    NOTICE OF PUBLIC HEARING

     

    The Ohio Bureau of Workers' Compensation will hold a public hearing on Wednesday, February 8, 2012, at 1:30 p.m., in Room 1, Level 2, 30 West Spring Street, Columbus, Ohio 43215, to consider the following:

     

    Amendment of the following rules for the purposes as shown below:

     

    4123-6-37.3 Payment of ambulatory surgical center services.

     

    Pursuant to the 10th District Court of Appeals decision in Ohio Hosp. Assn. v. Ohio Bur. of Workers' Comp., Franklin App. No. 06AP-471, 2007-Ohio-1499, BWC is required to adopt changes to its methodology for the payment of ambulatory surgical center services via the O.R.C. Chapter 119 rulemaking process. BWC's ambulatory surgical center reimbursement methodology is based on Medicare's Ambulatory Surgical Center Prospective Payment System, which is updated annually. Therefore, BWC must also annually update OAC 4123-6-37.3, to keep in sync with Medicare. BWC adopts - the 2012 new CPT© and HCPCS codes and deletes all expired codes.

     

    BWC's professional provider fee schedule is composed of the following standardized billing codes: Current Procedural Terminology (CPT®) codes, Healthcare Common Procedural Coding System (HCPCS) codes and local codes. Local codes are developed and maintained by BWC; CPT codes by the American Medical Association (AMA) [and adopted by the Centers for Medicare and Medicaid Services (CMS)]; and HCPCS codes by CMS.

    All interested parties will be given an opportunity to be heard. Any interested party unable to attend the public hearing may submit written comments to the undersigned prior to the public hearing at enotification@bwc.state.oh.us.
