    5101:12-55-26             Suspension of license to practice law.

     

     

     

    (A)A child support enforcement agency (CSEA) may choose as an enforcement technique to refer a justice, judge, or attorney for suspension of a license to practice law.

     

    (B)In accordance with section 5 of Rule V of the Ohio Rules of Court, Rules for the Government of the Bar of Ohio, a justice, judge, or an attorney admitted to the practice of law in Ohio is subject to an interim license suspension when a final and enforceable determination has been made pursuant to Chapter 3123. of the Revised Code that the justice, judge, or attorney is in default under a child support order.

     

    (C)In accordance with section 4705.021(B) of the Revised Code, upon determination that an obligor who has been admitted to the bar by order of the supreme court is in default under a child support order pursuant to sections 3123.01 to 3123.07 of the Revised Code, the CSEA may send to the secretary of the board of commissioners on grievances and discipline of the supreme court and to either the disciplinary counsel or the president, secretary, and chairperson of each certified grievance committee:

     

    (1)A notice listing the name and social security number or other identification number of the obligor; and

     

    (2) A certified copy of the court or agency determination of default.

     

    (D)Upon receipt of a certified copy of the determination of default under a child support order, the secretary of the board of commissioners on grievances and discipline of the supreme court, in accordance with section 5 of Rule V of the Ohio Rules of Court, Rules for the Government of the Bar of Ohio, shall submit the determination to the supreme court.

     

    (E)In accordance with section 5 of Rule V of the Ohio Rules of Court, Rules for the Government of the Bar of Ohio, the supreme court may enter an order as it considers appropriate, including an order immediately suspending the justice, judge, or attorney from the practice of law pending further proceedings pursuant to the Ohio Rules of Court, Rules for the Government of the Bar of Ohio.

     

    (F) A CSEA may send a notice similar to the notice described in paragraph (E) of rule 5101:12-55-25 of the Administrative Code that is specific to the suspension of a license to practice law. If the CSEA chooses to implement such a notice, the CSEA shall describe the procedures and shall maintain a copy of the notice in the agency's procedural manual.
