4906-5-09                    Proof of notice publication of accepted, complete certificate applications.

 

 

 

(A)   The applicant shall file proof of the first public notice, together with a copy of the notice, with the board within ten fourteen days of publication.

 

(B)   The applicant shall provide proof of the second public notice to the board at least three days before the public hearing by providing a copy of the actual notice from the newspaper(s) in which the notice was published.

 

(C)   Inadvertent failure of service on, or notice to, any of the persons entitled to receive service pursuant to rule 4906-5-05 of the Administrative Code, or identified in rules 4906-5-06, 4906-5-07 and 4906-5-08 of the Administrative Code, may be cured pursuant to orders of the board or the administrative law judge, designed to afford such persons adequate notice to enable their effective participation in the proceeding. In addition, the board or the administrative law judge may, after filing, require the applicant to serve notice of the accepted, complete application or copies thereof, or both, upon such other persons, and file proof thereof, as the board or the administrative law judge considers appropriate.
