochemical oxygen demand or 0.20 pounds of suspended solids per person per day.

    (K)    "Public water system" means any water system for the provision to the public of piped water for human consumption, if such a system has at least fifteen service connections or regularly serves an average of twenty-five individuals daily at least sixty days out of the year, unless the system meets all the following conditions:

    (1)     Consists  only  of  distribution  and  storage  facilities  and  does  not  have  any collection and/or treatment facilities;

    (2)    Obtains all of its water from but is not owned or operated by a public water system;

    (3)   Does not sell water to any person; and

    (4)   Is not a carrier which conveys passengers in interstate commerce.

    (L)     "Wastewater" means water containing sewage, industrial waste, or other wastes which may cause pollution, as defined in section 6111.01 of the Revised Code.

    (M)   "Wastewater works" means any facility for collecting, conveying, pumping, treating, and discharging wastewater, including sewerage systems and treatment works as those terms are defined in section 6111.01 of the Revised Code.
