    TO BE RESCINDED

     

    3301-16-01                  Good cause for school absence for learnfare participants.

     

     

     

    (A)    This rule shall apply to all learnfare participants enrolled in the Ohio learnfare program as established by the Ohio department of human services.

     

    (B)  As used in this rule:

     

    (1)   "A day of attendance" means a learnfare participant's presence in school for the entire school day, as school day is defined by the school district.

     

    (2)    "Family member" means an individual related by blood, marriage, adoption, legal assignment (foster parent).

     

    (3)   "Immediate family" means a parent, step-parent, adoptive parent, grandparents, step-grandparents, sibling, step-sibling, adoptive sibling, child or stepchildren.

     

    (C)   All learnfare participants enrolled in the Ohio learnfare program shall attend school in accordance with the learnfare program's school attendance requirement. A learnfare participant's absence from school will be excused only upon evidence of good cause. Good cause for school absence may be evidenced by any of the following:

     

    (1)   The learnfare participant is temporarily excused from school attendance by the school district;

     

    (2)    The learnfare participant is prohibited by the school district from attending school either because:

     

    (a)   The learnfare participant is serving a suspension;

     

    (b)   The learnfare participant is not attending school pending an expulsion;

     

    (c)   The learnfare participant has been expelled from school.

     

    (3)    The learnfare participant has failed to attend school for one or more of the following reasons:

     

    (a)      The  learnfare  participant  was  ill,  injured,  or  incapacitated  and  was reasonably prevented from attending school;

     

     

    (b)   The learnfare participant had a scheduled or emergency appointment for medical, dental, or vision care;

    (c)   A family member was ill and required the full-time care by the learnfare participant. The family member must live in the same house as the learnfare participant;

    (d)   Death of an immediate family member. A maximum of five consecutive school days of leave shall be allowed;

    (e)   Death of a family member outside of the immediate family, specifically, cousins, uncles, aunts, nephews and nieces. A maximum of three consecutive school days of leave shall be allowed;

    (f)    Transportation to or from the learnfare participant's school is necessary and the transportation ordinarily used is temporarily unavailable;

    (g)    Transportation to or from child care is necessary and the transportation ordinarily used was temporarily unavailable;

    (h)   The learnfare participant had a scheduled or emergency appointment at a court or the cdhs;

    (i) Other exceptional circumstances exist that reasonably prevent the learnfare participant from attending school, including any extenuating family circumstances not addressed above.
