STATE OF OHIO DEPARTMENT OF NATURAL RESOURCES

 

NOTICE OF INTENTION TO AMEND AND HOLD A PUBLIC HEARING ON STATE OF OHIO WATERCRAFT RULES

 

 

The Chief of the Division of Watercraft, pursuant to Section 1547.52 of the Ohio Revised Code, hereby gives notice of his intention to amend the following rules:

 

1501:47-1-02     Registration certificate

1501:47-1-04     Transferred watercraft

1501:47-1-07.1 Contingent registration

1501:47-1-12     Buoys

1501:47-1-18     Boating education course fees

1501:47-7-09     On the waters of Nettle lake: Williams county, Ohio 1501:47-7-20     Little Miami river, Warren county

 

and to rescind the following rules:

 

1501:47-3-04     Snorkel and scuba diving prohibited, exceptions 1501:47-3-06         Permits

 

Administrative Rule 1501:47-1-02 is being amended to correct the reference to a U.S. Citizen and Immigration document number and to clarify that a registration certificate is void if the information contained in the certificate is no longer correct. Administrative Rule 1501:47-1-07.1 is being amended to extend the period of time that a contingent registration is valid when issued in response to a HIN application. Administrative Rules 1501:47-1-04, 1501:47-1-12, and 1501:47-1-18 are being amended to provide consistency in terminology. Administrative Rule 1501:47-7-09 is being amended to make the speed limits consistent and to expand water skiing restrictions to include other towed watersports activities. Administrative Rule 1501:47-7-20 is being amended to make operating restrictions on the Little Miami river in Warren county consistent for all recreational vessels. Administrative Rules 1501:47-3-04 and 1501:47-3-06 are being rescinded because they are not directly related to the statutory mission of the Division of Watercraft.

 

A public hearing on the proposed amendments to these rules will be held at 10:00 am on Thursday, January 5, 2012 at the Division of Watercraft Headquarters, 2045 Morse Road, Building A in Columbus, Ohio. At the public hearing, any person affected by any rule amendment may appear and be heard in person, or by an attorney, or both, and may present testimony, orally or in writing, offer and examine witnesses, and present evidence tending to show that these rules, if amended or rescinded, will be unreasonable or unlawful.
