    PUBLIC HEARING NOTICE

    OHIO DEPARTMENT OF JOB AND FAMILY SERVICES

     

    DATE: Tuesday, January 29, 2008

    Pursuant to section 5104.011 and Chapter 119. of the Ohio Revised Code, the director of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the amendment of the rules as identified below and of a public hearing thereon.

     

    Rule 5101:2-14-04 entitled "Issuance and renewal of professional certification as a type B home provider or in-home aide" has been amended to add requirements that the CDJFS have the results of the BCII and PSCA record checks prior to certifying a provider, to allow only one certificate to be issued for an address and to clarify language. New PCSA record checks are required at recertification.

     

    Rule 5101:2-14-05 entitled "Provider qualifications for professional certification as a type B home provider or in-home aide" has been amended to update form revision dates, add the requirement for the PCSA records check, and from having any other employment during the hours of child care and clarify existing language.

     

    Rule 5101:2-14-06 entitled "Denial, revocation and withdrawal of professional certification as a type B home provider or in-home aide" has been amended to allow denial of an application or revocation of a certificate for delinquent child care copayments owed to a provider, for being unavailable for announced or unannounced inspections or if the results of the PCSA check indicate the provider may endanger the health or safety of children. The amended rule also extends to five years the restriction that a provider cannot reapply for certification after having certification revoked.

     

    Rule 5101:2-14-11 entitled "Offenses prohibiting certification as a type B professional or limited home provider or in-home aide, or as an emergency or substitute caregiver" has been amended to delete unnecessary language regarding FBI checks and add language to allow rehabilitation standards to be applied to persons with certain felony convictions and require criminal record checks to be completed every four years

     

    A copy of the proposed rules is available, without charge, to any person affected by the rules at the address listed below. The rules are also available on the internet at http://www.registerofohio.state.oh.us/. A public hearing on the proposed rules will be held at the date, time, and location listed at the top of this notice. Either written or oral testimony will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
