    NOTICE OF PUBLIC RULES HEARINGS

    In accordance with Chapter 119 of the Revised Code (R.C.) the Public Health Council (PHC) will conduct three public rules hearings* at its February 2, 2012 meeting. The PHC meeting will begin at 10:00 a.m. in the 8th Floor Large Conference Room of the Ohio Department of Health, 246 N. High Street, Columbus 43215; the public hearings will commence soon thereafter.

     

    HEARING #1: By authority of R.C. Sections 3721.28, 3721.29, and 3721.30, the PHC proposes to amend Ohio Administrative Code (O.A.C.) rules 3701-18-09 and 3701-18-12. These rules pertain to Nurse Aide Training Competency and Evaluation Programs (NATCEP). Proposed changes make general formatting changes to comply with Legislative Service Commission rule drafting requirements and update the NATCEP curriculum. The proposed update to the curriculum reflects current industry practices and terminology including "person-centered care," "individual plans," and the nurse aide's role in reporting abuse and neglect.

     

    HEARING #2: Pursuant to the repeal of statutory authority to regulate Marinas in H.B. 153 of the 129th General Assembly, the PHC proposes to rescind Ohio Administrative Code rules 3701-35-01 to 3701-35-08.

     

    HEARING #3: By authority of R.C. 3721.03, the Public Health Council proposes to amend

    O.A.C. rule 3701-69-02; to adopt new and rescind current rules 3701-69-01, and 3701-69- 03 to 3701-69-09; and to adopt new rules 3701-69-10 to 3701-69-13. These rules pertain to licensing and standards for radon testing, mitigation, and laboratories. A major revision of the Chapter was undertaken to make the rules more accessible for licensees and potential licenses. To promote accessibility, current rules 3701-69-03 and 3701-69-05 are each being split into three separate rules; and documents currently only referenced in the rules are now added as appendices to new rules 3701-69-07 and 3701-69-08.

     

    At the hearings, people affected by the proposed actions may appear and be heard in  person, by an attorney, or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful.
