    NOTICE OF PUBLIC RULES HEARING

    In accordance with Chapter 119. of the Revised Code (R.C.), the Director of the Department of Health is proposing changes to the following Ohio Administrative Code (O.A.C.) rules:

     

    O.A.C. Chapter 3701-83-01 to -59 - Health Care Facilities Licensure

     

    By authority of R.C. 3702.13, 3702.30, and 3702.31 and in fulfillment of five-year review (FYR) requirements, the Director proposes to amend O.A.C. rules 3701-83-01 to 3701-83-05.1, -07 to -19, -21 to -55, -57, and -58. These rules set forth the requirements for licensed Health Care Facilities ("HCF") in Ohio. These requirements include facilities, equipment, freestanding inpatient rehabilitation facilities, freestanding birthing centers, freestanding radiation therapy centers, freestanding or mobile diagnostic imaging centers, and freestanding birthing centers exempted from licensure under 3702.301 of the Ohio Revised Code.

     

    Amendments to the rules include, but are not limited to:

     

    1)      Clarifying that ambulatory surgical facilities must designate an individual trained in infection control to direct the facility's infection control program.

     

    2)      Including HCF's policies relating to Do-Not-Resuscitate (DNR) orders as one of the policies that must be discussed with patient.

     

    3)      Incorporating language consistent with other ODH rule sets relating to record keeping systems to enable the Director to ascertain personnel license, certification, and registration requirements are met.

     

    4)      Establishing in rule the notice and documentation requirements for exempt birthing centers that are already in practice in the licensure program and the exempt birthing center communities.

     

    Finally, numerous grammatical and formatting changes have been made to the rules to provide clarity of the licensure requirements and improve their ease of use for the business community.

     

    O.A.C. Rule 3701:1-37-08 - Access authorization program requirements in the Chapter pertaining to Physical Protection of Category One and Category Two Quantities of Radioactive Material

     

    By authority of R.C. 3748.04, the Director proposes to amend O.A.C. Rule 3701:1-37-08. This rule contains requirements for radioactive material licensees that possess large quantities of radioactive material to implement enhanced security requirements, including an access authorization program for individuals who have access to the radioactive material. The proposed change simply corrects a reference to another O.A.C. rule.
