    PUBLIC HEARING NOTICE

    OHIO DEPARTMENT OF JOB AND FAMILY SERVICES

    Pursuant to section 3125.25 and Chapter 119. of the Ohio Revised Code, the director of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the adoption of the rules as identified below and of a public hearing thereon.

     

    The following Ohio Administrative Code (OAC) rules are being proposed for adoption to authorize the child support enforcement agency (CSEA) to accept or reject a request from an obligor to waive or compromise permanently assigned arrears, which is consistent with federal child support policies.

     

    ·         Rule 5101:12-60-70, "Request to waive or compromise arrears," provides definitions of terms that are used in this rule and its supplemental rule; describes the limitations regarding waiving and compromising arrears; describes what the obligor must provide to the CSEA to initiate the request and other information the CSEA may request of the obligor; explains that, when the arrears are assigned to another state, the CSEA must obtain the other state's agreement to waive the assigned arrears; describes how the CSEA must react when it receives a court order to waive or compromise conditionally or never-assigned arrears; and states that the CSEA may not solicit requests or initiate actions to waive or compromise arrears.

     

    ·         Rule 5101:12-60-70.1, "Acceptance of request to waive or compromise permanently assigned arrears," describes when the CSEA may approve a request to waive or compromise permanently assigned arrears and the factors the CSEA may consider during the decision of whether to accept the request; the information that must be included in an agreed entry or notice of acceptance; the actions the CSEA must take when an agreed entry is not journalized or filed within one hundred twenty days of its issuance; the actions the CSEA must take within twenty days of the date the CSEA receives an agreed entry that is journalized or filed; and when the CSEA may consider reinstating the arrears.

     

     

    Copies of the proposed rules are available, without charge, to any person affected by the rules at the address listed below.  The rules are also available on the internet at http://www.registerofohio.state.oh.us/.

     

    A public hearing on the proposed rules will be held at the date, time, and location listed at the top of this notice. Either written or oral testimony will be taken at the public hearing.

     

     

     

     

     

     

     

    Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
