    4906-5-04                    Alternatives.

     

     

     

    (A)   All applications for electric generating plants other than an application for a major utility facility which is related to a coal research and development project  as defined in section 1555.01 of the Revised Code, or to a coal development project as defined in section 1551.30 of the Revised Code, submitted to the Ohio coal development office for review under division (B)(8) of section 1551.33 of the Revised Code, and gas and electric transmission facilities shall include fully developed information on two sites.

     

    (1)   Electric generating plants and associated facilities.

     

    (a)   Applications shall include fully developed information for two sites.

     

    (i)   These shall be designated as a preferred and an alternate site.

     

    (ii)     Both  sites  shall  be  actual  and  viable  alternatives  on  which  the applicant could build the proposed facility.

     

    (b)   Applications may include information on additional alternatives.

     

    (2)   Gas and electric transmission lines and associated facilities.

     

    (a)        Applications    shall    include    fully    developed   information    for                      two rights-of-way.

     

    (i)       These   shall   be   designated   as    preferred   and   an   alternate right-of-way.

     

    (ii)    Both rights-of-way shall be actual and viable alternatives on which the applicant could build the proposed facility.

     

    (iii)    Two rights-of-way shall be considered as alternatives if not more than twenty per cent of the rights-of-way are common.

     

    (b)    Applications may include information on additional alternatives, which may be either right-of-way or major equipment alternatives.

     

    (B)    For good cause shown, the board or the administrative law judge may waive the requirement of fully developed information on the alternative site designated as

     

     

    alternate.

    (C)       The information contained within the application, including information on alternatives as required by this rule, shall conform to the requirements of Chapters 4906-13 and 4906-15 of the Administrative Code, where applicable.
