    This rule is being filed to state the minimum activity/consumer records requirements that an agency must meet in order to be certified by ODADAS as an alcohol and other drug addiction prevention provider.

    7.  If the rule is an AMENDMENT, then summarize the changes and the content of the proposed rule; If the rule type is RESCISSION, NEW or NO CHANGE, then summarize the content of the rule:

    This rule describes the documentation necessary for services provided, policies

    needed regarding consumer records, and the requirement to follow federal confidentiality laws in regards to consumer records.

    This rule references Title 42 Code of Federal Regulations Part 2 which is easily attainable from the federal government website.

    It is infeasible to attach these references electronically because of the size of the documents as well as the fact that they are on an easily accessible website, and interested parties are familiear with the references and their websites.

    To correct grammatical errors, to ensure consistency of the words "program" and "agency" and to combine the definitions for prevention and prevention services. To update the definitions with changes from our constituents during our Continuium of Care meetings.

    NOTE: If the rule is not exempt at the time of final filing, two dates are required:

    This will have no impact on revenues or expenditures. 0.00

    No impact on ODADAS. Current staff will do a paper review of information to determine if the provider meets this standard. Agencies would have been preparing these records previously if they were practicing prevention strategies.

    No estimated costs associated with this rule. The processes listed are part of a good business practice that is already being followed in the field. The federal confidentiality law has already been in practice in the field.
