    PUBLIC HEARING NOTICE

    OHIO DEPARTMENT OF JOB AND FAMILY SERVICES

     

    DATE:           January 05, 2012

    TIME:              10:00 a.m.

    LOCATION: Room 3110 B, Rhodes State Office Tower, 30 East Broad St., Columbus, Ohio 43215

     

    Pursuant to section 3125.25 and Chapter 119. of the Ohio Revised Code, the director of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the amendment or rescission of the rules as identified below and of a public hearing thereon.

     

    The following Ohio Administrative Code (OAC) rules are being proposed for amendment as a result of a review conducted in accordance with section 119.032 of the Revised Code (ORC), which requires five-year reviews of all state agency rules:

     

    ·         Rule 5101:12-50-50, "Judicial enforcement actions," describes the required and discretionary judicial actions that the child support enforcement agency (CSEA) can take to enforce a child support order.  Changes from the existing rule include: revised the language for clarity in paragraphs (B) and (C), and corrected the reference in paragraph (C)(7) as the Ohio Administrative Code rule has been rescinded.

     

    ·         Rule 5101:12-50-55, "Extradition of obligors," describes the process of extraditing an obligor from another state to Ohio, and describes the process used by the governor of Ohio when a request is received from another state to extradite an obligor residing in Ohio for the purpose of enforcing a child support order. Changes from the existing rule include: corrected the reference to the Uniform Interstate Family Support Act (UIFSA) in paragraph (C).

     

    ·         Rule 5101:12-50-65, "Office of child support poster program," describes the requirements of the Office of Child Support's poster program for the purpose of enforcing a child support order. Changes from the existing rule include: replaced the term "food stamps" with "supplemental nutrition assistance program benefits (SNAP)" in paragraph (C)(1)(c).

     

     

    The following Ohio Administrative Code (OAC) rule is being proposed for rescission as a result of a review conducted in accordance with section 119.032 of the Revised Code (ORC), which requires five-year reviews of all state agency rules. The rule is being rescinded and not being replaced as it describes procedures that are no longer in effect:

     

    ·         Rule 5101:12-50-58, "Criminal enforcement of support orders using "Project Save Our Children" (PSOC)," describes procedures that a CSEA may use to enforce support orders using "Project Save Our Children" (PSOC), which is a collaborative effort between federal agencies, ODJFS, and CSEAs..

     

     

     

     

     

     

     

     

     

    Copies of the proposed rules are available, without charge, to any person affected by the rules at the address listed below. The rules are also available on the internet at  http://www.registerofohio.state.oh.us/.

    A public hearing on the proposed rules will be held at the date, time, and location listed at the top of this notice. Either written or oral testimony will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
