    NOTICE OF PUBLIC HEARING

    In accordance with Chapter 119 of the Revised Code (R.C.) and by authority of R.C. 3702.13 and 3702.30, the Director of the Ohio Department of Health (ODH), or his designee, will conduct a public hearing at the time and place listed above, to consider the proposal to amend O.A.C. rules 3701-83-01, 3701-83-03 to 3701-83-06, 3701-83-08 to 3701-83-13, 3701-83-15, 3701-

    83-16, 3701-83-18 to 3701-83-20, 3701-83-22 to 3701-83-23.1, 3701-83-23.3, 3701-83-23.4,

    3701-83-29, 3701-83-32, 3701-83-33, 3701-83-35, 3701-83-38, 3701-83-42, 3701-83-43,

    3701-83-45, 3701-83-50 to 3701-83-52, and 3701-83-55 to 3701-83-58; and to rescind

    current and propose new rule 3701-83-24. These rules pertain to ambulatory surgical facilities and certain freestanding health care facilities, and they are being proposed as a culmination of five year review.

     

    The proposed amendments: 1) delineate the responsibilities of the governing boards for facilites; 2) require an annual review of each facility's Quality Assurance and Performance Improvement program; 3) strengthen the emergency and disaster preparedness planning requirements for facilities; 4) allow for a patient to have a doula present for the birthing process in exempt freestanding birthing centers; and 5) make numerous grammatical, formatting, and stylistic changes throughout the rules to comply with current Legislative Service Commission rule drafting requirements.

     

    At the hearing, people affected by the proposed actions may appear and be heard in person, by an attorney or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful.
